MERCHANT SHIPPING (CERTIFICATES OF MASTERS AND ENGINEERS) REGULATIONS, 1988 (LI 1358)

IN exercise of the powers conferred on the Provisional National Defence Council Secretary responsible for Transport and Communications by section 72 of the Merchant Shipping Act, 1963 (Act 183) these Regulations are made this 16th day of March, 1988.

Regulation 1—Secretary to Issue Certificates.

(1) The Secretary shall issue in appropriate cases the following certificates of competency:

(a) Desk Certificates —

(i) Class 1 Master Mariner;

(ii) Class 2 Deck Officer;

(iii) Class 3 Deck Officer.

(b) Marine Engineering Certificates —

(i) Class 1 Chief Engineer;

(ii) Class 2 Marine Engineer;

(iii) Class 3 Marine Engineer.

(2) The certificates specified in sub-regulation (1) of this regulation shall be issued to persons who pass the relevant examinations prescribed by the Secretary.

Regulation 2—Fees to be Paid for Certificate.

A person shall be issued with the relevant certificate of competency upon payment by him of the prescribed fees.

Regulation 3—Examiners to Conduct Examination.

Examinations prescribed under sub-regulation (2) of regulation 1 shall be conducted by such Examiners as the Secretary may appoint.

Regulation 4—Secretary to Prescribe Conditions for Examination.

1. The Secretary may from time to time by notice in the Gazette prescribe the qualifications and conditions for the examinations.

2. No person shall qualify to enter for any such examination if he fails to fulfil the conditions prescribed by the Secretary.

Regulation 5—No Person to Undertake any Duty.

1. No person shall undertake any duty other than that in respect of which he holds the relevant certificate of competency.

2. Notwithstanding sub-regulation (1) of this regulation a person may, in the case of any unforeseen circumstances undertake any duty in a position next higher in rank to the position in respect of which he holds the relevant certificate of competency:

Provided that such position shall not be held for more than one voyage or more than six months whichever is shorter.
