IN exercise of the powers
conferred on the Minister
responsible for Local Government
by sub-section (3) of section 3 of
the Local Government Act 1993, Act
462 and with the prior approval of
the Cabinet this Instrument is
made this 13th day of September
1994.
PART I—METROPOLITAN ASSEMBLY
Section 1—Establishment of
Shama-Ahanta East Metropolitan
Assembly.
There is hereby established a
Metropolitan Assembly to be known
as the Shama-Ahanta East
Metropolitan Assembly (referred to
in this Instrument as "the
Assembly") for the area specified
in the First Schedule to this
Instrument.
Section 2—Membership of Assembly.
The Assembly shall consist of the
following members:
(a) The Metropolitan Chief
Executive;
(b) one person from each electoral
area within the Metropolis elected
by universal adult suffrage in
accordance with regulations made
for the purpose by the Electoral
Commission;
(c) the members of Parliament from
the constituencies that fall
within the area of authority of
the Assembly, except that such
members shall have no voting
rights; and
(d) other members not exceeding 30
percent of the total membership of
the Assembly appointed by the
President in consultation with
traditional authorities and other
interest groups in the Metropolis.
Section 3—Functions of the
Assembly.
(1) The Assembly shall perform all
the functions conferred on
District Assemblies by the Local
Government Act, 1993 (Act 462).
(2) Without prejudice to
sub-paragraph (1) of this
paragraph, the Assembly shall
perform the functions set out in
the Second Schedule to this
Instrument.
Section 4—Common Seal.
(1) The Common Seal of the
Assembly shall be such as the
Minister may approve by notice in
the Gazette.
(2) Until such time as the Common
Seal approved in sub-paragraph (1)
of this paragraph is available, a
rubber stamp bearing the
inscription "Shama-Ahanta East
Metropolitan Assembly" shall be
used as the Common Seal.
Section 5—Administrative Area of
Assembly.
The area of authority of the
Assembly shall comprise the area
specified in the First Schedule to
this Instrument.
Section 6—Location of Principal
Office of Assembly.
The Assembly shall establish its
principal office at Sekondi where
meetings of the Assembly shall be
held.
Section 7—Inaugural Meeting of
Assembly.
(1) The Assembly shall hold its
inaugural meeting on such date as
the Minister shall with the prior
approval of the Cabinet determine.
(2) The Presiding Member of the
Assembly shall be elected at the
inaugural meeting.
Section 8—Establishment
Metropolitan Assembly.
(1) There is hereby established
the Shama-Ahanta East Metropolitan
Authority (referred to in this
Instrument as "the Authority")
which shall be the Executive
Committee of the Assembly and
shall perform all the functions
conferred on Executive Committees
of District Assemblies by the
Local Government Act, 1993 (Act
462).
(2) The Authority shall consist of
not more than one-third of the
total number of members of the
Assembly elected by the members
from among themselves; except that
the Presiding Member of the
Assembly shall not be a member of
the Authority.
(3) The Metropolitan Chief
Executive shall preside over the
meetings of the Authority.
Section 9—Meetings of Metropolitan
Authority.
(1) The Authority may co-opt any
person to attend any of its
meetings, but a person so
co-opted shall not have a right
to vote.
(2) The Authority may conduct its
business in English and in any
Ghanaian language common to the
communities in the district.
(3) The validity of the
proceedings of the Authority shall
not be affected by a vacancy among
its members or by a defect in the
appointment or qualification of a
member.
(4) Subject to the provisions of
this paragraph, the Authority
shall regulate the procedure for
its meetings in accordance with
the standing orders of the
Assembly.
Section 10—Dissolution of
Metropolitan Authority.
(1) Where the Assembly is
satisfied that the authority is
not performing efficiently the
functions assigned to it under the
Act or this Instrument, the
Assembly may by resolution of
two-thirds of the members dissolve
the Authority and elect another.
(2) For the purposes of
sub-paragraph (1) of this
paragraph the Authority shall be
deemed not to have performed its
functions efficiently if its
actions or omissions —
(a) bring or are likely to bring
the Assembly into disrepute,
ridicule, hatred or contempt; or
(b) are prejudicial or inimical to
the economic, social or political
development of the metropolis or
to the national interest.
(3) The dissolution of the
Authority shall not operate as a
revocation of the appointment of
the Metropolitan Chief Executive.
Section 11—Sub-Committees of
Metropolitan Authority.
(1) The Metropolitan Authority
shall have the following
sub-committees —
(a) Development Planning
Sub-Committee;
(b) Social Services Sub-Committee;
(c) Works Sub-Committee
(d) Finance and Administration
Sub-Committee;
(e) Environmental Management
Sub-Committee;
(f) Education Sub-Committee;
(g) Revenue Mobilisation
Sub-Committee; and
(h) such other sub-committees as
the Metropolitan Assembly may
determine.
(2) Each sub-committee shall
consist of such members of the
Assembly as shall be determined by
the Assembly; except that each
member of the Assembly other than
the Presiding Member shall serve
on at least one sub-committee
during that member's tenure of
office.
(3) Heads of Departments of the
Assembly shall attend the meetings
of the sub-committees and shall
advise them on the execution of
their functions, but shall not
have a right to vote.
(4) A sub-committee may co-opt any
other person to attend any of its
meetings but a person so co-opted
shall not have a right to vote.
(5) A sub-committee shall regulate
the procedure of its meeting in
accordance with the standing
orders of the Assembly.
(6) The Assembly may by resolution
dissolve and reconstitute any
sub-committee which in its opinion
is not performing its functions
efficiently.
Section 12—Functions of
Sub-Committees.
(1) Every sub-committee shall be
responsible for collating and
deliberating on issues relevant to
it as the Assembly may direct for
the purpose of assisting the
Assembly in its deliberative,
executive and legislative
functions.
