IN exercise of the powers
conferred on the Commissioner by
section 11 of the National Weekly
Lotto Act, 1961 (Act 94) these
Regulations are made this 15th day
of August, 1978.
Regulation 1—Issue of Coupons by
Director.
(1) There shall be issued by the
Director of National Lotteries
(referred to in these Regulations
as the "Director") for the purpose
of conducting National Weekly
Lotto coupons which shall be of
such form and design as the
Commissioner may approve.
(2) The coupons shall be in such
denominations as the Commissioner
may from time to time prescribe.
Regulation 2—Method of Staking.
(1) Each coupon shall consist of
four fields and each field shall
contain ninety boxes numbered
consecutively from one to ninety.
(2) A staker may select in each
field any five numbers by marking
simultaneously the three-part
coupon with a cross mark (x) in
the appropriate boxes indicating
the numbers selected by him and
such mark shall be made with only
black or dark blue ball-point pen.
(3) A staker shall indicate by a
cross mark (x) in the appropriate
column provided on the right-hand
side of each field the
corresponding number of selections
made in that field.
(4) A staker shall in each field
of the coupon select not more than
five numbers.
(5) Every staker shall identify
his coupon by writing in the space
provided on the coupon his name,
address and the registration
number of the receiver by whom the
coupon is sold.
(6) The receiver shall in the
presence of the staker detach the
original copy and the carbon of
the coupon and return the carbon
copy of the coupon to the staker
who shall keep it until the lotto
is drawn.
(7) The receiver shall arrange
serially the original copies of
all coupons received by him and
shall forward these together with
the summary sheet duly completed
by him to the head office.
Regulation 3—Acceptance of Stakes.
(1) No stakes shall be accepted
from such hour of the day as the
Director may from time to time
determine by notice in the Gazette
in respect of the different groups
of lotto offices.
(2) In the case of lotto office
situated in Accra the day shall in
every case be that fixed for the
draw under these Regulations, and
in the case of offices situated
outside Accra it shall be such day
as may be determined by the
Director.
Regulation 4—Validity of Coupons.
(1) A coupon shall not be valid: —
(a) if any unauthorised marks are
made on it;
(b) if it is disfigured, defaced,
mutilated, folded or torn in any
part;
(c) if it contains any changes,
material alterations or erasures;
(d) if the original copy and the
carbon are not delivered at the
head office or such other place as
may be authorised at the
prescribed time;
(e) if all the four fields are not
completed;
(f) if the coupon is not
genuine.
(2) Any question which arises with
respect to the validity of a
coupon under these Regulations
shall be determined by the
Director whose decision thereon
shall be final.
(3) Any stake received in respect
of a coupon which is not valid
shall be forfeited and paid into
the Consolidated Fund.
Regulation 5—The Draw.
(1) A draw shall be held every
Saturday at four o’clock in the
afternoon.
(2) The extraction of five numbers
from a machine or contrivance
containing ninety balls, each of
which bears a distinct number
running from number one to number
ninety, shall constitute a draw.
(3) Each number shall be drawn
separately and in successive order
and the machine or contrivance
shall be set in motion before the
draw.
(4) The public shall be admitted
to the premises where the draw of
a lotto is conducted as far as may
reasonably be practicable having
regard to the accommodation
available for the purpose.
Regulation 6—Prizes.
Prizes shall be of the following,
amounts—
(a) on the first number drawn,
forty times the amount of the
stake or a proportion of the
amount relative to a field of the
coupon;
(b) on two numbers drawn, two
hundred and twenty times the
amount of the stake or a
proportion of the amount relative
to a field of the coupon;
(c) on three numbers drawn, one
thousand nine hundred and twenty
times the amount of the stake or a
proportion of the amount relative
to a field of the coupon:
(d) on four numbers drawn, five
thousand times the amount of the
stake or a proportion of the
amount relative to a field of the
coupon;
(e) on five numbers drawn, forty
thousand times the amount of the
stake or a proportion of the
amount relative to a field of the
coupon.
