SCHEDULE
Schedule
IN pursuance of the Provisional
National Defence Council
(Establishment) Proclamation,
1981, this Law is hereby made—
Section 1—Vesting of Hemang Lands
in the PNDC.
Notwithstanding any law or
anything to the contrary, the
lands specified in the Schedule to
this Law are hereby vested in the
Provisional National Defence
Council, on behalf of the
Republic, free from all
encumbrances.
Section 2—Compensation for
Acquisition.
(1) There shall be payable to the
Ellis and Wood families a final
and total compensation in the sum
of two hundred million cedis in
respect of the said land.
(2) The compensation specified in
subsection (1) of this section
shall be paid subject to the
deduction therefrom of all taxes,
rents and other charges payable
and outstanding in respect of the
said lands.
Section 3—Prohibition of Further
Litigation.
(1) No court or tribunal shall
have jurisdiction to entertain any
action or proceedings of whatever
nature for the purpose of
questioning or determining any
matter on or relating to the said
lands, the acquisition or the
compensation specified in this
Law.
(2) Any cause or matter relating
to or connected with any of the
lands specified in the Schedule to
this Law pending before any court
or tribunal shall abate.
Section 4—Repeals.
The following enactments are
hereby repealed—
(a) the Hemang Lands (Acquisition)
Decree, 1975 (NRCD 332); and
(b) the Hemang Lands (Acquisition)
(Amendment) Law, 1982 (PNDCL 29).
SCHEDULE
All those pieces or parcels of
land situate at Hemang in the
Twifo-Hemang-Denkyira District of
the Central Region of the Republic
of Ghana and comprising a total
area of 103,596.80 acres and the
boundaries whereof are described
as follows—
1. All that piece or parcel of
land situate at Hemang in the
Twifo-Hemang-Denkyira District of
the Central Region of the Republic
of Ghana and comprising a total
area of 103,421.84 acres lying
generally north of the Pra-Sushien
Blocks and I and II forest reserve
and about four miles south of
Twifo-Prasu township and astride
the motor road from Hemang to
Jukwa—the boundaries whereof
commencing at the confluence of
River Pra and Obuo Stream, thence
runs in a general easterly
direction along the southern bank
of the said Obuo Stream for an
approximate distance of 1 mile to
a point on the said Obuo Stream
south-west of Ntofrewaso village
thence runs in a general southerly
direction along the said Obuo
Stream for a distance of
approximately three miles to a
point—thence runs in a general
easterly direction for an
approximate distance of
seven—decimal seven five miles to
a point which point marks the
confluence of the said Obuo and
Afia Stream thence runs along the
Afia Stream in a general
south—south easterly direction to
a point marked CM.JTA.13/50/BP.11
which point marks the western
boundary of Validated Concession
No. 749 passing through pillars
BP.104, BP.105, CM.JTA.CP
13/50/BP.10 on the Northern bank
of Subrituntum Stream and for an
approximate total distance of two
decimal two miles—thence runs
along the Subrituntum Stream in a
general westerly direction to a
point marked CM.JTA.CP. 7/51/BP.1
for a distance of approximately
six miles which pillar is on the
northern boundary of Pra-Sushien
Block II forest reserve—thence
runs along the northern boundary
of Pra-Sushien Blocks I and II
forest reserve passing through
FR.BP.17 to GCS. C.P. 6/27/14 on
the eastern bank of River Pra for
a distance of approximately 18.5
miles thence runs along the said
eastern bank of the said Pra River
in a general northerly direction
for a distance of approximately
6.0 miles to a point where the
footpath from Atobiasi crosses the
River Pra to Awroso—thence runs in
a general north easterly and north
westerly direction to a point on
the Pra River for a distance of
approximately twelve decimal five
miles—thence runs along the said
Pra River in a general northerly
and north-easterly direction for
an approximate distance of eight
decimal five miles to the point of
commencement.
2. All that piece or parcel of
land marked `B' and containing
approximately an area of 50.00
acres and bounded on the North by
the Subrituntum River and on the
South, East and West by C.V 749.
3. All that piece or parcel of
land marked `C' and containing
approximately an area of 75.00
acres and bounded on the
north-west by the Kakum Forest
Reserve on the south-east lying
astride the Bodem Stream, and on
the west by the Twifo Praso-Jukwa
motor road.
4. All that piece or parcel of
land marked `D' and containing
approximately 49.96 acres and
bounded on the North, East and
West by the Kakum Forest Reserve
and lying North of the Asipa
River.
