IN exercise of the power
conferred on the Rules of Court
Committee by clause (2) of
article 157 of the Constitution,
these Rules are made this 22nd
day of September, 2016.
Rule 43 of C.!. 19 substituted
The Court of Appeal Rules, 1997
(C.I. 19) are amended by the
substitution for rule 43 of
"Review of decision of single
Justice
43. (1) A person dissatisfied
with the decision of a single
Justice of the Court of Appeal
in respect of an application
determined under article 138 of
the Constitution, may apply to
the Court of Appeal to have the
application deter- mined by
three Justices of the Court.
(2) The application to have the
cause or matter deter- mined by
the three Justices shall be by
motion on notice and shall be
served on any other party who
has an interest in
the cause or matter.".