(2) The sub-committees specified
in column 1 of the Third Schedule
to this Instrument shall be
responsible for the subject areas
specified in relation to them in
column 2 of the Schedule.
(3) A sub-committee shall submit
its recommendations to the
Metropolitan Authority of the
Assembly.
Section 13—Metropolitan Boards.
For the efficient performance of
its functions, the Assembly shall
establish the following —
(a) Metropolitan Planning Board;
(b) Board of Metropolitan Works;
and
(c) Board of Administration.
Section 14—Metropolitan Planning
Board.
(1) The Metropolitan Planning
Board shall consist of the
following—
(a) the Metropolitan Chief
Executive who shall be the
Chairman;
(b) the head of the Physical
Planning Department of the
Assembly;
(c) chairmen of the Board of
Metropolitan Works and the Board
of Administration;
(d) heads of non-decentralised
departments in the metropolis
involved in the planning process
in the metropolis;
(e) chairmen of the Sub-
Metropolitan District Councils.
(f) chairmen of the Sub-Committees
of the Metropolitan Authority.
(2) The Metropolitan Planning
Board shall have the following
functions —
(a) integrate the development
planning and management of the
metropolis and monitor and
evaluate such development planning
and management;
(b) integrate the development
planning proposals from the
sub-metropolitan district councils
and advise the Authority thereon;
and
(c) advise on the financial
planning and budgeting of the
Assembly.
(3) The Metropolitan Planning
Board shall be responsible through
the Metropolitan Authority to the
Metropolitan Planning Authority.
(4) The Metropolitan Planning Unit
shall provide a Secretariat for
the Metropolitan Planning Board in
the performance of its functions.
Section 15—Board of Metropolitan
Works.
(1) The Board of Metropolitan
Works shall consist of the
following —
(a) the head of the Metropolitan
Works Department who shall be
Chairman;
(b) the head of the Metropolitan
Roads Department;
(c) Heads of non-decentralised
Departments in the metropolis
responsible for the provision of
infrastructure and utility
services;
(d) the head of the Metropolitan
Traffic and Parking Unit;
(e) a representative of real
estate developers in the
metropolis.
(2) The Board of Metropolitan
Works shall have the following
functions —
(a) integrate the various
components of metropolitan works
that have metropolitan, regional
or national implications
particularly in the areas where
collaboration and coordination
with non-decentralised departments
and agencies are necessary;
(b) be responsible for the
provision of services including
civil engineering and building
construction, health, secretarial
and welfare services;
(c) encourage private sector and
community initiatives in the
achievement of the developmental
objectives of the Assembly; and
(d) advise on development control
and enforcement measures in the
metropolis.
(3) The Board of Metropolitan
Works shall be responsible to the
Metropolitan Planning Authority
through an appropriate
sub-committee of the Metropolitan
Authority depending on the
subject-matter concerned.
Section 16—Board of
Administration.
(1) The Board of Administration
shall consist of the following:
(a) the Metropolitan
Co-ordinating Director who shall
be the Chairman;
(b) the head of the Finance
Department;
(c) the head of the Budgeting and
Rating Department;
(d) the Metropolitan Police
Commander;
(e) the head of the Legal
Department;
(f) the head of the Public
Relations Department.
(2) The Board of Administration
shall have the following functions
—
(a) organise and advise on the
management of the general
administration, the treasury,
justice and security; and
(b) manage the business of the
Authority and the Assembly in
respect of their meetings.
(3) The Board of Administration
shall be responsible to the
Metropolitan Planning Authority
through an appropriate
sub-committee of the Metropolitan
Authority depending on the
subject-matter at issue.
Section 17—Ex-Officio Members.
Heads of Departments of relevant
public sectors and Departments or
Organisations in the metropolis
shall attend meetings of the
Boards and shall advise them on
their functions but shall not have
a right to vote.
PART II—SUB-METROPOLITAN DISTRICT
COUNCILS
Section 18—Establishment of
Sub-Metropolitan Districts.
The area comprising the
Shama-Ahanta East Metropolis shall
be divided into four
Sub-Metropolitan Districts as
specified in the First Schedule to
this Instrument.
Section 19—Establishment of
Sub-Metropolitan District
Councils.
(1) There is hereby established in
each Sub-Metropolitan District a
Sub-Metropolitan District Council.
(2) The area of authority of each
Sub-Metropolitan District Council
shall comprise the towns and
settlements specified in the First
Schedule to this Instrument.
Section 20—Membership and staff of
Sub-Metropolitan District Council.
(1) Each Sub-Metropolitan District
Council shall consist of —
(a) all elected members of the
Assembly in that Sub-Metropolitan
District; and
(b) such number of adult
residents in the Sub-Metropolitan
District as may be determined
by the Regional Minister who shall
appoint the persons on behalf of
the President in consultation with
the traditional authorities and
other interest groups in the sub-
metropolitan district except that
the total membership shall not be
less than twenty-five nor more
than thirty.
(2) The Chairman of a
Sub-Metropolitan District Council
shall be elected from among the
members and shall hold office for
two years, and be eligible for
re-election.
(3) A Sub-Metropolitan District
Council shall have an
Administrative Officer who shall
be the Secretary to the
Sub-Metropolitan District Council.
(4) The Administrative Officer
shall be a member of the Civil
Service.
(5) Other staff of the
Sub-Metropolitan District Council
may be appointed by the Assembly.
Section 21—Functions of
Sub-Metropolitan District Council.
A
Sub-Metropolitan District Council
shall perform the functions set
out in the Fourth Schedule to this
Instrument.
Section 22—Meetings of
Sub-Metropolitan District
Councils.
(1) A Sub-Metropolitan District
Council shall meet at such times
and in such places as the Chairman
shall determine and in any case
not less than six times in a year.
