ESTATES LIMITED AND FIRESTONE
GHANA LIMITED (MISCELLANEOUS
PROVISIONS) DECREE, 1977 (SMCD 84)
ARRANGEMENT OF SECTIONS
Section
1. The Term of Lease and Freehold
Interest granted by Government to
Ghana Rubber Estates and Firestone
Ghana Limited Respectively shall
remain valid.
2. Article 163 (7), (8),(9) and
(10) not to apply to Lease and
Conveyance Referred to in Section
1 of this Decree.
WHEREAS by a Lease dated the 3rd
day of June, 1968 the Government
of Ghana demised unto the Ghana
Rubber Estates Limited all those
pieces or parcels of land situated
in the Western Region of Ghana and
more particularly delineated and
described in the said Lease
together with all the buildings
and other erections existing
thereon at the commencement of
such lease for the cultivation of
rubber plantations for a term of
ninety-nine years:
AND WHEREAS by a Conveyance dated
the 3rd day of June, 1968 the
Government of Ghana sold to the
Firestone Ghana Limited forever
all that piece or parcel of land
situated at Bonsaso in the
Wassaw-Fiase-Mpohaw District, in
the Western Region of Ghana more
particularly delineated and
described in the said Conveyance
for the establishment of a factory
for the manufacture of tyres and
other rubber products:
AND WHEREAS the Government of
Ghana being a shareholder in both
the Ghana Rubber Estates Limited
and Firestone Ghana Limited
respectively, participates
effectively in the operations of
the rubber plantations with the
Ghana Rubber Estates Limited and
in the manufacture of tyres and
other rubber products with the
Firestone Ghana Limited with the
rubber produced from the said
plantations:
AND WHEREAS the said Lease and
Conveyance were granted by the
Government of Ghana pursuant to a
Master Agreement dated 2nd day of
September, 1967 and amended by the
Agreement dated 3rd day of June,
1968 and made between the Republic
of Ghana and The Firestone Tire &
Rubber Company of Akron, Ohio, in
the United States of America:
AND WHEREAS by virtue of the
participation of the Government of
Ghana in the operations of the
companies, the Government of Ghana
deems it necessary and considers
it in the national interest that
the term of the said Lease and the
freehold interest under the said
Conveyance granted by the
Government of Ghana to the Ghana
Rubber Estates Limited and
Firestone Ghana Limited,
respectively, shall not be reduced
or affected by operation of any
law or otherwise.
NOW THEREFORE, BE IT ENACTED by
the Supreme Military Council as
follows:—
Section 1—The Term of Lease and
Freehold Interest Granted by
Government to Ghana Rubber Estates
and Firestone Ghana Limited
Respectively shall remain Valid.
(1) Notwithstanding any law,
decree or regulation to the
contrary, the term of ninety-nine
years granted, under the Lease
dated the 3rd day of June, 1968,
by the Government of Ghana to
Ghana Rubber Estates Limited shall
remain in full force and effect.
(2) Notwithstanding any law,
decree or regulation to the
contrary, the freehold interest
granted under the Conveyance dated
the 3rd of June, 1968 by the
Government of Ghana to Firestone
Ghana Limited shall remain in full
force and effect.
Section 2—Article 163 (7), (8),(9)
and (10) not to Apply to Lease and
Conveyance Referred to in Section
1 of this Decree.
For the removal of doubt, clauses
(7), (8), (9), and (10) of article
163 of the suspended Constitution
as continued in force by section 1
of the Lands Commission Decree,
1972 (NRCD 24) shall be deemed
never to have applied to the term
of years and the freehold interest
referred to in section 1 of this
Decree.
