.
WHEREAS the Minister is satisfied
that it is expedient to appoint a
Wages Board in accordance with the
provisions of this Order:
AND WHEREAS the Minister has
complied with the requirements of
section 92 of the Labour Ordinance
as to the publication of a notice
of his intention to make this
Order and as to the consideration
of objections:
Cap. 89.
NOW THEREFORE in exercise of the
powers conferred upon the Minister
by section 92 of the Labour
Ordinance the following Order is
hereby made:—
Order 1—Title.
This Order may be cited as the
Wages Board (Retail Trade Workers)
Order, 1958.
Order 2—Interpretation.
(1) In this Order, unless the
context otherwise requires,—
“goods" means anything which is
the subject of trade, manufacture,
or merchandise;
“the Ordinance" means the Labour
Ordinance;
“person employed in the retail
trade" means any person so
employed whose wages do not exceed
£300 per annum;
“retail trade " means the sale of
goods by retail and includes,—
(a) work done or services
performed in or about any shop
where the work or services are for
purposes of or related to the sale
of goods by retail;
(b) work done or services
performed in connection with any
warehouse where the warehouse is
operated in conjunction with a
shop for the sale of goods by
retail; and
(c) clerical work or office work
performed or done in conjunction
with the sale of goods by retail
and whether or not in any shop or
warehouse;
“sale" means the disposal of goods
for money or money's worth;
“shop" includes any other place or
premises of retail business;
"the Wages Board" means the Retail
Trade Workers Wages Board
appointed by this Order;
“wages" includes salary;
“warehouse " includes any store or
other place of wholesale business.
(2) References in this Order to
"shop” “store " or " warehouse "
includes, as the case may require,
any branch, department or other
division made for convenience of
handling retail trade.
Order 3—Retail Trade Workers Wages
Board Appointed.
There is hereby appointed a Wages
Board to be known as the Retail
Trade Workers Wages Board which
shall consist of the following
persons—
(a) Four persons representing
employers elected and appointed
under the provisions of section 93
of the Ordinance;
(b) four persons representing
employees elected and appointed
under the provisions of section 93
of the Ordinance; and
(c) three persons appointed under
the provisions of section 94 of
the Ordinance.
Order 4—Functions of Retail Trade
Workers Wages Board.
The functions of the Wages Board
shall be,—
(a) to investigate the
remuneration and conditions of
employment of any person employed
in the retail trade and to make
recommendations to the Minister as
to the minimum wages to be paid to
and the conditions of employment
of any such person;
(b) to consider any matter
referred to the Wages Board by the
Minister with reference to
industrial conditions of persons
employed in the retail trade and
to report to the Minister.