(2) The quorum for a meeting of a
Sub-Metropolitan District Council
shall be thirteen.
(3) A Sub-Metropolitan District
Council shall conduct its meetings
in accordance with Standing
Orders made in that behalf by the
Assembly.
(4) Standing Orders made under
this paragraph may provide for the
payment of sitting and travelling
allowances and such other matters
concerned with the meetings of a
Sub-Metropolitan District Council
as the Assembly may consider
necessary.
Section 23—Tenure of Office of
Members of Sub-Metropolitan
District Council.
Subject to sub-paragraph (1) (a)
of paragraph 20 of this
Instrument, a member of a
Sub-Metropolitan District Council
shall hold office for four years.
Section 24—Removal from Office of
Members of Sub-Metropolitan
District Council.
The Regional Minister may, on the
recommendation of not less than
two-thirds of the members of the
Sub-Metropolitan District Council
remove from office a member of the
Sub-Metropolitan District Council
appointed under sub-paragraph
(1)(b) of paragraph 20 of this
Instrument.
Section 25—Location of Office of
Sub-Metropolitan District
Councils.
(1) A Sub-Metropolitan District
Council shall establish its
offices at the place specified in
the First Schedule to this
Instrument where meetings of the
Sub-Metropolitan District Councils
shall be held.
(2) Subject to sub-paragraph (1)
of this paragraph, where the
circumstances so require, the
Sub-Metropolitan District Council
may hold its meetings in such
other place in the
sub-metropolitan district as it
may determine.
Section 26—Funds and
Sub-Metropolitan District Council.
(1) Each Sub-Metropolitan
District Council shall retain in
the Sub-Metropolitan District
fifty per cent of all rates,
taxes, licences, fees and other
monies collected in the
Sub-Metropolitan District to be
used for the development and
recurrent expenditure of the
Sub-Metropolitan District Council.
(2) The Assembly shall make
available to the Sub-Metropolitan
District Council such other funds
as shall enable the
Sub-Metropolitan District Council
to effectively and efficiently
discharge the functions delegated
to it.
Section 27—Accounts and Audit.
(1) A Sub-Metropolitan District
Council shall open a bank account
into which shall be deposited all
monies for the Sub-Metropolitan
District Council.
(2) A Sub-Metropolitan District
Council shall keep proper books of
account and proper records in
relation to them.
(3) The books of account shall
be audited by the Metropolitan
Internal Auditor and the
Auditor-General in their audit of
the Assembly accounts.
PART III—TOWN COUNCILS
Section 28—Establishment of Town
Councils
(1) There is established for the
towns, villages or settlements
specified in the third column of
Part II of the First Schedule to
this Instrument the Town Councils
specified in relation to them in
the First Column of Part II of the
First Schedule.
(2) The area of authority of each
Town Council shall be as specified
to the third column of Part II of
the First Schedule to this
Instrument.
Section 29—Membership of the Town
Councils.
(1) A Town Council shall consist
of not less than fifteen or more
than twenty members composed as
follows —
(a) not more than five persons
elected from among the elected
members of the Metropolitan
Assembly from the electoral areas
within the area of authority of
the Town Council by such members,
except that where the electoral
areas within the area of authority
of the Town Council are less than
five, all the elected members from
the area shall be members of the
Town Council;
(b) not more than ten
representatives from the Unit
Committees in the area of
authority of the Town Council
elected annually by the Unit
Committees on rotational basis,
except that each Unit Committee
shall be represented on the Town
Council by the end of the
rotation; and
(c) such adult residents in the
area of authority of the Town
Council not exceeding five in
number appointed by the
Metropolitan Chief Executive
acting on behalf of the President
after consultation with —
(i)
the Presiding Member; and
(ii) traditional authorities and
organised productive economic
groupings in the area of authority
of the Town Council.
(2) The Electoral Commission shall
conduct the elections referred to
in sub-paragraph (1) (a) of this
paragraph.
Section 30—Functions of Town
Council.
(1) A Town Council shall in its
area of authority perform the
functions set out in the Fifth
Schedule to this Instrument.
(2) A Town Council shall in the
performance of its functions be
responsible to the
Sub-Metropolitan District
Council..
Section 31—Meetings of Town
Council.
(1) A Town Council shall elect
one person from among its of
members who shall preside at
meetings of the Town Council.
(2) A person elected under
sub-paragraph (1) of this
paragraph shall hold office for
one year and shall be eligible for
re-election.
(3) A Town Council shall meet at
such times as the person presiding
shall determine and in any case
not less than six times in a year
(4) The quorum for the meeting of
a Town Council shall be nine
persons of whom
three shall be persons who are
under paragraph 29(1) (a) and six
members by virtue of paragraph 29
(1) (b).
Section 32—Tenure of Office of
Members of Town Councils.
Subject to sub-paragraph 1(b) of
paragraph 29 of this Instrument, a
member of a Town Council shall
hold office for four years.
Section 33—Removal from Office of
Members of town Councils.
(1) Where in the opinion of the
members of a Town Council the
conduct of a member has brought
the Town Council into disrepute or
the member has committed an act
incompatible with his office as a
member of the Town Council, the
following removal procedures shall
apply —
(a) in the case of a person who
is a member under sub-paragraph 1
(b) of paragraph 29, the Unit
Committee concerned may, on the
recommendation of not less than
two-thirds of the members of the
Town Council, recall him; and
(b) in the case of any of the
persons appointed under
sub-paragraph (1) (c) of paragraph
29 of this Instrument, the
Metropolitan Chief Executive may,
on the recommendation of not less
than two-thirds of the members of
the Town Council, remove him.
(2) Where a member of a Town
Council is removed under this
paragraph
(a) in the case of a member
removed under sub-paragraph 1(b),
another person from the unit shall
be elected to serve his unexpired
term; and
(b) in the case of a member
removed under sub-paragraph 1(c),
another person may be appointed in
his place.
