IMPORTS AND EXPORTS (PERMITTED AND PROBIBITED GOODS) REGULATIONS, 1980 (LI 1246).

 

IN exercise of the powers conferred on the Minister responsible for Trade by section 22 of the Imports and Exports Act, 1980 (Act 418) these Regulations are made this 9th day of September, 1980.

Regulation 1—Permitted imports and exports.

(1) The importation of any goods specified in the First Schedule to these Regulations shall be deemed not to be importation of goods for commercial purposes or in commercial quantities and accordingly no import licence shall be required for the importation of any such goods.

(2) No person shall import for commercial purposes or in commercial quantities the goods specified in the Second Schedule to these Regulations except under a Specific Licence  issued for the purpose by the Minister responsible for Trade.

(3) The exportation of any goods specified in the Third Schedule to these Regulations shall be deemed not to be exportation of goods for commercial purposes or in commercial quantities and accordingly no Exchange Control Form A.2 shall be required for the exportation of any such goods.

Regulation 2—Prohibited imports and exports.

(1) No import licence shall be issued in respect of any goods the importation of which is prohibited by any law for the time being in force in Ghana.

(2) No person shall export any goods where the exportation of such goods is prohibited by any law for the time being in force in Ghana.

Regulation 3—Penalty.

Any person who without reasonable excuse the proof of which shall rest on him—

(a) imports goods for which a Specific Licence is required under sub-regulation (2) of regulation 1 of these Regulations without having any such licence in respect of those goods; or

(b) imports or exports any goods contrary to regulation 2 of these Regulations,

shall be guilty of an offence and liable on summary conviction to a fine not exceeding ten thousand cedis or to imprisonment not exceeding five years or to both and any goods in respect of which the offence is committed shall be liable to be seized and forfeited to the State.

Regulation 4—Interpretation.

"n.e.s." means not elsewhere specified or included in the Second Schedule to these Regulations.

SCHEDULES

FIRST SCHEDULE

PERMITTED IMPORTS WITHOUT LICENCE

(a) Bona fide trade samples or advertising materials provided that the quantities are not excessive in relation to the nature of the goods concerned.

(b) Personal or household effects of crew or passengers arriving in Ghana provided the importers are in possession of completed Passenger Unaccompanied Baggage Declaration Forms, where appropriate.

(c) Gifts addressed to individuals, provided they are unsolicited gifts and not imported as merchandise and that the weight or value does not exceed 10kg. gross or ˘1,000.00 respectively.

(d) Single copies of books, newspapers, magazines and periodicals.

(e) Live animals, not exceeding two, imported as domestic pets and not for sale.

(f) Single headloads of foodstuffs from the Ivory Coast, Upper Volta to Togo for personal use or for sale.

(g) Fresh or frozen fish caught by Ghanaian-owned vessels (Statistical Nos. 031-011 and 031-190).

(h) Goods imported under a re-importation certificate issued by the Comptroller of Customs and Excise.

(i) One open bottle of wine or spirits and 500 grams of tobacco or cigarettes (i.e. 50 cigars or 400 cigarettes) per adult.

THIRD SCHEDULE

 

PERMITTED EXPORTS WITHOUT EXCHANGE CONTROL FORM A.2

(a)  Bona fide trade samples, advertising materials, or used postage stamps, provided that the quantities are not excessive in relation to the nature of the goods concerned

(b)  Personal or household effects of crew or passengers leaving Ghana, and ˘100.00 worth of newly imported personal goods (other than imported foodstuffs)

(c)  Goods as unsolicited gifts whose weight or value does not exceed 10kg. gross or ˘1,000.00 respectively, and not containing imported foodstuffs

(d)  Single copies of books, newspapers, magazines and periodicals

(e)  Locally produced foodstuffs to a maximum of 20 kilogrammes except that in the case of yams to a maximum of 3 tubers.  [Para.(e) substituted by LI 1354 reg.3.]

(f)  Single headloads of locally-produced foodstuffs across the border to the Ivory Coast, Upper Volta, or Togo for personal use

(g)  One open bottle of wine or spirits and 500 grams of tobacco or cigarettes (i.e. 50 cigars or 400 cigarettes) per adult

(h)  Goods exported under a re-exportation certificate issued by the Comptroller of Customs and Excise.
