IN exercise of the powers
conferred upon the P.N.D.C.
Secretary responsible for Lands
and Natural Resources by section
134 of the Land Title Registration
Law, 1986 (P.N.D.C.L. 152) these
Regulations are hereby made this
4th day of January, 1993.
The Land Title Registration
Regulations, 1986 (L.I. 1341) as
amended is hereby further amended
by the insertion after regulation
30 thereof of the following new
regulation.
"30A. Disclosure by members of the
Committee of interests in
disputes.
(1) If a member of the Committee
has any interest, direct or
indirect, in any dispute before
the Committee he shall, as soon as
practicable, disclose the fact and
shall not take part in the
proceedings.
(2) In the case of married persons
living together, the interest of
one spouse shall, if known to the
other, be deemed for the purposes
of this regulation to be also an
interest of that other spouse.
(3) Any member of the Committee
who fails to comply with the
provisions of sub-regulation (1)
shall be liable to a fine not
exceeding ten thousand cedis.
(4) Where for any reason the
Chairman of the Committee is
unable to act in the hearing of an
application or having acted
declines to act further or
withdraws from the hearing and
determination of the dispute, the
Secretary shall, subject to this
regulation, select any fit person
to take his place temporary and
the Committee so reconstituted
shall continue the hearing and
determination of the dispute
unless the Committee decides to
commence the hearing afresh.
(5) When, after commencement of
the hearing and before the
determination of a dispute by the
Committee, a member declines to
act or becomes incapable to act
further in or withdraws from the
hearing of the dispute, it shall
not be necessary, unless the
Committee otherwise decides, to
replace that member on the
Committee, unless the number of
members remaining is thereby
reduced below two."
