This Order may be cited as the
Mining Health (Marlu Area) Order.
Order 2—Declaration of Marlu as
Mining Health Area.
The area delimited in the
subjoined Schedule is hereby
declared to be a Mining Health
Area.
SCHEDULE
All that piece or parcel of land
situate in the Wasaw District of
the Gold Coast Colony and bounded
as follows—
The boundaries run parallel to and
one mile distant from those of the
Marlu Gold Mining Areas Limited
Mining Area and, in addition,
include strips of land three miles
in extent and half a mile in depth
along the following roads—
Bogosu-Enchi Road
Bogosu-Prestea Road
Bogosu-Insu Road.
The Town of Bogosu and the New
Bogosu Lay-out are excluded from
the Mining Health Area.

SCHEDULE
All that piece of land situate
surrounding the Ariston Gold Mines
(1929) Limited Mining Area near
the Town of Prestea in the Gold
Coast Colony the boundaries
whereof are as follows—
Commencing at a point on the right
bank of the Ankobra River and
which said point is situate west
from the 54 mile post on the
Prestea-Tarkwa Railway runs on a
bearing of two hundred and
eighteen degrees—which bearing
together with all further bearings
hereinafter mentioned is referred
to True North—for a distance of
sixteen thousand feet and thence
runs on a bearing of two hundred
and nineteen degrees for a
distance of eleven thousand feet
to the south east corner of Tuapim
Renewed. Concession and thence
runs on a bearing of two hundred
and seventy degrees for a distance
of twelve thousand feet to the
south west corner of the said
Concession and thence runs on a
bearing of three hundred and sixty
degrees for a distance of twelve
thousand feet to the north west
corner of the said Concession and
thence runs on a bearing of
forty-five degrees for a distance
of eleven thousand five hundred
feet and thence runs on a bearing
of thirty-eight degrees for a

The area described in the Schedule
to this Order shall be a Mining
Health Area.
SCHEDULE—ADOWSENA CONCESSION NO. 1
MINING HEALTH AREA
All that piece of land the
boundaries whereof run parallel
with and half a mile outside a
line which forms the outer
boundary of Adowsena Concession
No. 1 and which said line
commencing at the north-west
corner of Adowsena Concession No.
1 situate on the left bank of the
River Pra runs on a bearing of
ninety degrees—which bearing
together with all further bearings
hereinafter mentioned is referred
to True North—for a distance of
ten thousand seven hundred and
thirty-four feet to the north-east
corner thereof and thence follows
the eastern boundary of the said
Concession on a bearing of one
hundred and eighty degrees for a
distance of ten thousand five
hundred and sixty feet to the
south-east corner thereof and
thence follows the southern
boundary of the said Concession on
a bearing of two hundred and
seventy degrees for a distance of
fifteen thousand six hundred and
sixty-six feet to the south-west
corner thereof situate on the left
bank of the aforesaid River Pra
and thence follows the left bank
of the said River Pra in a general
north-north-easterly direction to
the point of commencement save
that the said boundaries shall not
include that area within the
boundaries of the Town of Ntronang
as defined under the Towns
Ordinance the said piece of land
being more particularly delineated

