BORDER (GHANA-TOGO DEMARCATION) COMMISSION INSTRUMENT, 1975 (LI 1035).  

 

IN exercise of the powers conferred on the National Redemption Council by paragraph 1 of the Border Demarcation Commission, Decree, 1968 (N.L.C.D. 235) this Instrument is made this 10th day of July, 1975.

Section 1—Appointment of Commission.

(1) There is hereby appointed a Commission to be known as the Ghana Togo Border  Demarcation Commission.

(2) The Commission shall consist of the following members—

(i)  Mr. Sam Okudzeto, Legal Practitioner,

(ii) The Principal Secretary, Ministry of Lands and Mineral Resources or his representative,

(iii)  The Chief Survey Officer or his representative,

(iv) The Principal Secretary, Ministry of Internal Affairs or his representative,

(v)  The Principal Secretary, Ministry of Defence or his representative,

(vi) The Principal Secretary, Ministry of Foreign Affairs, or his representative,

(vii) The Principal Secretary, Ministry of Agriculture or his representative,

(viii)  The Commander of Border Guards or his representative,

(ix)  The Attorney-General or his representative,

(x) The Regional Administrative Officer, Volta Region or his representative.

Section 2—Chairman of Commission.

The said Mr. Sam Okudzeto shall be the Chairman of the Commission.

Section 3—Terms of Reference.

The terms of reference of the Commission are—

(a) to undertake the physical demarcation of the border between the Republic of Ghana and the Republic of Togo in the manner agreed upon between the Government of Ghana and the Government of the Republic  of Togo.

(b) to hold negotiations on any matters arising which concern the demarcation of the said border,

(c) to hold such enquiries as are necessary to solve any human problems occasioned by the present position of the said border and by the proposed border demarcation.

(d) To embody in its report appropriate recommendations for the preservation of the beaconing objects and the track marking the border.

Section 4—Commission to Submit Interim Report.

The Commission shall submit interim report to the National Redemption Council as and when the Commission deems it necessary and shall upon the completion of its work submit a full report to the Government.

Section 5— Secretary.

The representative of the Ministry of Foreign Affairs shall be Secretary to the Commission.

Section 6—Co-option of District Chief Executive.

(1) The Commission may where necessary co-opt any District Chief Executive in whose area demarcation operations may be in progress to advise and assist the Commission on local matters and on its work generally.

(2) No such co-opted member shall be entitled to vote at any meeting on any matter for decision by the Commission.

Section 7—Duties of Police in Respect of Commission.

The Inspector-General of Police shall detail Police Officers to attend upon members of the Commission, to preserve order during the work or proceedings of the Commission, to serve summons on witnesses and to perform other functions relating to the Commission as the members may direct.

Section 8—Commencement.

This Instrument shall be deemed to have come into force on 25th day of July, 1973.