Section 34—Location office of Town
Council.
(1) A Town Council shall
establish its offices at the place
specified in the first column of
Part II of the First Schedule to
this Instrument where meetings of
the Town Council shall be held.
(2) Subject to sub-paragraph (1)
of this paragraph, where the
circumstances so require, the Town
Council may hold its meetings in
such other place in the area as it
may determine.
PART IV—UNIT COMMITTEES
Section 35—Establishment of Unit
Committee
There is hereby established a Unit
Committee for each unit specified
in the third column of Part II of
the First Schedule of this
Instrument.
Section 36—Membership of Unit
Committee
(1) A Unit Committee shall consist
of not more than fifteen persons
made up of—
(a) ten adult residents in the
Unit elected at a meeting of all
adult residents in the Un it
called by the Electoral Commission
for that purpose; and
(b) such other adult residents in
the Unit not exceeding five in
number as may be appointed by the
Metropolitan Chief Executive
acting on behalf of the President
in consultation with —
(i)
the Presiding Member; and
(ii) any traditional authorities
and organised productive economic
groupings in the Unit.
(2) A member of a Unit Committee
shall hold office for four years
and shall be eligible for
re-election or re-appointment, as
the case may be.
Section 37—Functions of Unit
Committee
(1) A Unit Committee shall perform
the functions set out in the Sixth
Schedule to this Instrument.
(2) The Assembly may assign to a
Unit Committee within its area of
authority such powers of
enforcement of any bye-laws
enacted by the Assembly as the
Assembly may consider fit.
(3) A Unit Committee shall in the
performance of its functions be
responsible to the Assembly
through the Town Council
concerned.
Section 38—Meetings of unit
committees
(1) A Unit Committee shall elect
one person from among its members
who shall preside at meetings of
the Unit Committee.
(2) A person elected under
sub-paragraph (1) of this
paragraph shall hold office for
one year and shall be eligible for
re-election.
(3) A Unit Committee shall meet
at such times as the person
presiding shall determine and
shall in any case meet at least
once every month.
(4) The quorum for a meeting of a
Unit Committee shall be seven at
least two of whom shall be members
appointed under paragraph 36(1)
(b).
Section 39—Removal from office of
members of Unit Committees.
(1) A member of a Unit Committee
may be removed from office if —
(a) the conduct of the member has
brought the Unit Committee into
disrepute; or
(b) the member has committed an
act incompatible with his office
as a member of the Unit Committee.
(2) Subject to sub-paragraph (])
of this paragraph the following
provisions shall regulate the
removal from office of a member of
a Unit Committee —
(a) an elected member may be
removed on the resolution of
two-thirds of the members of the
Unit Committee or by a simple
majority of the adult residents of
the Unit;
(b) an appointed member may be
removed by the Metropolitan Chief
Executive on the recommendation of
not less than three-fourths of the
other members of the Unit
Committee.
(3) The Assembly may dissolve a
Unit Committee but shall
immediately cause it to be
reconstituted under the provisions
of paragraph 36 of this
Instrument.
PART V—MISCELLANEOUS PROVISIONS
Section 40—Standing Orders.
(1) Every Town Council or Unit
Committee shall conduct its
meetings in accordance with
Standing Orders made in that
behalf by the Assembly.
(2) Standing Orders made under
this paragraph may provide for
the payment of sitting and
travelling allowances and such
other matters concerned with the
meetings of a Town Council or Unit
Committee as the Assembly may
consider necessary.
Section 41—Staff.
(1) Every Town Council or Unit
Committee shall have a Secretary
who shall be appointed by the
Assembly except that the Secretary
of a Unit Committee shall not be a
full-time official.
(2) The Secretary shall be paid
such remuneration as may be
determined by the Assembly.
(3) The Secretary shall —
(a) record minutes of all meetings
of the Town Council or Unit
Committee
(b) in the case of the Town
Council, be responsible for the
day-to-day administration of the
Town Council Office in accordance
with such directives and
guidelines as the Town Council may
issue,
(c) perform such other functions
as the Town Council or Unit
Committee may determine.
(4) A Town Council shall have a
Secretariat the staff of which
shall be appointed by the Assembly
on such terms as the Assembly may
determine in consultation with the
Town Council; except that the
staff so appointed shall not be
civil servants and shall be
responsible to the Town Council.
(5) Without prejudice to
sub-paragraph (4) of this
paragraph a Town Council may
engage other staff on such terms
and conditions as it may
determine.
Section 42—Town Council to Open
Bank accounts.
A
Town Council shall open a bank
account into which shall be
deposited all monies collected as
special levies, monies allocated
by the Assembly out of revenues
collected in its area, any special
development funds allocated to it
out of the District Assemblies
Common Fund or out of Central
Government Grants and all monies
donated to it or collected by or
for it from voluntary
contributions for development.
Section 43—Revenues of Town
Council.
(1) A Town Council shall retain —
(a) fifty per cent of all revenue
allocated to it by the
Sub-Metropolitan District Council
for collection and collected by
the Town Council in its area of
authority to defray the cost of
operation and maintenance of the
administration and services within
the area or authority of the Town
Council;
(b) mutually agreed proportions of
other Sub-Metropolitan District
Council revenues the Town Council
may undertake to collect under a
contract with the Sub-Metropolitan
District Council, which contract
shall specify the type of revenue,
the targeted amount, percentage to
be retained on the quantum of the
target and additional incentive
percentage to be retained when the
target is exceeded.
(2) The Town Council may —
(i)
raise funds from voluntary
contributions, gifts, and grants;
and
(ii) be granted funds by the
Metropolitan Assembly from its
share of the District Assemblies
Common Fund for the development of
the area of authority of the Town
Council.
Section 44—Levying of Rates.