COMPANY LIMITED
PEPAYE DREDGING MINING HEALTH AREA
All that piece of land situate in
the Wasaw Aowin District of the
Gold Coast Colony the boundary
line whereof commencing at a point
on the Bawdia-Enchi Road which
said point is distant
approximately two thousand seven
hundred feet as measured westward
along the said Bawdia-Enchi Road
from mile post 25 runs due north
for a distance of one half of a
mile and thence runs in an
easterly direction parallel to and
distant one half of a mile north
from the said Bawdia-Enchi Road
for an approximate distance of
three miles and thence runs in a
northerly direction parallel to
and distant one mile west from the
right bank of the River Ankobra
for an approximate distance of
twenty-five and one half miles to
a point situate approximately one
half of a mile north west from the
Village of Jukwa and thence runs
due east for a distance of
approximately two miles and thence
runs in a southerly direction
parallel to and distant one mile
east from the left bank of the
aforesaid River Ankobra for an
approximate distance of fifteen
and one half miles and thence runs
in a north easterly direction
parallel to and distant one half
of a mile north west from the
Bawdia-Ayanfuri Road for an
approximate distance of two and
three quarter miles and thence
runs by a circle whose radius is
one mile and whose centre is at
the middle of the Town of Akropong
to a point situate one half of a
mile south east from the aforesaid
Bawdia-Ayanfuri Road and thence
runs in a general south westerly
direction parallel to and distant
one half of a mile east from the
said Bawdia-Ayanfuri Road for an
approximate distance of ten miles
to the northern corner of the
boundary of the Marlu Mining
Health Area on the Insu-Bawdia
Road and thence runs in a westerly
direction parallel to and distant
one half of a mile south from the
Bawdia-Enchi Road for an
approximate distance of four and
one half miles and thence runs in
a general southerly direction
parallel to and distant one mile
east from the left bank of the
aforesaid River Ankobra for an
approximate distance of twelve and
one half miles and thence runs in
a north easterly direction
parallel to and distant one half
of a mile north west from the
Bogoso-Prestea Road for an
approximate distance of two and
one half miles to the south
western corner of the boundary of
the aforesaid Marlu Mining Health
Area on the said Bogoso-Prestea
Road and thence follows the
southern boundary of the said
Marlu Mining Health Area for a
distance of one mile and thence
runs in a south westerly direction
parallel to and distant one half
of a mile south east from the
aforesaid Bogoso-Prestea Road for
an approximate distance of four
and one eighth miles and thence
runs on an approximate true
bearing of two hundred degrees
forty-eight minutes for a distance
of three miles to the north
eastern corner of the Prestea and
Bondaye Mining Health Area and
thence follows the northeastern
boundary of the said Prestea and
Bondaye Mining. Health Area to the
north western corner thereof and
then runs in a general northerly
direction parallel to and distant
one mile west from the right bank
of the aforesaid Ankobra River for
an approximate distance of twelve
and one half miles and thence runs
in a westerly direction parallel
to and distant one half of a mile
south from the aforesaid
Bawdia-Enchi Road for an
approximate distance of three
miles and thence runs due north
for a distance of one half of a
mile to the point of commencement
the same being more particularly
delineated and shewn edged pink on

which has been filed with the
Surveyor-General at Cantonments,

Tarkwa Common Mining Health Area
Order.
Order 2—Declaration of a Mining
Health Area and Prohibited Area
for Recruitment of Labour.
The area described in the Schedule
to this order shall be a Mining
Health Area, and shall also be a
Prohibited Area for the purposes
of the aforesaid Regulations.
Order 3—Amendment of Schedule to
Order No. 5 of 1927.
The Schedule to the order made
under the aforesaid authorities on
the 17th day of March, 1927, is
hereby amended by deleting
therefrom those portions thereof
which relate to the areas
specified therein as the Nsuta
Mining Health Area, the Adja
Mining Health Area and the Abosso
Mining Health Area respectively.

Commencing at the north-west
corner of Bippobin Concession
follows the north-eastern and
south-eastern boundaries of the
said Concession to the south-east
corner thereof and thence by a
straight line to a point on the
southern boundary of Cinnamon
Bippo Timber Concession and thence
runs due south and along the
eastern edge of Satchen Estate
Concession to the southern
boundary of Satchen Extension
Concession and thence follows the
said southern boundary of Satchen
Extension Concession to the
south-west corner thereof and
thence follows the eastern
boundary and thence the southern
boundary of Abosso Timber and

foregoing boundaries to which the

for the time being apply under
section 3 of that Ordinance. The

Officer-in-Charge, Cadastral
Branch, Gold Coast Survey
Department on the 11th day of
January, 1937 and on which the
Mining Health Area boundaries are
shewn edged pink.

Takrowasi-Kusi) Area Order.

Health Area.
The area defined in the Schedule
shall be a Mining Health Area.

TAKROWASI-KUSI MINING HEALTH AREA
The boundaries of the Mining
Health Area for the Takrowasi-Kusi
Concession shall be as follows—
Commencing at a point on the Gold
Coast Government Railway (Central
Province Line) and which said
point is distant approximately two
thousand eight hundred and seventy
feet as measured south west along
the said Railway from the 92 mile
post runs on a bearing of three
hundred and seventeen degrees
fifty minutes—which bearing
together with all further bearings
hereinafter mentioned is referred
to True North—for a distance of
eight thousand seven hundred feet
and thence runs on a bearing of
fifty-three degrees thirty minutes
for a distance of ten thousand and
eighty feet and thence runs on a
bearing of one hundred and twenty
degrees forty-five minutes for a
distance of nine thousand nine
hundred and twenty feet and thence
runs on a bearing of two hundred
and twelve degrees thirty minutes
for a distance of twelve thousand
five hundred and forty feet and
thence runs on a bearing three
hundred and eight degrees thirty
six minutes for a distance of five
thousand one hundred and forty
feet to the point of commencement
but excluding Gold Coast
Government Railway Land and also
the Domiabra Town Area and that
portion of the Takrowasi Town Area
as declared under the Towns

