FOREIGN EXCHANGE (CEDI VOUCHER) REGULATIONS, 1976 (LI 1062).

 

IN exercise of the powers conferred on the Commissioner responsible for Finance by section 38 of the Exchange Control Act, 1961 (Act 71), these Regulations are made this 27th day of January, 1976.

Regulation 1—Visa or Entry Permit to be Granted upon Purchase of Cedi Voucher.

(1) Subject to the provisions of the Aliens Act, 1963 (Act 160) and to the provisions of these Regulations no visa or entry permit shall be granted to any person travelling to Ghana referred to in these Regulations as the "traveller" unless he has purchased for exchange in Ghana the Cedi Voucher referred to in subregulation (2) of this regulation issued by the Bank of Ghana.

(2) A traveller shall be required to purchase in foreign exchange a voucher of not less than U.S. $50.00 in value or such additional amount as the Bank of Ghana may determine.

Regulation 2—Ghana Diplomatic Mission or Consulate to Sell Voucher.

A traveller shall purchase the voucher from an authorised agent of the Bank of Ghana in the diplomatic mission or consulate of Ghana in the country where the traveller is resident or from which he intends to travel to Ghana.

Regulation 3—Endorsement of Passport or Travel Document of Traveller.

The value of a voucher purchased by a traveller shall be endorsed on the visa or entry permit in his passport or travel document by the authorised agent of the Bank of Ghana.

Regulation 4—Voucher is Non-negotiable and is not to be Re-exchanged.

(1) The voucher which is non-negotiable shall be encashed only in Ghana by an authorised dealer at its face value in Ghana currency at the rate of exchange applicable at the time of payment between the cedi and the foreign exchange used in purchasing the voucher.

(2) A voucher shall not be re-exchanged for any foreign exchange.

Regulation 5—Traveller in Ghana With no Evidence of Purchase of Voucher.

(1) Where a traveller who arrives in Ghana shows no evidence in his passport or travel document that he has purchased the voucher the immigration officer shall not grant him a permit to enter Ghana unless he has purchased the voucher from an authorised dealer at the port or place of disembarkation.

(2) A traveller who refuses to comply with subregulation (1) of this regulation shall not be granted permit to enter Ghana and shall be ordered to leave Ghana immediately.

Regulation 6—Immigration Officer to inspect Passport or Travel Document.

It shall be the duty of an immigration officer or a person authorised by the Bank of Ghana to inspect the passport or travel document of any traveller who has arrived in Ghana to ensure that the traveller has complied with the provisions of these Regulations.

Regulation 7—Authorised Agent of Bank of Ghana to Submit Returns.

An authorised agent of the Bank of Ghana shall at the end of each month forward to the Bank of Ghana particulars of all vouchers sold by him during that month.

Regulation 8—Special Bank Account.

(1) An authorised agent of the Bank of Ghana shall open a special bank account into which he shall pay all foreign exchange realised from the sale of the vouchers.

(2) The Bank of Ghana may from time to time give directions in writing to the authorised agent of the Bank with regard to the disposition of foreign exchange held on deposit in such bank account, and the agent shall comply with such directions.

Regulation 9—Authorised Dealers to Maintain Proper Records and Submit Returns.

(1) An authorised dealer shall maintain proper and up-to-date records of all transactions involving the exchange of vouchers and such records shall be examined from time to time by an officer authorised by the Bank of Ghana.

(2) An authorised dealer shall at the end of each month furnish to the Bank of Ghana the following particulars in respect of vouchers encashed during that month:-

(a) the value of the voucher in foreign exchange;

(b) the amount of cedis for which the voucher was encashed;

(c) the country where the voucher was purchased; and

(d) such other information as the Bank of Ghana may reasonably request in writing.

Regulation 10—Exemption.

The Commissioner responsible for Finance or a person authorised in that behalf by him may in writing exempt any person or class of persons from the provisions of these Regulations.

Regulation 11—Regulations not Applicable to Certain Persons.

These Regulations shall not apply to the following persons:

(a) Ghanaians resident in Ghana; or

(b) Ghanaians resident outside Ghana; or

(c) non-Ghanaians resident in Ghana; or

(d) any person who enters Ghana by sea or air in direct transit to a place outside Ghana, that is to say —

(i) where he arrives in a vessel which is proceeding to a place outside Ghana, if he does not disembark from the vessel;

(ii) where he arrives in an aircraft, if he does not leave the precincts of the airport and leaves Ghana within 24 hours on the same or another aircraft.

Regulation 12—Interpretation.

In these Regulations—

"authorised agent of the Bank of Ghana" means the person authorised by the Bank of Ghana to sell on its behalf the Cedi voucher issued by the Bank;

"authorised dealer" means a person prescribed in that behalf under section 1 of the Exchange Control Act, 1961 (Act 71);

"foreign exchange" means currency notes, bank notes or coins which are at any time legal tender and which are convertible into currency which is legal tender in any other country;

"Immigration Officer" has the meaning assigned to it in section 29 of the Aliens Act, 1963 (Act 160).
