                   ARMED FORCES REVOLUTIONARY COUNCIL DECREE

 

COMMITTEE OF INQUIRY (STATE HOUSING CORPORATION) (IMPLEMENTATION OF FINDINGS) DECREE, 1979 (AFRCD 69)

 

ARRANGEMENT OF SECTIONS

Section

SCHEDULES

First Schedule—Houses forfeited to the State

WHEREAS on the 10th day of August, 1979 the Armed Forces Revolutionary Council caused to be published certain findings made by the Committee of Inquiry into the Affairs of the State Housing Corporation appointed under section 26 of the National Redemption Council (Establishment) Proclamation, 1972;

AND WHEREAS the said findings declared that there were certain irregularities and malpractices in the allocation of estate houses built by the Corporation and in the dealings of certain persons with the Corporation;

AND WHEREAS the Armed Forces Revolutionary Council deems it fit to give due effect to the said findings;

NOW, THEREFORE, BE IT ENACTED by the Armed Forces Revolutionary Council as follows:

Section 1—Certain Houses Forfeited to the State.

The houses described in the first column of the First Schedule to this Decree, belonging to the persons specified in the second column in relation to each of the said houses in the said Schedule, are hereby forfeited to the State and accordingly are hereby vested in the State free from all incumbrances whatsoever.

Section 2—Certain Houses Revested in the State Housing Corporation.

(1) The estate houses described in the first column of the Second Schedule to this Decree, belonging to the persons specified in the second column in relation to each of the houses in the said Schedule, are hereby revested in the State Housing Corporation for reallocation free from all incumbrances whatsoever.

(2) Notwithstanding the provisions of subsection (1) of this section any person whose estate house has been so revested may opt for a refund of any moneys paid by him to the State Housing Corporation in respect of the house or for the moneys to be applied towards the purchase price of another estate house, so however that in the case of the last two named persons in the said Schedule their moneys shall be refunded without any option.

Section 3—Certain Persons to Surrender One House each to the State Housing Corporation.

(1) The persons specified in the Third Schedule to this Decree shall each surrender forthwith free from all incumbrances whatsoever to the State Housing Corporation one of the estate houses described in relation to him in the said Schedule.

(2) The State Housing Corporation shall refund any moneys paid by the said persons in respect of the houses surrendered to the Corporation.

Section 4—State Housing Corporation not Liable for Cost of Extensions, Etc.

The State Housing Corporation shall not be liable to pay the cost of any extensions, improvements or renovations made to any of the houses revested in or surrendered to the Corporation under the provisions of sections 2 and 3 of this Decree.

Section 5—Surrender of Property.

Any person who immediately before the coming into force of this Decree is in possession of any of the estate houses referred to in the said First, Second and Third Schedules shall surrender it forthwith to the Armed Forces Revolutionary Council or to any person authorised by the Council or to the State Housing Corporation as the case may be.

Section 6—Ex gratia Payments.

The Government may, in its discretion and notwithstanding anything to the contrary, make provisions for the compensation of any person who satisfies the Government that he had granted any loan on the security of any property forfeited to the State by this Decree, being a loan any part of which remains for the time being unpaid.

Section 7—Persons to Pay Unlawfully Acquired Moneys to the State.

Each of the persons specified in the first column of the Fourth Schedule to this Decree shall pay forthwith into Government chest the sum specified in relation to him in the second column of the said Schedule.

Section 8—Persons to Refund Certain Amounts to the State Housing Corporation.

Each of the persons specified in the first column of the Fifth Schedule to this Decree shall pay forthwith to the State Housing Corporation the sum specified in relation to him in the second column of the said Schedule.

Section 9—Offences.

Any person who—

(a) refuses or without reasonable excuse, proof of which shall be on him, fails to surrender any estate house or pay any money required to be surrendered or paid under this Decree; or

(b) otherwise obstructs the Armed Forces Revolutionary Council or any person authorised by the Council or the State Housing Corporation in the recovery of the revesting of any of the estate houses specified in the said First and Second Schedules in the State or the State Housing Corporation,

shall be guilty of an offence and liable on conviction to a fine not exceeding ¢10,000.00 or to imprisonment not exceeding ten years or to both.

Section 10—Commencement.

This Decree shall be deemed to have come into force on the 10th day of August, 1979.