SECTION 4—REGULATIONS
Regulation 1—Title and
Application.
(1) These Regulations may be cited
as the Mining Health Areas
Regulations.
(2) Regulations 14, 15, 17, 18,
22, 23, 24, 29 and 36 of these
Regulations shall apply to all
Mining Health Areas, and the
remainder of these Regulations
shall apply to any particular
Mining Health Area upon the
declaration of part of such Mining
Health Area as a Mining Area by
Order of the Governor in Council.
Regulation 2—Interpretation.
Definitions—
"Inspecting officer" includes the
Chief Medical officer and any
properly qualified member of the
Medical Department especially
appointed as such by the Chief
Medical Officer;
"Manager of the Mine" includes the
Acting Manager;
"Mining Area" means such portion
of a Mining Health Area
(containing within it mine shafts
and workings, power plant and
machinery, employees' bungalows,
mine labourers' villages, etc.),
as shall be agreed upon between
the Chief Medical Officer on the
one part and the manager of the
mine on the other part, and
declared as such by order of the
Governor in Council: Provided that
where agreement is not reached,
the decision of the Governor shall
be final.
Regulation 3—Medical Examination
of Labourers.
SCHEDULE
(1) No manager of any mine shall
employ in any mining area any
labourer until a registered
medical practitioner shall have
examined such labourer and have
certified in the form prescribed
in the Schedule to these
Regulations that the said labourer
is fit for such engagement.
(2) The manager of the mine shall
keep a register of the medical
certificates referred to in
sub-regulation (1) of this
regulation.
(3) No manager of a mine who has
received a notification from the
Chief Medical Officer that in
respect of the mining area in
which such mine is situated there
has been a failure to comply with
any of these Regulations, shall
until the Chief Medical Officer
has withdrawn such notification,
employ or permit to be employed on
or in connection with such mine
any labourer after the date of the
receipt by the manager of the mine
of the said notification except
such labourers as were actually
working on or in connection with
the mine on the said date.
Regulation 4—Inspection of
Registers.
All registers of medical
certificates shall be open to
inspection by any inspecting
officer.
Regulation 5—Inoculation against
Pneumonia.
The medical officer of every mine
for which one has been appointed
shall offer free of charge to
every labourer employed on or in
connection with the mine, whether
under written contract of service
or not, inoculation against
pneumonia.
Regulation 6—Sanitary Labour.
(1) The manager of the mine shall
appoint in writing European
supervisors for—
(a) The sanitary maintenance of
all surface and underground
latrines in the mining area;
(b) The supervision of the housing
and accommodation of labourers in
the mining area;
(c) Housing conditions generally
in the mining area;
(d) The sanitation of the mining
area; and
(e) Generally carrying out these
Regulations in the mining area.
(2) The manager of the mine shall
employ such labour as may be
necessary for the carrying out of
these Regulations.
Regulation 7—Latrines,
Incinerators, and Dustbins.
The structure, design, and
arrangement of all surface and
underground latrines,
incinerators, and dustbins in a
mining area shall be such as are
approved by the Chief Medical
Officer.
Regulation 8—Inspection of
Latrines.
All surface and underground
latrines in a mining area shall be
inspected weekly by a European
supervisor, who shall be
responsible to the mine manager
for their cleanliness and
disinfection.
Regulation 9—Use of Disinfectant
in Latrines.
The walls, floors, and the
squatting and seating arrangements
in every latrine in a mining area,
shall be washed down daily with
disinfectant; and every latrine
seat shall be provided with a
spare bucket; and every bucket
shall have a close-fitting lid.
Regulation 10—Separation of
Latrines for Males and Females.
All latrines for males erected in
a mining area shall be constructed
on sites removed some distance
from latrines for females.
Regulation 11—Disinfectant of
Latrine Buckets and Sanitary
Carts.
All vehicles used for the
conveyance in a mining area of
latrine buckets, and all latrine
buckets after being emptied at the
trenching ground, shall be
subjected to steam disinfection or
shall be thoroughly cleansed in
disinfectant solution.
Regulation 12—Disinfection of
Skip.
The skip used in a mining area for
conveying labourers in and out of
the mine shall be cleansed at
least once daily by hosing with
steam, or thoroughly cleansed in
disinfectant solution.
Regulation 13—Water Supply.
The manager of the mine shall, as
far as the Chief Medical Officer
shall consider possible and
reasonable, provide in the mining
area an ample and pure water
supply for all employees of the
mine and, at such times as the
Chief Medical Officer may consider
necessary, shall cause or permit
samples of the water to be taken
for analysis, and shall keep a
