WHEREAS the President is satisfied
that there should appointed a
Commission of Inquiry into the
international transfer of Ghana
Football players;
NOW THEREFORE, in exercise of the
powers conferred on the President
by clause (1) of article 278 of
the Constitution, this Instrument
is made this 9th day of March,
1999.
Section 1—Appointment of
Commission.
There is hereby appointed a
Commission of Inquiry composed of

Section 2—Terms of Reference of
Commission.
The terms of reference of the
Commission are —
(a) to examine the method of
operation in Ghana for
international transfer of
footballers to determine whether
the method used is in consonance
with the Regulations of Federation
of International Football
Association;
(b) to scrutinise existing
contracts for the international
transfer of any footballer to
determine whether the transfer was
made in accordance with any
special directive applicable at
the time of the contract;
(c) to determine in relation to
any contract entered into for the
international transfer of a
footballer whether the sums
negotiated under the contract was
declared by the club or agent to
the Ghana Football Association;
(d) to investigate any dispute
relating to any contract for the
international transfer of any
footballer;
(e) to ascertain whether proper
records of international transfer
of footballers are kept by the
Ghana Football Association or the
clubs concerned or by both;
(f) to inquire into any other
matter which appears to the
Commission to be incidental to or
reasonably related to the
foregoing and which in the opinion
of the Commission ought to be
inquired into;
(g) to make recommendations for
sanctions where considered
appropriate; and
(h) to submit its report to the
President giving reasons for its
findings and recommendations.
Section 3—Mode of Operation of
Commission.
The Commission shall carry out its
inquiry in accordance with
articles 279, 280 and 281 of the
Constitution.
Section 4—Secretary to the
Commission.
Miss Mercy Kwaah, Principal State
Attorney, Attorney-General’s
Department shall be secretary to
the Commission and shall perform
such administrative functions
relating to the work of the
Commission as the Commission may
direct.
Section 5—Appearance by Lawyer.
(1) Any person whose conduct is
the subject of inquiry by the
Commission or who is anyway
implicated, concerned in, or has
a legitimate interest in any
matter under investigation by the
Commission shall be entitled to be
represented by a lawyer at the
inquiry.
(2) Any other person who may
consider it desirable that he
should be represented by a lawyer
or any other expert may be allowed
by the Commission to be so
represented.
Section 6—Privileges and
Immunities of Witness and Lawyer.
A
witness or lawyer appearing before
the Commission shall be entitled
to the same privileges and
immunities as a witness or lawyer
appearing before the High Court.
Section 7—Expenses in Relation to
Commission.
(1) A witness summoned by the
Commission shall be entitled to
such allowances as are payable to
a witness summoned by the High
Court in a Criminal trial.
(2) The chairman and other members
of the commission and any person
employed in relation to the
functions of the commission may be
paid such travelling sitting and
other allowances as the president
may approve on the recommendations
of the Minister responsible for
Finance.
Section 8—Public Officers to
Assist Commission.
The Inspector General of Police
shall assign officers to attend
upon the Commission, to serve
summones on witnesses and to
perform such other functions
relating to the Commission as the
Commissioners may direct.
