                                          HUMAN TRAFFICKING (AMENDMENT) ACT, 2009

AN ACT to amend the Human Trafficking Act, 2005 (Act 694) in order to redefine human trafficking and to provide for related purposes.

ENACTED by the President and Parliament:

Section 1 of Act 694 amended

1. Section 1 of the Human Trafficking Act, 2005 (Act 694) referred to in this Act as the principal enactment is amended by the substitution for subsection (I) of

"(1) Human trafficking means the recruitment, transportation, transfer, harbouring, trading or receipt of persons for the purpose of exploitation within and across national borders by

'.

(a) the use of threats, force or other forms of coercion, abduction, fraud, deception, the abuse of power or exploitation of vulnerability, or

               (b) giving or receiving payments and benefits to achieve con­sent. "


Section 35 of Act 694 amended

2. The principal enactment is amended in section 35 by the substitu­tion for "extradited", of "deported".

Section 41 of the principal enactment is amended

3. The principal enactment is amended in section 41

                   (a) in paragraph (c) by the addition of "including formal edu­cation for young victims" after "the   skills training";

(b) by transposing paragraph "(I)" to paragraph "(g)" and the addition of "and" at the end of new paragraph (I); and

(c) by the deletion of paragraph (h).