record of the results of each
analysis at the time and shall
send a copy to the Chief Medical
Officer, Accra.
Regulation 14—Resident Area.
The manager of every mine in which
labourers are employed shall in a
place or area located to the
satisfaction of the Chief Medical
Officer provide such accommodation
for such labourers as is required
by such officer.
Regulation 15—Village Master.
(1) In the case of every mine in
connection with which five hundred
or more labourers are employed,
there shall be appointed by the
manager of the mine a European
Village Master, who shall, if
possible, have some working
knowledge of tropical hygiene and
some experience in dealing with
Africans.
(2) The Village Master shall work
under the supervision of the
medical officer (if any) appointed
under regulation 27 subject to the
order of the manager of the mine.
Regulation 16—Infectious Diseases.
Every house in a mining area in
which plague, cholera, yellow
fever, small-pox, cerebro-spinal
meningitis, tuberculosis,
pneumonia, dysentery, or relapsing
fever has occurred shall be
disinfected and afterwards
lime-washed before being
reoccupied. The manager of the
mine shall by telegram notify the
Chief Medical Officer of the
occurrence of any such disease,
and shall ensure that this
regulation is carried out. On a
mine to which a medical officer
has been appointed the medical
officer shall notify the manager
of the occurrence of any of the
above-mentioned diseases, and
shall advise the manager of the
mine with regard to the carrying
out of this regulation.
Regulation 17—Prohibition of
Swine.
The keeping of swine within a
Mining Health Area shall be
prohibited; and any swine found
within a Mining Health Area shall
be deemed to be a nuisance within
the meaning of this term in the
Towns Ordinance:
Provided that swine may be kept in
a Mining Area by the Mine Manager
in an established piggery subject
to the following conditions—
1. That the Mine Manager shall be
responsible for the management and
control of the piggery.
2. That swine shall be confined to
the piggery.
3. That the piggery shall be
situated at least five hundred
feet from any human habitation on
a site approved by the Chief
Medical Officer.
4. That the design and
construction of the piggery shall
conform to the requirements of the
Chief Medical Officer who shall
limit the number of swine to be
kept therein.
5. That fodder shall be stored in
fly-proof containers of a type
approved by the Chief Medical
Officer.
6. That manure shall be stored and
disposed of in accordance with the
requirements of the Chief Medical
Officer.
7. That the piggery shall be
cleansed with water at least once
a week and at any other time when
required by the inspecting officer
so to do.
Regulation 18—Part Application of
Regulations 14 to Mining Health
Area Cap.
(1) Regulations 14, 20, 21, 24,
42, 71, 72, 74, 82, 83 (3), (4),
85, 86, 87, 88, and 91 of the Gold
Coast Colony Buildings
Regulations, made under the Towns
Ordinance shall be deemed to be in
force in every Mining Health Area.
(2) The manager of the mine in a
mining area and the Chief Medical
Officer or some person specially
authorised by him in such part of
the Mining Health Area as is
outside the mining area shall be
vested with the powers and duties
in the Director of Public Works
under the Regulations mentioned in
sub-regulation (1) hereof:
Provided that this regulation
shall not apply to any Mining
Health Area or any part of a
Mining Health Area to which the
Towns Ordinance has been applied.
Regulation 19—Plans of Mine
Village.
The manager of the mine shall in a
mining area cause plans to be made
of every existing mine village or
proposed new village or re-layout
of an existing village or of part
of an existing mine village. Each
plan shall show the layout of the
village, and shall indicate all
building sites and plots for
houses, hospitals,
slaughter-places, markets, all
sanitary conveniences (including
latrines for males and females),
washing places, baths, dustbins,
incinerators, roads, lanes, and
open spaces, the main drains,
wells, water taps, and standpipes,
and shall show in addition the
layout of any proposed future
extension of the village and of
any area set apart for the housing
of labourers for employment in
connection with the mine. Such
plans shall, if the Chief Medical
Officer shall so require, be
contoured plans:
Provided that nothing in these
Regulations shall be deemed to
authorise the demolition without
the consent of the owner of any
building save in accordance with
the provisions of regulation 24.
Regulation 20—Approval of Plans.
All plans required by regulation
19 shall be submitted to the Chief
Medical Officer, for his approval.
Regulation 21—Building Sites.
No new building or hut shall be
erected except on a site shown on
one of the plans referred to in
regulation 19 and approved under
regulation 20, or unless the site
has first been approved by the
Chief Medical Officer: Provided
that no site shall be used for the
erection thereon of any building
