IN exercise of the powers
conferred on the
Commander-in-Chief by section 97
of the Armed Forces Act, 1962 (Act
105) and after consultation with
the Armed Forces Council, this
Regulation is made this 29th day
of March, 1976.
Article 206.01 of C.I. 12 of 1970
Amended.
The Armed Forces Regulation, 1970
(C.I. 12) as amended are hereby
further amended by the
substitution for Article 206. 01
(5) of the following:
"(5) 'Pensionable emoluments'—
(a) in respect of an officer means
the basic pay, service rank
increment and pensionable element
attached to the substantive or
acting rank or appointment held by
the officer or to a higher acting
rank held by him for six months or
more during the three years
preceding his release or transfer
to the Reserves:
Provided that the word appointment
in this paragraph shall refer only
to appointment to the office of
Chief of Defence Staff or Service
Commander;
(b) in respect of an officer
released after reduction in rank
by a disciplinary authority means
the basic pay, qualification pay,
service rank increment and
pensionable element attached to
the new rank;
(c) in respect of a man includes—
(i)
the basic pay and trade pay
attached to the substantive or
acting rank or higher acting rank
held by the man for six months or
more during the three years
preceding his release or transfer
to the Reserves;
(ii) service and rank increment;
(iii) pensionable element;"