(1) For the avoidance of doubt,
no Town Council or Unit Committee
shall levy any rates.
(2) Notwithstanding sub-paragraph
(1) of this paragraph, a Town
Council or Unit Committee may
recommend to the Assembly through
the Sub-Metropolitan District
Council the levying of such
special rates as may be approved
by the Assembly and for such
purpose as may be approved by the
Assembly.
(3) A special rate levied under
this paragraph shall have effect
only within the area of authority
of the Town Council or Unit
Committee requesting it, and the
provisions of Part VIII of the
Local Government Act 1993, (Act
462) relating to rates shall, with
such modification as may be
necessary, apply.
(4) Recommendations by a Town
Council or Unit Committee to the
Assembly for the levying of rates
shall indicate —
(a) the nature of the project or
service which is intended to be
financed from the rate;
(b) the nature of its execution,
that is whether it will be
executed by contract or directly
by the Town Council or Unit
Committee through hired labour or
unpaid communal labour;
(c) the estimated revenue from the
rate;
(d) the estimated cost of the
project;
(e) how much self-help or matching
funds, if any, are expected from
Central Government or any other
source; and
(f) the estimated time of
completion.
(5) The revenue from the special
rate shall be deposited in the
bank account of the Town Council,
except in the case of the Unit
Committee in a Town Council area
of authority, where the revenue
shall be deposited in a special
account of the Town Council
bearing the name of the Unit
Committee concerned and the
balance in the account after
deducting all expenses incurred in
the collection of the rate, shall
be used for the purpose for which
the rate was levied.
(6) The Secretary to the Town
Council or Unit Committee and the
person presiding or any other
member appointed by the Town
Council or Unit Committee shall be
responsible for signing documents
authorising expenditure agreed
upon by the Town Council or Unit
Committee.
(7) No special rates approved by
the Assembly and collected by the
Town Council or Unit Committee
shall be diverted to any other use
without the prior approval of at
least than two-thirds of the
members of the Town Council or
Unit Committee and the Assembly.
(8) The Town Council or Unit
Committee shall keep proper books
of account in which all their
financial transactions shall be
recorded; these account books
shall be audited by the Assembly's
Internal Auditor and the
Auditor-General in his audit of
the Assembly's accounts.
Section 45—Committees of Town
Council.
(1) A Town Council shall
establish the following Committees
—
(a) A Development and Services
Committee; and
(b) A Finance and Administration
Committee.
(2) A Town Council may establish
such ad hoc committees as may be
necessary to perform special
functions assigned to it by the
Town Council.
(3) Every committee shall consist
of such members of the Town
Council as the Town Council may
determine.
(4) A committee shall appoint one
of its members to preside at its
meetings.
(5) A committee may co-opt any
person to attend any of its
meetings but such a co-opted
member shall not have a right to
vote.
Section 46—Functions of
Committees.
(1) The Development and Services
Committee shall —
(a) oversee the provision and
maintenance of all services within
the area of authority of the Town
Council;
(b) provide leadership in the
selection, planning and
implementation of community
participatory projects;
(c) mobilise the community for
self-help work;
(d) propose development plans for
the consideration of the Town
Council and eventual submission to
the Assembly; and
(e) perform any other related
functions as the Town Council may
determine.
(2) The Finance and Administration
Committee shall —
(a) set revenue collection
targets, organise, monitor and
ensure the collection of revenues
allocated or contracted to the
Town Council by the Assembly or
special rates approved for the
Town Council by the Assembly;
(b) prepare a budget of the
revenue and expenditures of the
Town Council including the Unit
Committees in consultation with
them;
(e) oversee the implementation of
the budget of the Town Council;
(d) recommend remuneration and
incentives for staff recruited by
the Town Council;
(e) monitor and supervise the
staff of the Assembly in the
performance of their duties in the
area of authority of the Town
Council;
(f) review and endorse monthly
financial reports submitted to the
Town Council by the secretary
before consideration by the Town
Council; and
(g) perform any other related
functions as the Town Council may
determine.
Section 47—Town Councils, to
Submit Returns.
(1) A Town Council shall —
(a) submit quarterly
administrative returns including
development programmes and
progress reports on the activities
of the Town Council to the
Assembly;
(b) make fortnightly revenue
returns supported with bank
pay-in-slips where appropriate on
revenues collected in the area of
authority of the Town Council
together with a statement showing
how it has been shared;
(c) submit monthly revenue and
expenditure financial statements
to the Assembly; and
(d) report all personnel
recruitment and staff disciplinary
actions to the Assembly.
Section 48—Interpretation.
In this Instrument unless the
context otherwise requires —
"Act" means the Local Government
Act, 1993 (Act 462);
"adult resident" means a person of
18 years and above resident in the
unit;
"Assembly" means the Shama-Ahanta
East Metropolitan Assembly.
"ordinary resident" has the
meaning assigned to it under
Section 6 (2) of the Local
Government Act, 1993, Act 462.
"Minister" means the Minister
responsible for Local Government.

Zonal and Town and Unit
Committees) (Establishment)

amended by the deletion from the
Fourth Schedule thereof of the
following item —

PART I
DESCRIPTION OF AREA OF AUTHORITY
OF ASSEMBLY
Shama Ahanta East District is
bounded on the west by Ahanta West
District. It streches inland from
the Whin Estuary on the coast
along the Whin River through
Ntiakokrom in Mpohor Wassa East
District (about three-quarters of
a mile west of Whindo) to a point
about a quarter of a mile west of
the villages of Mokum, Kofikrom
and Kojokrom. It further stretches
north west to a point one mile
east of Nketsiakrom in Mpohor
Wassa East District.