or hut or addition to any existing
building or hut which has not
first been elevated and drained to
the satisfaction of the Chief
Medical Officer or which has been
filled up with any such animal,
vegetable, or other offensive
matter, or with anything
impregnated with any such matter,
or upon which any such matter
shall have been deposited, unless
and until such matter shall have
been properly removed or
destroyed.
Regulation 22—Streets and Lanes.
In every village laid out or in
any existing village or in any
part of any existing village
re-laid out after the 1st day of
July, 1935, no street shall be
less than 30 feet wide, and no
back street or lane shall be less
than 12 feet wide measured from
eave to eave; and there shall be a
space of at least 15 feet between
buildings or huts on the same side
of the street.
Regulation 23—Permit Required for
New Building or Structural
Alteration of Building.
No new building shall be
commenced, and no alteration or
addition to the external or
internal structure of any building
shall be made until a permit for
such new building or structural
alteration or addition has been
obtained from the manager of the
mine if such building is situate
in the mining area or from the
Chief Medical Officer or his
representative if such building is
situate outside such mining area.
Regulation 24—Duties of Manager.
The manager of the mine in a
mining area and the Chief Medical
Officer or his representative in
such part of the Mining Health
Area as is outside such mining
area:—
(1) Shall take the necessary steps
to ensure that no erection of a
new building is commenced, and
that no alteration of or addition
to the external or internal
structure of any building shall be
made until a permit for such new
building or structural alteration
or addition has been obtained from
him;
(2) May pull down any work or
works executed in contravention of
or otherwise than in accordance
with these Regulations and may
thereupon recover any expense
incurred thereby as a debt from
the person whose actions or
omissions led to the work or works
being so executed;
Dangerous Buildings.
(3) May demolish any house or
building certified in writing by
an inspecting officer to be in a
ruinous or dangerous condition, or
in a condition dangerous or
injurious to the health of the
inmates or to the public health on
being authorised so to do by the
Government Agent (who is hereby
empowered to grant such
authorisation):
Provided that such demolition
shall not be authorised as
aforesaid by the Government Agent
under this sub-regulation, unless—
(1) the inspecting officer
certifies in writing that
immediate demolition is necessary;
or
(2) the inspecting officer
certifies in writing that the
house or building cannot be put
into proper condition by repair or
otherwise, and a notice of
intention to apply to the
Government Agent for authority for
demolition has been posted on the
house or building fourteen days
before the date of such
application; or
(3) notice to repair or otherwise
put the house or building into
proper condition has been posted
on the house or building fourteen
days before the date of the
application for authority for
demolition, and the requirements
of the inspecting officer have not
been complied with.
Regulation 25—Refuse, Sewage, and
Waste.
In a mining area the manager of
the mine shall take all necessary
measures to the satisfaction of
the Chief Medical Officer for the
removal and disposal of refuse,
waste products, and night-soil.
Regulation 26—Rooms.
The provisions of this regulation
shall only apply to rooms in
existing buildings and huts in
mine villages situate in a mining
area partially or wholly used for
occupation by labourers for
employment in a mining area—
(a) Occupants.
Room accommodation for labourers
shall be provided on a basis of
not less than 480 cubic feet of
air space for each person.
(b) Floors.
Floors of all rooms shall be
cemented.
(c) Lighting and Ventilation.
For lighting and ventilation, a
strip of expanded metal one foot
deep and in length equivalent to
two-thirds of the length of the
wall, provided the stability or
structure of the wall permits of
such length, shall be inserted in
the upper part of the front and
back walls of the room below and
parallel to any ceiling that may
exist.
Regulation 27—Medical Officer.
The management of every mine
employing 500 or more persons
shall appoint a whole-time medical
officer: Provided that the Chief
Medical Officer may, on
application being made to him,
sanction in special circumstances,
the employment of a part-time
medical officer.
Regulation 28—Powers of Medical
Officers with Respect to Mosquito
Destruction.
In a mining area a medical officer
appointed under regulation 27 and
in such part of a mining health
area as is outside such mining
area a Government medical officer
appointed by the Chief Medical
Officer—
(a) May enter upon and inspect any
premises between the hours of six
a.m. and six p.m.;
(b) May take immediate steps to
destroy any mosquito larvae that
may be found on any premises and
