The judgment of this Court requires the Ghana Education Service to pay the respondent the sum GH¢1.0 million  among other orders.  The respondent is a civil servant and if he goes into execution and the appeal succeeds it would be difficult to recover the said sum.  Furthermore if the other orders are complied with and when the appeal succeeds it would mean reversing the respondent back to his current situation which would create administrative problems for the Ghana Education Service.

For these reasons I would grant the application save that the applicants pay the cost of GH¢3,000.00.00 awarded in the judgment.  I believe the respondent would be able to repay this amount if the appeal succeeds.

JUSTICE OF THE HIGH COURT