In the north the districts shares
a common boundary with Mpohor
Wassa East District. It extends
eastwards from Nketsiakrom through
Osakrom, Abokyikrom, the southern
section of Sekondi Water Works
Catchment Area Block II. It
further extends north of Ntamakrom,
and east of Nkontowura and then
through latitude 5° 8', south of
Botogyina, Dompim No., Kakokrom
and Adiembra (all in the Mpohor
Wassa East District) to Krofokrom
on the Central Regional Boundary.
The district shares a common
eastern boundary with the Central
Region, stretching from Krokofrom
in the interior to the coast.
It is bounded on the south by the
sea, extending westwards from the
Western Central regional boundary
through Anwiado, Shama,
Sekondi-Takoradi to the Whin River
Estuary.

SECOND SCHEDULE
(Paragraph 3 (2))
FUNCTIONS OF THE ASSEMBLY
It shall be the duty of the
Assembly—
1. To promote and safeguard public
health and for this purpose the
Ministry of Health shall assign
Medical Officers of Health, health
inspectors and other staff as
appropriate except semi-skilled
and unskilled labourers to the
Metropolitan Assembly for the
proper discharge of this duty.
2. To cause their Metropolis to be
inspected regularly for the
detection of nuisances or any
condition likely to be offensive
or injurious to health.
3. If satisfied that any nuisance
or any condition likely to be
offensive or injurious to health
exists, to cause all proper steps
to be taken to secure the
abatement of the nuisance or the
removal of the condition.
4. To ensure the provision of
adequate and wholesome supply of
water throughout the entire
Metropolis in consultation with
the Ghana Water and Sewerage
Corporation.
5. To establish, install, build,
maintain and control public
latrines, lavatories, urinals and
wash places.
6. To construct and maintain
sewerages.
7. To establish, maintain and
carry out services for the removal
of nightsoil from any building and
for the destruction and treatment
of such night-soil.
8. To establish, maintain and
carry out services for the removal
and destruction of all refuse,
filth and carcasses of dead
animals from any public or private
place.
9. To regulate any trade or
business which may be noxious or
injurious to public health or a
source of danger to the public or
which otherwise is in the public
interest to regulate.
10. To provide for the inspection
of all meat, fish, vegetables and
all other foodstuffs and liquid of
whatever kind or nature intended
for human consumption whether
exposed for sale or not; and to
seize, destroy and otherwise deal
with all such foodstuffs or liquid
as are unfit for human consumption
and to supervise and control the
manufacture of foodstuffs and
liquids of whatever kind or nature
intended for human consumption.
11. To provide, maintain,
supervise and control
slaughter-houses and pounds and
all such matters and things as may
be necessary for the convenient
use of such slaughter-houses.
12. To prevent and deal with the
outbreak or the prevalence of any
disease.
13. To prevent the spread of and
exterminate tsetse-fly,
mosquitoes. rats, bugs and other
vermin.
14. To prohibit or regulate the
making of burrow-pits or other
excavations.
15. To establish and maintain
cemeteries.
16. To provide crematoria where in
the opinion of the Assembly it is
expedient so to do.
17. To regulate or prohibit the
sinking of wells and provide for
the closing of wells.
18. To establish, maintain and
control pounds, seize and impound
any stray animal and provide for
the payment of compensation for
damage done by such animal.
19. To provide that the owner or
occupier of any land or tenements
maintain, clear and keep free from
vegetation, the roads, streets or
paths adjoining his land or
tenements.
20. To provide for the control,
destruction and licensing of dogs.
21. To provide for the control,
regulation, inspection,
supervision and licensing of —
(i)
social halls, dance halls and
places of entertainment;
(ii) lodging and eating houses;
(iii) any premises or land in or
upon which any profession,
occupation, trade or business is
carried on;
(iv) such occupations as the
Minister may specify in an
Instrument from time to time.
22. To establish and operate
clinics and dressing stations in
consultation with the Ministry of
Health.
23. To construct, repair, maintain
and keep clean all streets.
24. To divert or alter where
necessary the course of any
street.
25. To provide or arrange for
electric lighting in streets and
other public places and where
necessary to provide and maintain
electricity supply in consultation
with the Electricity Corporation
of Ghana.
26. To construct, repair and
maintain all public roads other
than trunk roads but including
feeder roads and to undertake road
rehabilitation programmes within
the Metropolis.
27. To prescribe the condition
subject to which the erection and
construction, demolition,
re-erection and re-construction,
conversion and re-conversion,
alteration, repair, sanitation and
ventilation of public and private
buildings and structures may be
undertaken and carried out.
28. To provide for building lines
and the layout of buildings, to
prepare and undertake and
otherwise control schemes for
improved housing layout and
settlement.
29. To prescribe the conditions to
be satisfied on a site for any
building or for any class of
building.
30. To prohibit the construction
of any new building unless and
until the plans thereof have been
submitted to and approved by the
Assembly.
31. To provide for the demolition
of dangerous buildings and for the
recovery of any expenses incurred
in connection therewith.
32. To maintain, as agents of
central government, all public
buildings, including prestige
buildings put up by the Central
Government and previously
maintained by the Public Works
Department.
33. To maintain as agents of the
Ghana Highway Authority, trunk
roads lying within the boundaries
of the area of authority of the
Assembly.
34. To take steps to ensure the
effective maintenance of all
Government properties within its
area of authority.
35. To prohibit or regulate the
use in any defined area of any
inflammable material in the
construction or repair of any
building.
36. To control and regulate the
siting of advertisements and
hoardings or other structures or
other structures designed for the
displays of advertisements.
37. To build, equip, open close
and maintain markets, prohibit the
erection of stalls in places other
than markets and prevent the sale
and purchase of goods or stock
near established markets or
elsewhere.
38. To fix days and hours during
each day on which a market may be
held and prevent the sale and
purchase of goods in markets on
any day or at any hour except
those fixed.