to render any accumulations of
water on such premises temporarily
unfit to be breeding places for
mosquitoes;
(c) May take such action or order
the owner or occupier of any
premises to take such action as
may be necessary to render any
accumulations of water on such
premises permanently unfit to be
breeding places for mosquitoes:
Provided that no order shall be
made nor action taken under this
paragraph involving the
expenditure of any sum exceeding
five pounds.
Regulation 29—Abatement of
Nuisance.
(1) In a mining area a medical
officer appointed under regulation
27 and in such part of a Mining
Health Area as is outside such
mining area a Government medical
officer authorised by the Chief
Medical Officer may on receiving
information of or having reason to
suppose the existence of, any
nuisance, personally or by some
messenger authorised by him visit
the premises where such supposed
nuisance exists and shall serve a
notice on the person by whose act,
default, or sufferance the
nuisance arises or continues or
the occupier or owner of the
premises ordering him to abate the
same.
(2) If the person on whom the
notice is served makes default in
complying with any of the
requirements thereof within the
time specified by the notice or
within five days if the time was
not specified, or fails to satisfy
the medical officer that he has
used all due diligence to carry
out the requirements he shall
unless he satisfies the Court that
he has used all due diligence to
carry out the requirements be
guilty of an omission in
contravention of this regulation.
(3) On any person being convicted
for an omission in contravention
of this regulation the medical
officer may enter the premises and
abate the nuisance and may recover
the expenses incurred as a debt
against the convicted person.
Regulation 30—Hospital.
The management of every mine which
is required under regulation 27 to
appoint a medical officer shall
provide hospital accommodation
which, in the opinion of the Chief
Medical Officer is suitable and
adequate.
Regulation 31—Plans of Hospital.
No work shall be undertaken in
building any new hospital required
under regulation 30 or in altering
any existing hospital until plans
showing site, sections, and
specifications of buildings, and
arrangements for sanitation and
ventilation, have been submitted
to the Chief Medical Officer, to
enable him to examine the plans
and if necessary, to state any
objections he may have to any of
the proposals therein.
Regulation 32—Dispensary.
The management of every mine
employing 200 persons or over
shall appoint a duly licensed
druggist and dresser: Provided
that the Chief Medical Officer
may, on application being made to
him, sanction, in special
circumstances, the appointment of
an unlicensed druggist. The
management shall also provide a
dispensary with an adequate supply
of drugs, and surgical and medical
necessaries within one hundred
yards of a shaft head which is
used for the purposes of winding
persons. At mines to which a
medical officer has been appointed
under regulation 27, the druggist
and dresser shall be responsible
to the medical officer.
Regulation 33—Inspecting Officer.
An inspecting officer may at any
time after due notice has been
given to the manager of the mine
visit and inspect any mining area
or any part of such area, and
shall reduce into writing any
recommendation he may have to
make; and he shall send one copy
of such recommendations to the
manager of the mine and one copy
to the Chief Medical Officer.
Regulation 34—Appeal of Manager.
The manager of the mine shall
carry out any recommendation made
within the scope of these
Regulations and communicated to
him in accordance with regulation
33: Provided that the manager of
the mine may appeal against any
such recommendation to the Chief
Medical Officer whose decision
thereon shall be binding, unless
the Governor shall, on application
being made to him in that behalf
by the said manager, see fit to
vary such decision; in which case
such decision shall have effect as
so varied.
Regulation 35—Inspection.
The manager of any mine to which a
medical officer has been appointed
under regulation 27 shall on
notification by the Chief Medical
Officer, that an inspection will
be made under regulation 33,
inform the mine medical officer
who shall accompany the inspecting
officer. In case of all other
mines, the manager of the mine or
his deputy shall accompany the
inspecting officer.
Regulation 36—Offences.
Every act or omission in
contravention of any of the
provisions of these Regulations
shall constitute an offence
against these Regulations; and any
such offence shall, on the summary
conviction of the offender, be
punishable with a fine not
exceeding fifty pounds or in
default of payment with
imprisonment; or in the case of a
continuing offence a fine may be
imposed not exceeding five pounds
a day for the period during which
the offence has continued; and in
default of payment a sentence may
be imposed of imprisonment for any
term not exceeding one year.
