OF THE PARLIAMENT OF THE REPUBLIC

OF GHANA

ENTITLED

THE COURTS (AMENDMENT) ACT- 2004

/\N ACT to amend the Courts Ac11993 (Act 459) to enable non-lawyers who have the requisite limited training in law to be appointed District Magistrates to rectify identified omission and repetition in the Courts Act and to provide for related purposes.

DATE OF ASSENT: 1st November; 2004

BE IT EN ACTED by Parliament as follows

Act 459 amended

The Courts Act 1993 (Act 459) as amended is further amended as fo11ows

    (a) in section 46, by the substitution for subsection (I ) of the following.

                 "Qualification of a Magistrate and sitting of the District Court

   (46. 1) A person does not qualify to be appointed a magistrate of a District Court unless the person is of high moral character and proven integrity and

             (i) is a lawyer, or

             (ii) is a person with such judicial or legal knowledge as the Chief Justice shall on the advice of the Judicial Council determine";                      

    (b) in section 15, by the insertion after sub section as follows:

"(la) For the purposes of paragraph (c) order requiring a person to enter into sentence"; and

   (c) in section 47( 1), by the repeal of paragraph (h)
