IN exercise of the powers
conferred on the
Commander-in-Chief by section 97
of the Armed Forces Act, 1962 (Act
105) and after consultation with
the Armed Forces Council, these
Regulations are made this 27th
day of June, 1977.
Section 1—Article 206. 40 of C.I.
12 of 1970 Amended
The Armed Forces Regulations, 1970
(C.I. 12) as amended are hereby
further amended by the
substitution for Article 206.40
thereof of the following:—
"(1) Subject to (2) of this
article the rank for retired pay
purposes shall be the substantive
or acting rank or a higher acting
rank held by the officer on his
retirement if the rank has been
held on the Active list for a
minimum period of six months:
Provided that the prescribed
minimum period of six months shall
not apply to a person who has been
invalided.
(2) Where the substantive or
acting rank has been held for less
than the specified period the rank
for retired pay purposes shall be
the highest substantive or acting
rank which satisfied the
condition."
Section 2—Article 206. 42 of C.I.
12 of 1970 Revoked
Article 206.42 of the Armed Forces
Regulations, 1970 (C.I. 12)
hereby revoked.
