COMMISSION OF INQUIRY INTO THE
CREATION OF NEW REGIONS, 2017 C.

WHEREAS,
Article 5 of the Constitution
empowers the President to
appoint a commission of inquiry
to inquire into the need and
substantial demand for the
creation and alteration of
regions;
WHEREAS,
the President has received a
number of petitions from
Western, Brong Ahafo, Northern
and Volta Regions, demanding the
creation of new regions;
WHEREAS,
as required, the President has,
by letter, dated 26th
June, 2017, referred the
petitions to the Council of
State for its advice;

WHEREAS,
pursuant to the petitions, the
Council of State is of the view
that there is a need and
substantial demand for the
creation and alteration of
regions, and has accordingly
advised, by letter, dated 15th
August, 2017, the President to
appoint a commission of inquiry
to inquire into the need and
demand;
WHEREAS,
the President is satisfied that
there is a need and substantial
demand for the creation and
alteration of regions;
WHEREAS,
the Commission shall make
recommendations to the President
on all the factors involved in
the creation and alteration of
regions;
NOW THEREFORE,
in exercise of the powers
conferred on the President under
Article 5 of the Constitution,
this Instrument is made this
12th day of October, 2017.
Establishment of Commission of
Inquiry
1. There is hereby established
by this Instrument a Commission
of Inquiry, which shall
hereinafter be referred to as
the "Commission".
Membership of the Commission of
Inquiry
2. The members of the Commission
are:
Secretary to the Commission of
Inquiry
3. The President shall appoint a
Secretary to the Commission, who
shall perform such functions as
may be assigned by the
Commission.
Terms of Reference of the
Commission of Inquiry
4.
The terms of reference of the
Commission are:
(a)
to inquire, pursuant to the
petitions, into the need and
substantial demand for the
creation of new regions and,
thereby, the alteration of
Western Region, Brong Ahafo
Region, Northern Region and
Volta Region;
(b)
to make recommendations to the
President, based on its
findings, on the creation and
alteration of regions; and
(c)
to specify the issues to be
determined by referendum and the
places where the referendum
should be held, where it makes
recommendations for the creation
and alteration of regions.
Mode of operation of the
Commission of Inquiry
5.
(1) The Commission shall carry
out its inquiry in accordance
with
(a)
Article 5 of the Constitution;
and
(b)
this Instrument.
(2) The decisions of the
Commission, including its
report, with its findings and
recommendations, shall, as far
as possible, be taken by
consensus or, in the absence of
a consensus, by a majority of
the members of the Commission.
Panels of the Commission of
Inquiry
6. In order to expedite its
work, the Commission is hereby
authorized, if it deems it
necessary, to sit in panels of
at least four (4) Commissioners,
provided, however, that the
entire Commission will adopt the
work of these panels.
Technical support team
7. The Minister responsible for
Regional Reorganisation and
Development may engage a
Technical Team to provide
technical support to the
Commission.
Public officers to assist the
Commission of Inquiry
8. (1) The President may, on the
recommendation of the
Commission, assign such officers
from the Public Service to the
Commission as may be required
for the effective functions of
the Commission.
(2) Without limiting the
generality of subsection (1),
the President may, on the
recommendation of the
Commission, assign to the
Commission such security
personnel as may be necessary
for the effective functioning of
the Commission.
Submission of report
9. The Commission shall submit
its report, with its findings
and recommendations, to the
President, not later than six
(6) months after its
inauguration.
