IN exercise of the powers
conferred on the President by
subsection (1) of section 43 of
the Civil Service Act, 1960 (C.A.
5) and acting in consultation with
the Public Services Commission
these Regulations are made this
11th day of November, 1971.
Regulation 1—Compulsory Retiring
Age for Civil Servants.
A
civil servant holding a
pensionable post otherwise than on
a limited engagement shall retire
from the Civil Service on reaching
the age of 55 years.
Regulation 2—Voluntary Retiring
Age.
A
civil servant holding a
pensionable post otherwise than on
a limited engagement may retire
from the Civil Service at any time
after he has reached the age of 50
in the case of a male civil
servant and 45 in the case of a
female civil servant:
Provided that a civil servant may
retire at an earlier date with the
consent of the President.
Regulation 3—Voluntary Retirement
Procedure.
(1) A civil servant who wishes to
retire voluntarily after attaining
the age of 50 years or 45 years as
the case may be shall seek the
approval of his Head of Department
at least three months before the
date on which he wishes to retire:
Provided that the requirement of
notice may be waived in whole or
in part at the discretion of the
President.
(2) A Head of Department shall
grant such permission unless
criminal or disciplinary
proceedings have been or are about
to be instituted against the civil
servant concerned.
(3) A civil servant who wishes to
retire voluntarily before
attaining the age of 50 years or
45 years as the case may be shall
submit his application to the
President through his Head of
Department together with a
statement of his reasons for
wishing to retire prematurely.
(4) The Head of Department shall
forward the application together
with his own recommendation to the
President through the Secretary to
the Cabinet.
Regulation 4—Transitional
Provisions.
(1) A civil servant holding a
pensionable post otherwise than on
a limited engagement who is 50
years of age or below at the date
of commencement of these
Regulations shall retire
compulsorily on attaining the age
of 55 years.
(2) A civil servant holding a
pensionable post otherwise than on
a limited engagement who is above
the age of 50 years at the
commencement of these Regulations
shall retire compulsorily at the
end of two years from the said
commencement or at the age of 55
years whichever is the later:
Provided that a civil servant to
whom this sub-regulation applies
shall in any case retire upon
attaining. the age of 60 years
unless otherwise exempted by the
President acting in accordance
with the advice of the Public
Services Commission.
(3) A civil servant holding a
pensionable post otherwise than on
a limited engagement, who is 60
years or above at the commencement
of these Regulations shall retire
forthwith unless he is otherwise
exempted by the President acting
in accordance with the advice of
Grant of the Public Services
Commission.
Regulation 5—Grant of Retiring
Awards Under Pensions Ordinance.
(1) Three months before a civil
servant holding a pensionable
post, otherwise than on a limited
engagement, is due to reach the
age of 55 years or in the case of
a civil servant who seeks
permission to retire voluntarily,
on receipt of his application, the
Head of Department shall consider
whether or not the civil servant's
service has been satisfactory.
(2) If the civil servant's service
has been satisfactory the Head of
Department shall issue a
certificate accordingly and
approve the grant of the retiring
award subject to computation and
verification by the
Auditor-General.
(3) If the Head of Department is
of the opinion that the civil
servant's service has not been
satisfactory, or if an order for
the Civil servant's removal has
been made, he shall report the
matter to the Public Services
Commission together with his
recommendation as to whether the
Civil Servant's retiring award
should be withheld in whole or in
part, and the Public Services
Commission shall advise the
President on the matter.
