ENTITLED

COPYRIGHT (AMENDMENT) ACT, 2009

AN ACT to amend the Copyright Act, 2005 (Act 690) to revise the provision on the security device; provide an arrangement for the collection of royalties and for related matters.

ENACTED by the President and Parliament:

Section 25 of Act 690 amended

I. Section 25 of the Copyright Act referred to as the principal enact­ment is amended by the insertion of new subsections (2a) and (2b)

U(2a) Despite subsection (1), a manufacturer, importer or publisher of a sound or audio-visual recording may use an alternative security device chosen by that manu­facturer, importer or publisher and approved by the Minister to cover the number of copyright works that the manufacturer, importer or publisher intends to sell or distribute.

(2b) A manufacturer, importer or publisher of a sound or audio-visual recording who intends to use an alternative security device shall

(a) register the device with the Internal Revenue Service after the approval of the Minister, and (b) deposit the quantity of the alternative security device with the Internal Revenue Service.

(2c) The Internal Revenue Service shall have the alter­native security device affixed to the sound or audio­visual recording.

(2d) The alternative security device used by the manufac­turer, importer or publisher shall be a device that provides a superior method of protection to the device approved by the Minister under subsection (1)".

Section 77 of Act 690 amended

2. The Principal enactment is amended by the insertion after section 77 of section 77 A

"Transitional Provisions 77 A The Minister shall

(a) adopt measures that ensure that the rights of authors, producers, publishers and performers are collectively administered, promoted and protected; and

(b) collect and distribute any royalties or other remuneration accruing to authors until societies are formed under the Regulations."
