WHEREAS the Nkoranza
Traditional Council under the
provisions of Section 51 of the
Chieftaincy Act 2008, (Act 759),
recommended to the National
House of Chiefs through the
Brong-Ahafo Regional House of
Chiefs a modification of the
customary law relating to
succession to the Nkoranza
Paramount Stool; the name of the
Skin of the Traditional Area is
Baffo Pim Stool and the seat of
the Stool shall be at Nkoranza.
WHEREAS the Brong Ahafo
Regional House of Chiefs upon
representation from the Nkoranza
Traditional Council and backed
by their own initiative
submitted to the National House
of Chiefs have declared that in
their opinion the customary law
relating to succession in the
Nkoranza Traditional Area needed
a declaration;
AND WHEREAS by a
unanimous decision the
initiative has been accepted by
the National House of Chiefs;
NOW THEREFORE under the
powers conferred on the National
House of Chiefs by Article 272
(b)
of the 1992 Constitution, to
inter alia compile the customary
laws and lines of succession to
the Baffo Pim Stool; and in
compliance with the above
mentioned provisions, the
following procedures are hereby
adopted:
1. Succession to the Baffo Pim (Asene)
Paramount Stool of the Nkoranza
Traditional Area shall be
strictly non rotatory in the
Nkoranza Traditional Area
2. On the death of the occupant
of the Baffo Pim Paramount Stool
the Omanhemaa shall in
consultation with the
Abusuapayin, Ankobeahene,
Gyasehene and Pemasehene
nominate according to
established customary law
pertaining to a Chief and
present an occupant to succeed
the deceased as contained in
paragraph 1.
The Amakomhene, Antoahene and
Kwamohene shall advise and
supervice the installation to
ensure that it conforms to
customs and usage.
3. At anytime that the Baffo
Pirn Paramount Stool becomes
vacant by reason of abdication,
de-stoolment or any other cause,
succession shall be in the
manner specified in paragraph I
or as may be in the established
customary manner as if the
vacancy has occurred by death.
Nomination
4. (1) The Omanhemaa shall in
consultation with the
Abusuapanim,
.
Ankobeahene,
Gyasehene and Pemasehene make
their choice to the Kingsmakers
through the Pemasehene,
Gyasehene and Ankobeahene.
(2) Nomination of a candidate
for the Baffo Pim Stool shall be
done at any time on a Monday or
Thursday, forty days after the
Stool had become vacant.
(3) Nomination of a candidate
for the Baffo Pim Stool shall be
done at the Omanhemaa's Palace.
Election or selection
5.
(l)The election or selection of
a candidate to the Baffo Pim
Stool shall be done by the
Omanhemaa, Gyasehene,
Ankobeahene and Pemasehene.
(2) Any number of qualified
candidates shall apply with
drinks and cash through elderly
people to the Omanhemaa for
consideration to be elected or
selected as the Omanhene.
(3) The election and selection
of a candidate to the Baffo Pim
Stool shall take place in the
forenoon at the
Omanhemaa'sPalace.
Installation
6.
(1) The Akyeamehene assisted by
the Kingmakers as mentioned in
paragraph 2 of this instrument
shall instal the new Nkoranza
Omanhene.
(2) The installation process of
a new Nkoranza Omanhe ne shall
be as follows:
(a)
the Chief's installation shall
take two days,
(b)
on the first day the Gyasehene
and Pemasehene shall present the
Chief-elect to the Akyeamehene,
(c)
the Akyeamehene shall take the
Chief-elect to Gyeduakese or
Dwabrem, where the installation
shall be done,
(d)
the Chief-elect shallbe
introduced to the public at
Geduakrase or Dwabrem,
;
(e)
the Akyeamehene with the
assistance
ofthe Kingmakers shall hold the
hand of the Chief-elect and
place him on an Asesedwa (Stool)
three times,
(f)
the Chief-elect shall be carried
shoulder high with powder
smeared on him and paraded
through the town amid singing,
drumming and dancing. He shall
be taken to town and back to the
palace three times,
(g)
on the second day the
Chief-elect shall meet all the
sub-chiefs at the Omanhene's
palace,
(h)
the Chief-elect shall swear the
oath of office to the chiefs and
Elders and each Chief and Elder
shall in turn swear the oath of
allegiance to the new Chief,
(I)
the Ankobeahene, Gyasehene,
Pemasehene, Kyidomhene, and
Akwamuhene shall meet the new
Omanhene at the Stool House,
(j)
the Omanhene shall be shown the
Black Stool and other stool
regalia and the same handed over
to him by the Gyasehene and
inventory shall be prepared by
the Gyasehene and signed by him
and the new Omanhene and
witnessed by the
Akwamuhene, Kyidomhene,
Pemasehene and Ankobeahene, and
(k)
the new Chief's installation
shall be said to be comsummated
after he has sworn the oath of
office; taken over the Black
Stool and other Stool regalia
and a sheep slaughtered and has
sworn the oath of allegiance to
the Golden Stool of Asante.
Destoolment offences
7. A Chief shall be destooled
for committing any of the
following offences:
(a)
embezzlement of Nkoranza
Traditional council funds,
(b)
refusing to perform customary
rites,
(c)
extra marital relationship with
spouses of subjects or other
persons, or
(d)
doing any act that affects the
dignity of the Stool.
Destoolment process
8.
The destoolment charges against
the occupant of the Baffo Pim
Stool of the Nkoranza
Traditional Area shall be
prepared by two-thirds (213)
of the Kingmakers mentioned in
Paragraph 2 of this instrument.
Destoolment procedure
9.
The destoolment procedure for
the occupant of the Baffo Pim
Stool shall be as follows:
(a)
the Charges shall be lodged with
the Amakomhene, Antoahene,
Agonahene and Kwamohene,
(b)
the Amakomhene, Antoahene,
Agonahene and Kwamohene shall
give the Omanhene the chance to
defend the charges preferred
against him and attempt to solve
the problem,
(c)
the Omanhene shall be warned and
pardoned if the offences are not
so grievious,
(d)
the Omanhene shall be warned
three times if he persists in
committing the offences, and
(e)
the offences shall be lodged
with Brong Ahafo Regional House
of Chiefs when the chief commits
any of the offences after the
third pardon.
Completion of destoolment
10.
(1) The destoolment of the
occupant of the Baffa Pim Stool
of the Nkoranza Traditional Are
shall be complete when the
Omanhene is found guilty of any
of the offences mentioned in
paragraph 7 above and a sheep is
slaughtered by all the
Kingmakers and the foreleg given
to and
accepted by the Asantehene, the
overlord.
(2) The destooled Chief shall be
made to hand over all the stool
properties to the Gyasehene.
Kingmakers
11.
The Kingmakers of the Baffa Pim
Stool of the Nkoranza
Traditional Area shall be the:
(a) Omanhemaa,
(b) Krontihene,
(c) Gyasehene,
(d) Adontenhene,
(e) Akwamuhene,
(f)
Pemasehene,
(g)Ankobeahene,
(h)Kyidomhene,
(i)Nifahene,
(j)Benkumhene,
(k)Akyeamehene, and
(l)Twafohene.
System of
inheritance
12.
Succession to
the Baffa Pim
Stool of the
nkoranza
Traditional Area
shall be by the
matrilineal
system of
inheritance.

Subject to Golden Stool
13.
For the avoidance of doubt the
Baffo Pim Stool of the Nkoranza
Traditional Area is subject to
only the Golden Stool of Asante.
