IN exercise of the powers
conferred on the Secretary
responsible for National Revenue
by section 11 of the National
Weekly Lotto Act 1961 (Act 94) and
in consultation with the Secretary
responsible for Local Government,
these regulations are made this
14th day of November 1989.
Regulation 1—Control of District
Lotto.
No person shall operate a District
Weekly Lotto unless he holds a
licence granted for that purpose
by the District Assembly of the
administrative area where the
lotto is intended to be operated.
Regulation 2—Application for
Licence.
(1) An application for a licence
under regulation 1 shall be made
to the District Assembly
accompanied by—
(a) two passport size photographs
of the applicant;
(b) evidence of a bank account of
the applicant; and
(c) such other particulars as the
District Assembly may request.
(2) No licence shall be granted
under these Regulations to any
person unless the person is of the
age of eighteen or above years and
is a citizen of Ghana.
(3) There shall be paid in respect
of every licence granted under
these Regulations such annual fee
as the District Assemblies may by
bye-laws determine.
(4) A licence issued under these
Regulations shall be renewable.
Regulation 3—Revocation of
Licence.
A
District Assembly shall revoke a
licence granted under these
Regulations where the operator—
(a) is convicted of an offence
relating to lotto; or
(b) is unable to maintain the
deposit payable under section 8A
of the National Lotto Act, 1961
(Act 94).
Regulation 4—Deposit for Operation
of District Weekly Lotto.
(1) Any applicant seeking a
licence for the operation of a
Weekly Lotto shall pay to the
relevant District Assembly a
deposit of such sum as the
District Assembly shall direct.
(2) Subject to sub-regulation (3)
of this regulation the amount of
the deposit shall at all times be
maintained in full.
(3) The deposit shall be the asset
of the operator but shall be
available to him only—
(a) where he cannot in the opinion
of the District Assembly
reasonably meet his liabilities
arising from any weekly lotto from
his available resources for the
payment of any prize monies and
the winnings remain unpaid for
more than fifteen days from the
date of presentation for payment;
or
(b) where he ceases to operate the
District Weekly Lotto.
(4) Any withdrawal made out of the
deposit under this regulation
shall be replaced by the operator
within thirty days from the date
of the withdrawal.
Regulation 5—Places for Operating
Lotto.
(1) Every licensed operator shall
have an identifiable location
approved by the District Assembly
for his operations.
(2) The location for the operation
of a District Weekly Lotto shall
be in a public place to which the
general public have access.
Regulation 6—Agents of Operators.
(1) A licensed operator may
appoint such a number of agents as
he deems fit for the purpose of
operating the lotto.
(2) A licensed operator shall
deposit at the offices of the
District Assembly two passport
size photographs of any agents
employed by him together with
their particulars and shall notify
the District Assembly where any
change in the particulars
submitted occurs.
Regulation 7—Coupons.
(1) Every licensed operator shall
be responsible for the printing of
all coupons to be issued by him
for the operation of the lotto.
(2) A licensed operator shall
submit a sample of coupons
intended to be used by him for the
operation of the lotto to the
District Assembly for approval.
(3) The District Assembly shall
upon approval of sample coupons
keep copies of the approved
coupons and identify set of
coupons to distinguish them from
any other coupons in use in any
other district.
(4) Approved coupons shall be
serially numbered to distinguish
them from those of any other
operator.
Regulation 8—Control of Operators.
A
District Assembly shall be
responsible for the control and
Supervision of every lotto
operated in its area of
administration and shall for that
purpose have power at all
reasonable times to authorise such
persons as it deems fit to inspect
the operations of an operator
within the District.
Regulation 9—Operators to Keep
Records.
(1) A licensed operator shall keep
records of—
(a) Coupons approved for his use
in the operation of the lotto;
(b) a register of sales of
coupons; and
(c) a register of his agents.
(2) Any record kept under
regulation (1) of this regulation
shall be available for inspection
by any authorised officer of the
District Assembly.
Regulation 10—Returns.
(1) Every operator shall submit to
the District Assembly quarterly
returns of coupons collected and
sold in respect of his operations.
(2) For the purposes of compiling
statistics on lotto in Ghana every
District Assembly shall at the end
of every year commencing 31st
December, 1989 submit returns on
the operation of the lotto within
its administrative area to the
Director of National Lotteries.
Regulation 11—Offences and
Penalties.
Any person who—
(a) operates a lotto without a
licence, contrary to regulation 1
of these Regulations;
(b) issues fraudulent coupons; or
(c) acts in contravention of any
of the provisions of these
Regulations is guilty of an
offence and. shall be liable on
conviction to a fine not exceeding
¢50,000 or imprisonment for a term
not exceeding 6 months or to both.
