GHANA MARITIME AUTHORITY
(AMENDMENT) ACT, 2011
AN ACT to amend the Ghana
Maritime Authority Act, 2002
(Act 630) to make specific
provision for levies, fees and
charges and to provide for
related matters.

1. The Ghana Maritime Authority
Act, 2002 (Act 630) referred to
as the principal enactment is
amended in section 16 by the
substitution for paragraph
(a)
of
" (a)
moneys accruing to the Authority
(i)
in the performance of its
functions under the Ghana
Shipping Act, 2003 (Act 645) and
any other enactment related to
maritime matters,
(ii) from levies, fees and
charges, and
(iii) from investments."
Section 25 of Act 630 amended

The principal enactment is
amended by the substitution for
section 25 of
"Regulations
25.
(I)
The Minister may, by legislative
instrument, make Regulations
for
(a)
the supervision of flag State
and port State responsibilities;
(b)
the prevention of marine
pollution;
(c)
the protection of the marine
environment and response to
marine environment incidents;
(d)
the imposition of levies, fees
and charges;
(e)
offences and penalties; and
(f)
generally carrying into effect
the functions of this Act.

MEMORANDUM
The purpose of this Bill is to
amend the Ghana Maritime
Authority Act, 2002, (Act 630)
to make specific provision for
the Minister to make Regulations
for the purpose of fixing
specific levies, fees and
charges to cover the
administrative costs associated
with the performance of the
functions specified in the Act.
The application of the specific
levies, fees and charges will be
provided for in the Regulations.
Clause
I of the Bill introduces levies,
fees and charges as part of
moneys accruing to the
Authority.
Clause
2 includes in the Minister's
power to make Regulations, the
imposition of levies, fees and
charges and the authority to
make Regulations generally to
carry into effect the functions
provided for under the Act. A
general penalty has been
provided for the contravention
of Regulations. The ceiling set
by
clause
2 is fifteen thousand penalty
units.
