AN ORDINANCE to amend the Mining Rights Regulation Ordinance (Chapter 153).

Date of Commencement: [4th March, 1957.]

BE IT ENACTED by the Legislature of the Gold Coast, as follows:—

Section 1—Short Title.

This Ordinance may be cited as the Mining Rights Regulation (Amendment) Ordinance, 1957, and shall be read as one with the Mining Rights Regulation Ordinance, hereinafter referred to as the principal Ordinance.

Section 2—Amendment of Section 2 of Principal Ordinance.

Section 2 of the principal Ordinance is hereby amended —

(i) by deleting the definition of "Concession land";

(ii) by inserting after the definition of "Gold Coast" the following new definition:—

"'lessee' means any person to whom a right to conduct mining operations is granted under a mining lease;";

(iii) by deleting the definition of "Mining" and substituting the following definition:—

"'mining' includes dredging, boring for mineral oil and any other operations for winning or obtaining minerals or precious stones;";

(iv) by inserting after the definition of "Mining concession" the following new definitions:—

" 'mining land' means land subject to a mining concession or mining lease;

'mining lease' means any writing whereby any right is granted to conduct mining operations in land under territorial waters;"; and

(v) by inserting in the definition of "Mining rights" immediately after the word "concession" the words "or mining lease".

Section 3—Amendment of Section 3 of Principal Ordinance.

Section 3 of the principal Ordinance is hereby amended by substituting for the word "concession" occurring in subsection (2) the word "mining".

Section 4—Amendment of Section 5 of Principal Ordinance.

Section 5 of the principal Ordinance is hereby amended—

(i) by substituting for the word "concession" occurring in paragraph (1) and where it first occurs in paragraph (4) the word "mining";

(ii) by inserting after the word "concessions" occurring in paragraph (3) the comma and words "mining leases"; and

(iii) by inserting after the word "holder" occurring in paragraph (4) the words and commas "or lease, as the case may be,".

Section 5—Amendment of Heading to Part 3 of Principal Ordinance.

The heading to Part 3 of the principal Ordinance is hereby amended by adding the words "AND LESSEES" after the word "HOLDERS".

Section 6—Amendment of Section 6 of Principal Ordinance.

Section 6 of the principal Ordinance is hereby amended by inserting after the word "holder" where it first occurs therein the words "and lessee" and where it next occurs the words "or lessee".

Section 7—Amendment of Section 7 of Principal Ordinance.

Section 7 of the principal Ordinance is hereby amended by substituting for the expression "concession land" occurring therein and in the marginal note the expression "mining land".

Section 8—Amendment of Section 8 of Principal Ordinance.

Section 8 of the principal Ordinance is hereby amended by inserting after the word "holder" the words "and lessee" and substituting for the expression "concession land" the expression "mining land".

Section 9—Amendment of Section 11(1) of Principal Ordinance.

Subsection (1) of section 11 of the principal Ordinance is hereby amended—

(i) by inserting in paragraph (d) after the word "holders" the words "and lessees"; and

(ii) by inserting immediately after paragraph (d) the following new paragraph (dd):—

"(dd) For prescribing accounts and records to be kept by concession holders and lessees;".

This printed impression has been carefully compared by me with the Bill which has passed the Legislative Assembly, and found by me to be a true and correctly printed copy of the said Bill.
