WHEREAS upon a petition presented
in that behalf the President and
the Council of State are satisfied
that there is a substantial demand
for alteration of the boundaries
between the Eastern and Volta
Regions of Ghana.
NOW THEREFORE in exercise of the
powers conferred on the President
by articles 4 and 165 of the
Constitution and acting in
accordance with the advice of the
Council of State this Instrument
is made this 24th day of May,
1971.
Section 1—Appointment of
Commission.
There is hereby appointed a
Commission of Inquiry consisting
of the following persons:—
(a) Mr. Justice F. K. Apaloo,
Supreme Court Judge;
(b) Nana Wiafe Akenten II,
Omanhene, Offinso Traditional
Area;
(c) Dr. A. K. P. Kludze, Faculty
of Law, University of Ghana;
(d) Mr. J. K. Essiem,
Barrister-at-Law, Sekondi;
(e) Mr. T. E. Kyei, Retired Civil
Servant. [As substituted by

Section 2—Chairman of the
Commission.
The said Mr. Justice F. K. Apaloo
shall be the Chairman of the
Commission.
Section 3—Terms of Reference.
The Commission shall inquire into
the claim that the towns of Finte
and Frankadua and the villages of
Ahovikope and Norvekope and their
surrounding lands are part and
parcel of the Duffor Traditional
Area and consequently should form
part of the Volta Region.
(2) In determining whether the
said towns and villages are part
and parcel of the Duffor
Traditional Area the Commission
shall consider the following
matters:—
(a) whether or not the people in
the said towns and villages are
Ewes;
(b) whether or not the people in
the said towns and villages have
any cultural and linguistic
affinity with the people in the
Duffor Traditional Area;
(c) whether or not the people in
the said towns and villages owe
allegiance to the ancestral stool
of the Duffor Traditional Area.
Section 4—Commission to Report its
Findings to the President.
The Commission shall report its
findings to the President stating
whether in the light of its
findings the said towns and
villages are part and parcel of
the Duffor Traditional Area and
consequently should form part of
the Volta Region.
Section 5—Mode of Operation.
The Commission shall carry out its
inquiry in accordance with the
provisions of articles 166, 167
and 168 of the Constitution.
Section 6—Secretary.
Mr. Emmanuel Tetteh, Principal
Executive Officer, Ministry of
Education, Culture and Sports
shall be secretary to the
Commission.
Section 7—Expenses of the
Commission.
(1) Any witness summoned by the
Commission shall be entitled to
such allowances as are payable to
a witness summoned by the High
Court in a criminal trial.
(2) The Prime Minister may, with
the approval of the Cabinet
authorise the payment of such
remuneration (if any) as the
Cabinet may decide to members of
the Commission, the Secretary and
to any other person employed in
connection with the work of the
Commission.
Section 8—Police Officers to
assist the Commission.
The Inspector-General of Police
shall detail police officers to
attend upon the Commission to
preserve order during the
proceedings of the Commission, to
serve process on witnesses and to
perform such other functions
relating to the work of the
Commission as the Commissioners
may direct.
