ARRANGEMENT OF SECTIONS

Commission
WHEREAS the President is satisfied
that there should be appointed a
Commission of inquiry into the
release of five prisoners from
Ussher Fort Prison on the 12th day
of November, 1979.
NOW THEREFORE in exercise of the
powers conferred on the President
by clause (1) of article 196 of
the Constitution this Instrument
is made this 15th day of November,
1979.
Section 1—Appointment of
Commission.
(1) There is hereby appointed a
Commission of Inquiry consisting
of the following persons:—
Mr. Justice George Francois .
. . . Justice of the
Court of Appeal
Mr. E. C. Quist-Therson .
. . . Retired Civil
Servant
Mr. A.S. K. Allotey . .
. . . . Retired
Director of Prisons.
(2) The said Mr. Justice George
Francois shall be Chairman of the
Commission.
Section 2—Terms of Reference of
Commission.
The terms of reference of the
Commission shall be—
(a) to investigate the
circumstances leading to the
release from Ussher Fort Prison in
the night of the 12th day of
November, 1979 of five prisoners
namely—
Capt. Victor Okaikoi
Capt. Edmund K. Koda
S/Sgt. John Quartey
Sgt. John Asmah
George Chinebuah
(b) to establish who were the
persons responsible for the
release of the said prisoners;
(c) to investigate whether any
public officers were in any way
connected with bringing about or
facilitating the release or
preventing the detection of the
release;
(d) to investigate whether or not
the law regulating the detention
of prisoners was duly observed in
relation to the said five
prisoners;
(e) to investigate whether or not
the said prisoners were convict
prisoners held under warrants of
commitment duly issued;
(f) to investigate any other
matter which appears to the
Commission to be reasonably
related to the foregoing and which
in the opinion of the Commission
ought to be investigated; and
