IN exercise of the powers
conferred on the Provisional
National Defence Council by
section 5 of the Statutory
Corporations Act, 1964 (Act 232)
this Instrument is made this 23rd
day of April, 1986.
Section 1—L.I. 395 Amended.
The Ghana National Trading
Corporation Instrument, 1965 (L.I.
395) is hereby amended as follows—
(a) by the substitution for
paragraphs 2, 3 and 4 of Part IV
thereof of the following new
paragraphs—
“2. The Board shall consist of—
(a) the person appointed the
Executive Chairman;
(b) the two persons appointed
Deputy Executive Chairmen; and
(c) eight other persons who shall
be appointed by the Provisional
National Defence Council.
3. The Executive Chairman shall be
the Chairman of the Board and
where there is no Executive
Chairman, such person as may be
appointed by the Provisional
National Defence Council.
4. The members of the Board, other
than the Executive Chairman and
the two Deputy Executive Chairmen,
shall hold office for a term of
one year so however that any
member may at any time, by writing
addressed to the Provisional
National Defence Council through
the Secretary resign his office
or, be removed from office by the
Provisional National Defence
Council.”
(b) by the substitution for
paragraph 4 of Part V thereof of
the following new paragraph—
“4. The quorum of the Board shall
be seven.”
(c) by the substitution for
paragraphs 2, 3 and 4 of Part VI
thereof of the following new
paragraphs—
“2. The Corporation shall have an
Executive Chairman who shall also
act as the Managing Director.
3. The Executive Chairman and the
two Deputy Executive Chairmen
shall be appointed by the
Provisional National Defence
Council and shall hold office upon
such terms and conditions as the
Provisional National Defence
Council may determine.
4. The Executive Chairman shall,
subject to the provisions of this
Instrument, be responsible to the
Board for the day to day
administration of the
Corporation.”
(d) by the substitution for the
words “Minister” means the
Minister responsible for Trade”
appearing in Part IV thereof of
the words “ ‘Secretary’ means the
P.N.D.C. Secretary responsible for
Trade.”
Section 2—Commencement.
This Instrument shall be deemed to
have come into force on the 16th
day of February, 1984.