39. To regulate and control
markets including the fixing of
and collection of stallages, rents
and tolls.
40. (1) To require the owner of
any premises to do any of the
following acts:
(i)
to remove, lower or trim to the
satisfaction of the Assembly any
tree, shrub or hedge overhanging
or interfering in any way with the
traffic in any street or with any
wires or works thereof,
(ii) to remove any dilapidated
fence or structure abutting on any
public place;
(iii) to paint, distemper,
white-wash or colour-wash the
outside walls or roof of any
building forming part of the
premises;
(iv) to tidy the premises; and
(v) to move any derelict car or
other vehicles.
(2) In the event of the owner
failing to comply with a notice
from any Assembly requiring him to
perform any of the acts specified
in subparagraphs i-v of paragraph
(1) the Assembly shall be at
liberty to undertake the work and
charge the owner with the cost
thereof.
41. To build, equip and maintain
all public primary, middle and
special schools as are in the
opinion of the Minister for
Education, after consultation with
the Minister responsible for Local
Government, required in its area.
42. To advise the Minister for
Education on all matters relating
to primary and middle schools and
such other matters as may be
referred to it by the Minister for
Education.
43. To be responsible for—
(i)
postings and transfers within its
area of authority of teachers
including pupil teachers;
(ii) keeping records of
teachers;
(iii) discipline of teachers in
accordance with the disciplinary
laid down by the Ghana Education
Service;
(iv) appointment of school welfare
officers;
(v) recommending teachers for
study leave;
(vi) appointment of headteachers
in accordance with rules laid down
by the Ghana Education Service;
(vii) supervision of primary and
middle schools;
(viii) formation of education
committees;
(ix) collection of statistical
data and other information;
(x) in-service training for pupil
teachers;
(xi) nursery school education;
(xii) approval for the opening of
private primary and middle
schools;
(xiii) payment of teachers'
salaries from funds made available
by Government;
(xiv) indenting for the supply and
distribution of textbooks;
(xv) disbursement of Education
Grants.
44. To provide for the control
and regulation of—
(i)
concerts, musical entertainment to
which admission is to be obtained
on payment of moneys or of any
reward, except where the whole
proceeds are being devoted to
charity;
(ii) horse-raising meetings.
45. To grant and maintain
scholarships or bursaries to
suitable persons to attend any
school or other educational
institution in Ghana or elsewhere.
46. To provide for the
establishment and maintenance of
facilities for arts and crafts,
for recreation and sports.
47. To establish, maintain,
control and contribute to bands
for musical performances in public
places and at functions arranged
by the Assembly; and generally to
provide musical entertainment in
such places and at such functions.
48. To arrange for the provision
of public libraries in
consultation with the Ghana
Library Board.
49. With the prior approval of the
Ghana Museums and Monuments Board,
to control the disposal of any
African antique work of art.
50. To organise community
development programmes to improve
and enrich rural life through
running literacy and adult
education classes, organising
voluntary contributions and
communal labour for the provisions
of such facilities and services as
water supplies, roads, school
buildings, community centres and
public places of conveniences, and
teaching village women the
management of home and care of
children.
51. To take such measure as would
promote the well-being of
under-privileged children and the
stability of the distressed family
52. organise and maintain
child-care centres and ensure the
process running and management of
such centres.
53. To establish, run and manage
children's homes and offer
parental care for the deprived,
namely, orphans and those that are
neglected or abandoned.
54. To render relief services
during natural disasters, e.g..
floods, fire, earthquakes,
accidents in the form of supply of
material.
55. To be responsible for the
improvement of agriculture
including extension services and
allotments for agricultural
purposes.
56. To control methods of
husbandry.
57. To allocate land in the
ownership of the Assembly for
farming purposes and to regulate
the systems of farming of such
land.
58. To provide services for the
improvement of livestock.
59. To prevent and control animal
diseases.
60. To prohibit, restrict or
regulate the hunting, capture,
killing or sale of animals or
birds or any specified kind of
animal or bird.
61. To provide and maintain public
parks and gardens.
62. To provide for measures for
soil and water conservation.
63. To provide for the fencing of
land and for the maintenance and
repair of such fences.
64. To take every step to
encourage persons to plant
specified crops for the
maintenance of themselves and
their families.
65. To plant trees in any street
and to erect tree-guards to
protect the same: provided that
the streets shall not be unduly
obstructed thereby.
66. To regulate or prohibit the
planting, cutting, tapping or
destruction of any tree or
vegetation growing along any
street, road or path or in any
public place.
67. To establish and manage, on
commercial basis, rural and
small-scale industries and farms.
68. To promote tourism in the
Metropolis in co-operation with
the Regional Development
Corporation and the Tourist
Development Board.
69. Subject to the control and
direction of the Registrar of
Births and Deaths to register all
births and deaths occurring within
the Metropolis.
70. To appoint in consultation
with the Registrar of Births and
Deaths such registration staff as
may be necessary for the proper
discharge of births and deaths
registration duties.
71. To make such financial
contribution as the Assembly
considers necessary for the
maintenance of any traditional
authority which possesses any
functions which relate to any part
of its area.
72.'To establish and maintain tree
nurseries and forest plantation
and sell the produce thereof.
73. To compile and maintain a
record of all tenant farmers and
the rents and tributes which
should be paid by them.
74. To prohibit or restrict the
driving or use of vehicles
generally or any specified class
on any specified road or specified
direction on any specified road.
75. To regulate the use and
conduct of public vehicles, to
regulate routes and parking places
to be used by such vehicles to
appropriate particular routes,
roads, streets and parking places
to specified classes of traffic
and when necessary to provide the
identification of licensed
vehicles as defined in the Motor
Traffic Ordinance.
76. To license any vehicle used
for taxi, bicycle, motor bicycle
and to prescribe the fees to be
paid in respect of any such
bicycles or vehicle.
