COMMISSION OF INQUIRY (GREATER-ACCRA REGION) INSTRUMENT, 1970 (CI 5)

WHEREAS upon a petition presented in that behalf the Presidential Commission and the Council of State are satisfied that there is a substantial demand for the creation of an additional Region, namely the Greater-Accra Region:

NOW THEREFORE, in exercise of the powers conferred on the Presidential Commission by articles 4 and 165 of the Constitution and acting in accordance with the advice of the Council of State this Instrument is made this 13th day of May, 1970.

Section 1—Appointment of Commission.

There is hereby appointed a Commission of Inquiry consisting of the following persons: —

(a) Mr. Justice Enoch Edusei, High Court Judge;

(b) Nana Akyin VI, President of the Central Region House of Chiefs;

(c) Mr. D. M. Akotiah, Legal Practitioner;

(d) Mr. J. K. A. Tamakloe, Accra;

(e) Dr. M. B. Acquaye, University of Science and Technology, Kumasi. [As substituted by Commission of Inquiry (Greater Accra Region) (Amendment) Instrument, 1971 (CI 14), (a)].

Section 2—Chairman of the Commission.

The said Mr. Justice Enoch Edusei shall be the Chairman of  the Commission.

Section 2A—Quorum.

The quorum of the Commission shall be three members. [As inserted by Commission of Inquiry (Greater Accra Region) (Amendment) Instrument, 1971 (CI 14), (b)].

Section 3—Terms of Reference.

(1) The Commission shall inquire into the aforesaid demand for the creation of a Region in respect of the area generally known as the Greater-Accra Region and to make recommendations on all the factors involved in such creation.

(2) For the purposes of its functions under sub-paragraph (1) of this paragraph it shall be the duty of the Commission—

(a)  to examine the feasibility of administering the said Greater-Accra Region, extended to include the districts of Awutu and Ada, having regard to the geographical, agricultural, economic and social characteristics of the area resulting from such extension,

(b) to determine whether the creation of the Greater-Accra Region into a political entity as distinct from its present administrative status will in any way enhance the effectiveness of the administration of the areas to be so affected, having regard to the new policy of decentralisation,

(c)  to ascertain whether the population in the areas to be affected are homogeneous enough traditionally and the number of traditional units sufficiently substantial to warrant the establishment of a Regional House of Chiefs as required by article 155 of the Constitution,

(d) to determine whether there is a substantial demand for the creation of the new Region among the peoples of the area to be affected,

(e) to report their findings to the Presidential Commission stating whether in the light of their findings there is a need for the creation of the Greater-Accra Region envisaged.

Section 4—Mode of Operation.

The Commission shall carry out its inquiry in accordance with the provisions of articles 166, 167 and 168 of the Constitution.

Section 5—Secretary.

Mr. Albert O'Brien Kodowo-Mensah of the Ministry of Education, Culture and Sports shall be secretary to the Commission. [As substituted by Commission of Inquiry (Greater Accra Region) (Amendment) Instrument, 1971 (CI 14), (c)].

Section 6—Expenses of the Commission.

(1) Any witness summoned by the Commission shall be entitled to such allowances as are payable to a witness summoned by the High Court in a criminal trial.

(2) The Prime Minister may, with the approval of the Cabinet authorise the payment of such remuneration (if any) as the Cabinet may decide to members of the Commission, the Secretary and to any other person employed in connection with the work of the Commission.

Section 7—Police Officers to Assist Commission.

The Inspector-General of Police shall detail Police Officers to attend upon the Commissioners to preserve order during the proceedings of the Commission, to serve process on witnesses and to perform such other functions relating to the work of the Commission as the Commissioners may direct.
