WHEREAS the President is satisfied
that there should be appointed a
Commission of Inquiry into the
salaries and wages in the public
services;
NOW THEREFORE in exercise of the
powers conferred on the President
by clause (1) of article 196 of
the Constitution, this Instrument
is made this 14th day of April,
1980.
Section 1—Appointment of
Commission.
(1) There is hereby appointed a
Commission of Inquiry consisting
of the following persons:—

(2) The Commission shall at
anytime be deemed to be duly
constituted if the Chairman and
one other member are present.
Section 2—Terms of Reference.
(1) The terms of reference of the
Commission shall be—
(a) to inquire into and ascertain
the extent to which there is
disparity in emoluments of civil
servants and their counterparts in
the other public services
including the emoluments of
employees of statutory
corporations whether or not they
form part of the public services
within the meaning of the
Constitution;
(b) to examine the salary
proposals submitted by the Civil
Service Negotiating Machinery with
the aim of making proposals for
the removal of any such disparity,
taking into account the job
classifications and qualifications
required for the establishment of
parity in the emoluments of public
officers;
(c) to enquire into any other
matters which appears to the
Commission to be incidental to or
reasonably related to the
foregoing and which in the opinion
of the Commission ought to be
enquired into; and
(d) to submit its findings to the
President not later than the 31st
day of May, 1980, giving reasons
therefor and making such
recommendations as it may consider
appropriate for the adjustment of
the salary and wage structures and
scales of public officers.
(2) The provisions of
sub-paragraph (1) of this
paragraph shall not apply to
persons specified in article 58 of
the Constitution, the Armed Forces
and Police Service.
Section 3—Mode of Operation of
Commission.
The Commission shall carry out its
inquiry in accordance with the
provisions of articles 197, 198
and 199 of the Constitution.
Section 4—
Mr. R. S. Acolatse shall be
Secretary to the Commission and
shall perform such administrative
functions relating to the work of
the Commission as the Commission
may prescribe.
Section 5—Privileges and
Immunities of Witnesses and
Counsel.
A
witness or counsel appearing
before the Commission shall be
entitled to the same privileges
and immunities as a witness or
counsel appearing before the High
Court.
Section 6—Expenses in Relation to
Commission.
(1) Any witness summoned by the
Commission shall be entitled to
such allowances as are payable to
a witness summoned by the High
Court in a criminal trial.
(2) The Chairman and other members
of the Commission and any persons
employed in relation with the
functions of the Commission may be
paid such travelling, sitting and
other allowances, if any, as the
President may approve on the
recommendations of the Minister
responsible for Finance.
Section 7—Public Officers to
Assist Commission.
(1) The officers of the Commission
known as the Salary Review
Commission and the officers of the
Prices and Incomes Board
established by the Prices and
Incomes Board Decree, 1972 (N.R.C.D.
119) responsible for matters
relating to incomes shall be
assigned to the Commission to
assist the Commission in the
discharge of its functions under
this Instrument.
(2) The Inspector-General of
Police shall detail officers to
attend upon the Commission to
serve summonses on witnesses and
to perform such other functions
relating to the Commission as the
Commissioners may direct.
