LABOUR ORDINANCE (CAP. 89) THE WAGES BOARD (CATERING TRADE WORKERS) ORDER, 1958 (LN 256).              

 

WHEREAS the Minister is satisfied that it is expedient to appoint a Wages Board in accordance with the provisions of this Order:

AND WHEREAS the Minister has complied with the requirements of section 92 of the Labour Ordinance as to the publication of a notice of his intention to make this order and as to the consideration of objections:

NOW THEREFORE in exercise of the powers conferred upon the Minister by section 92 of the Labour Ordinance the following Order is hereby made:—

Order 1—Title.

This Order may be cited as the Wages Board (Catering Trade Workers) Order, 1958.

Order 2—Definition of Catering Trade Workers.

In this Order "catering trade workers" means those falling within the Schedule to this Order.

Order 3—Catering Trade Workers Board Appointed.

There is hereby appointed a Wages Board to be known as the Catering Trade Workers Wages Board which shall consist of the following persons—

(a) four persons representing employers elected and appointed under the provisions of section 93 of the Labour Ordinance;

(b) four persons representing employees elected and appointed under the provisions of the said section 93; and

(c) three persons appointed under the provisions of section 94 of the Labour Ordinance.

Order 4—Functions of Catering Trade Workers Wages Board.

The functions of the said Wages Board shall be—

(a) to investigate the remuneration and conditions of employment of catering trade workers and to make recommendations to the Minister as to the minimum wages to be paid to and the conditions of employment of catering trade workers;

(b) to consider any matter referred to the Wages Board by the Minister with reference to industrial conditions of catering trade workers and to report to the Minister.

SCHEDULE

DEFINITION OF CATERING TRADE WORKERS

EMPLOYEES IN HOTELS

1. Persons, other than those whose salary or wages exceed £300 per annum, employed in Ghana for the purpose of the activities carried on at any of the following establishments, that is to say—

any hotel, hostel, catering undertaking, restaurant, canteen, bar or club, and who are engaged on any of the following work, that is to say—

(a) the preparation of food or drink;

(b) the service of food or drink;

(c) work incidental to such preparation or service;

(d) work connected with the provision of living accommodation;

(e) work in connection with any retail sale of goods on premises where the main activity is either the supply of food or drink for immediate consumption or the provision of living accommodation for guests or lodgers or partly the supply of food or drink as aforesaid and partly the provision of living accommodation as aforesaid;

(f) transport work;

(g) work performed at any office or at any store or warehouse or similar place or at any garage or stable or similar place;

(h) any work other than that specified in sub-paragraphs (a) to (g) hereof performed on or about the premises or place where food or drink is prepared or served or where living accommodation is provided, including work in connection with any service or amenity provided on or about such premises or place.

COOKS AND STEWARDS IN HOSPITALS, INSTITUTIONS AND EDUCATIONAL ESTABLISHMENTS

2. Persons, other than those whose salary or wages exceed £300 per annum, employed in Ghana for the purpose of activities carried on at any of the following establishments, that is to say—

(i) any hospital, nursing home or convalescent home or similar establishment providing accommodation for the sick, infirm or mentally defective;

(ii) any institution or home where living accommodation is provided for the aged or indigent;

(iii) any university, college, school or similar establishment;

and who are engaged on any of the following work, that is to say—

(a) the preparation of food or drink;

(b) the service of food or drink;

(c) work incidental to such preparation or service.

EXCEPTIONS

3. The foregoing paragraphs of this Schedule shall not apply to any of the following workers in respect of their employment in any of the following circumstances, that is to say,—

(a) workers who are employed by the same employer partly in a catering undertaking and partly in some other undertaking, if their employment is confined to work specified either in sub-paragraph (f) or sub-paragraph (g) of paragraph 1 of this Schedule or partly to work specified in the said sub-paragraph(f) and partly to work specified in sub-paragraph (g), and they are mainly employed on work in or in connection with that other undertaking;

(b) workers who are employed by the Crown.
