COURTS (AMENDMENT) ACT, 1993
AN ACT
to amend the Courts Act, 1993 (Act 459).

ENACTED
by Parliament as follows-
1. (1)
Notwithstanding any provision to the contrary in the
Jurisdiction Courts Act, the Circuit Court
established under the Courts Act, 1993 by Circuit
(Act 459) shall in addition to its jurisdiction in
civil matters have Court. and exercise the
jurisdiction in criminal matters conferred on the
Circuit Tribunal under section 44 (1) and (2) of the
Courts Act, 1993 (Act 459).
(2) The Circuit Court shall in the exercise of its
jurisdiction under subsection (1) of this section,
have all the powers vested in the Circuit Court in
existence immediately before the coming into " force
of the Courts Act, 1993 (Act 459) in respect of
criminal matters.
2. A
person aggrieved by a decision or order of the
Circuit Court Appeals
(a)
in a civil matter appeal to the Court of Appeal; and
Court.
(b)
in a criminal matter appeal to the High Court on
a question of law or fact against the acquittal,
conviction or sentence other than a sentence fixed
by law.
3. Notwithstanding any provision to the contrary in
the Courts Act, 1993 (Act 459), the District Court
Grade I in existence immediately before the coming
into force of the said Act shall have and exercise
the jurisdiction conferred on the Community
Tribunals under sections 47 and 48 of the Courts
Act, 1993.
4. (1) A person aggrieved by a judgment, decision or
order of the
District Court in a civil cause or matter may appeal
to the High Court against the judgment, decision or
order.
(2) The prosecution or a person convicted of an
offence by a District Court may appeal to the High
Court on a question of law or fact against the
acquittal, conviction or sentence other than a
sentence fixed by law.

The Courts Act, 1993 {Act 459) shall apply
subject to such modification as may be necessary to
give effect to this Act. ,
