IN exercise of the powers
conferred on the Commissioner
responsible for Local Government
by section 17 of the Identity
Cards Decree, 1972 (N.R.C.D. 129),
these Regulations are made this
2nd day of March, 1973.
Regulation 1—Procedure for
Objections.
(1) Where any person objects to
the issue of an identity card to
any other person on the ground
that such other person is under
the age of sixteen years, the
objector shall complete the Notice
of Objection contained in Form 1
in the Schedule and deliver it to
the Electoral Commissioner or his
authorised agent.
(2) Where any person objects to
the issue of a citizen's identity
card to any other person on the
ground that such other person is
not a citizen of Ghana, the
objector shall complete the Notice
of Objection contained in Form 2
in the Schedule and deliver it to
the Electoral Commissioner or his
authorised agent.
(3) The fact that a Notice of
Objection is given shall not
preclude the issue of an identity
card to any person pending the
investigation of the Notice of
Objection.
Regulation 2—Objections to be from
Personal Knowledge.
The particulars stated in a Notice
of Objection shall be confined to
facts within the personal
knowledge of the objector.
Regulation 3—Withdrawal of Cards
(1) Where the Commissioner
responsible for Local Government,
after considering the facts
specified in a Notice of Objection
and making such investigations as
he thinks fit, is satisfied that
an identity card has been issued
to any person not entitled
thereto, he may cancel that
identity card and shall
immediately in writing inform the
person affected of such
cancellation and of the reasons
therefor.
(2) It shall be the duty of any
person whose identity card is
cancelled under this regulation to
surrender it forthwith to the
Electoral Commissioner or his
authorised agents.
Regulation 4—Appeals.
(1) Any person aggrieved by the
cancellation of an identity card
under regulation 3 may, within
twenty-eight days of receiving
notification of such cancellation,
appeal to a Circuit Court.
(2) The Circuit Court may
thereupon consider the facts
specified in the Notice of
Objection and any other facts
which appear to it to be relevant
in determining whether the
appellant is entitled to the issue
of an identity card, and make such
order in relation thereto as the
court thinks fit.
Regulation 5—Offences.
Any person who—
(a) with intent to deceive makes
any Notice of Objection containing
particulars which are false; or
(b) fails to surrender an identity
card which he is required to
surrender under regulation 3 (2),
shall be guilty of an offence and
liable on conviction to a fine not
exceeding two hundred cedis or to
imprisonment not exceeding twelve
months or to both.