77. To establish, acquire and
maintain transport service by land
or water including ferries.
78. To establish, maintain and
control parks for motor and other
vehicles.
79. To establish and maintain in
consultation with the Posts and
Telecommunications Corporation,
Postal Agencies where necessary.
80. To lay down rules and
regulations in respect of private
and public property to ensure
adequate fire protection.

outbreaks including bush fires.
82. To promote the development of
all sports within the area of
authority of the Assembly.
83. To organise sports activities
within the area of authority and
to provide such facilities as may
be recommended by the national
body responsible for sports.
84. To perform as agents of the

sports in maintaining such sports
facilities as may be assigned to
it by the national body.
85. To advise to the exclusion of
all others on all matters of
sports relating to its area of
authority.
86. To prohibit, restrict,
regulate and license the
manufacture, distillation, sale
transportation distribution,
supply, possession and consumption
of akpeteshie, palm-wine, and all
kinds of description of fermented
liquour usually made by citizens
of Ghana or adjacent countries.
87. To license petrol service and
filling stations within the
Metropolis.
88. To provide information
centres, where necessary, in
consultation with the Ministry of
Information.

FOURTH SCHEDULE
(Paragraph 21)
FUNCTIONS OF SUB-METROPOLITAN
DISTRICT COUNCILS
It shall be the duty of a
Sub-Metropolitan District
Councils: —
1. To number and keep records of
all rateable properties in its
area and collect all rates fixed
and taxes levied by the Assembly.
2. Be responsible for the
day-to-day administration of its
area.
3. Promote and safeguard public
health and for this purpose assign
medical officers of health, health
inspectors and other staff as
appropriate except semi-skilled
and unskilled labourers, to its
area.
4. Cause its area to be inspected
regularly for the detection of
nuisance or any condition likely
to be offensive or injurious to
health and to cause all proper
steps to be taken to secure the
abatement of the nuisance or the
removal of the condition.
5. Build, install, maintain and
control public latrines,
lavatories and urinals.
6. Name all streets in its area
and cause all buildings in such
streets to be numbered.
7. Administer as agents the issue
of loans under the Roof Loans
Scheme.
8. Be responsible for the
administration or self-help
projects in consultation with the
Ministry of Mobilization and
Social Welfare; and
9. Prepare annual estimates
covering recurrent and development
expenditure for inclusion in the
budget of the Assembly.
FIFTH SCHEDULE
(Paragraph (30) (1))
FUNCTIONS OF TOWN COUNCILS
1. To take over, as appropriate,
all the functions formerly
performed by the Town and Village
Committee concerned.
2. To enumerate and keep records
of all rateable persons and
properties in the town.
3. To assist any person authorised
by the Assembly to collect revenue
due to the Assembly.
4. To recommend to the Assembly
the naming of all streets in its
area of authority and cause all
buildings in such streets to be
numbered.
5. To plant trees in any street
and to erect tree-guards to
protect them: provided that the
streets are not unduly obstructed
thereby.
6. To prevent and control fire
outbreaks including bush fires.
7. To organise with any, other
relevant organisation annual
congresses of the people of the
town for the purpose of discussing
the development of the town
including the raising of voluntary
or other contributions to fund
such development.
8. To perform such other functions
as may be delegated by the
Assembly or the Sub-Metropolitan
District Council.
9. Town Councils shall perform
the following additional
functions-
(i)
be responsible for the day-to-day
administration of the town;
(ii) arrange revenue collection
contracts with the Assembly and
collect revenue due to the
Assembly;
(iii) prepare annual budgets of
revenue and recurrent and
development budget of the Town
Council for approval by the
Assembly;
(iv) open and maintain Bank
Accounts;
(v) provide, operate and
maintain community services in the
town;
(vi) take such steps as may be
necessary 'to prevent disasters
including floods and bush fires in
the town;
(vii) recommend short, medium and
long-term development plans for
the town for the approval of the
Assembly;
(viii) make proposals to the
Assembly for the levying and
collection of special rates for
projects and programmes within the
town;
(ix) subject to the approval and
direction of the Assembly, to
implement schemes for economic
development and social justice as
may be entrusted to them.
SIXTH SCHEDULE
(Paragraph 37(1))
FUNCTIONS OF UNIT COMMITTEES
1. Take over, as appropriate, all
the functions formerly performed
by the Town or Village Committee
concerned.
2. Supervise the staff of the
Assembly assigned duties in its
area of authority.
3. Assist the Town Council to
enumerate and keep records of all
rateable persons and properties.
4. Assist any person assigned by
the Urban or Town Council to
collect allocated and contracted
revenue on behalf of the Urban or
Town Council.
5. Mobilise members of the Unit
for the implementation of
self-help and development
projects.
6. Monitor the implementation of
self-help and development
projects.
7. Take all lawful steps to abate
any nuisance.
8. Be responsible, under the
guidance of the Registrar of
Births and Deaths, for the
registration of births and deaths
in the unit.
9. Provide a focal point for the
discussion of local problems and
take remedial action where
necessary or make recommendations
to the Assembly where appropriate
through the relevant Urban, Zonal
or Town Council.
10. Organise communal and
voluntary work especially with
respect to sanitation—
11. Make special proposals to the
Assembly for the levying and
collection of rates for projects
and programmes through the
relevant Urban, Zonal or Town
Council.
12. Educate the people on their
rights, privileges, obligations
and responsibilities in
consultation with the District
branch of the National Commission
for Civic Education.
13. Monitor the implementation of
any enactment regulating the use
of chain-saws in the Unit.
14. Oversee the performance of
staff of the Urban, Zonal or Town
Council and Metropolitan Assembly
assigned to work in the Unit.
15. Perform such other functions
as may be delegated by the Urban,
Zonal or Town Council or the
Assembly.