Regulation 7—Disputes as to
Prizes.
(1) Where two or more persons
claim to be entitled to one and
the same prize, the Director shall
deposit the value of the prize in
a court of competent jurisdiction
and the amount shall be disposed
of as the court may order subject
to sub-regulation (2) of this
regulation.
(2) Where,
(a) proceedings are not commenced
by any claimant before the
expiration of one year from the
date of the deposit of the prize
money in court; or
(b) the court does not order
payment to any claimant in
proceedings commenced before the
expiration of one year from the
date of deposit,
the prize money shall be forfeited
to the Director and shall be paid
into the Consolidated Fund.
Regulation 8—Refund of Void
Stakes.
(1) Where a draw of the lotto is
declared void by the Director the
value of the stakes shall be
claimed within thirty days from
the date of the notice of the
annulment in the Gazette.
(2) No reimbursement shall be made
after the expiration of the thirty
days prescribed under
sub-regulation (1) of this
regulation and stakes which are
not claimed within that period
shall be forfeited to the
Government.
Regulation 9—Director not Liable
to Refund any Stakes not Received
at the Head Office.
The Director shall not be liable
to refund to a staker any stake
which for any cause is not
received at the head office.
Regulation 10—Duties of Receivers.
It shall be the duty of a receiver
to ensure that—
(a) both original and carbon
copies of a coupon are correctly
entered;
(b) all coupons reach the head
office at the prescribed time;
(c) summary sheets are correctly
filled in and delivered with
accompanying coupons to the head
office;
(d) eligible cross marks are made
in the numbered boxes selected by
the staker with only black or dark
blue ball-point pen
(e) the coupons do not have any
changes or alterations of any
kind;
(f) each carbon copy is a true
replica of the original coupon;
(g) each field of the coupon is
correctly completed and the number
of selections indicated in the
appropriate column;
(h) the coupons are not folded,
torn or defaced in any manner
whatsoever.
Regulation 11—Duration of Validity
of Coupons.
(1) Every receiver shall be
allocated a specified amount of
coupons and these shall be valid
for sale within a period not
exceeding two weeks.
(2) No coupon shall be valid for
sale after the expiration of the
said period of two weeks.
Regulation 12—Custody of Original
Copies and Carbon Sheets of
Coupons.
The completed original copies and
the carbon sheets of the coupons
issued for any draw of the lotto
shall be kept in a strong room,
the key to which shall be kept
under the custody of the Director.
Regulation 13—Destruction of
Original Copies and Carbon Sheets
of Coupons.
The Director shall retain in safe
custody the original copies and
carbon sheets of all coupons sold
until the expiration of two months
after the completion of a draw
when he may in agreement with the
Auditor-General cause the coupons
to be destroyed as well as the
relative carbon sheets.
Regulation 14—Winning Coupon to be
Delivered to the Director.
(1) Any person who claims to be
entitled to a prize shall present
or cause to be presented the
winning coupon to the Director at
the head office not later than
fifteen days after the completion
of the draw.
(2) The Director shall reject any
winning coupon presented to him
after expiration of the period
prescribed in sub-regulation (1)
of this regulation.
Regulation 15—Forfeiture of
Unclaimed Prizes.
(1) Any person who has presented
or caused to be presented to the
Director a winning coupon in
accordance with regulation 14 of
these Regulations shall pursue and
secure payment of his prize money
within one year after the date of
the draw.
(2) Any person who fails to secure
payment of his prize money within
one year after the date of the
draw shall forfeit his prize
money.
(3) The Director shall cause to be
paid into the Consolidated Fund
any prize money forfeited under
sub-regulation (2) of this
regulation.
Regulation 16—Offences Relating to
the Sale of Coupons.
(1) Any person who in respect of a
coupon pays a stake higher than
that prescribed on the coupon
shall be guilty of an offence and
liable on summary conviction to a
fine not exceeding fifty cedis or
to imprisonment not exceeding
three months or to both.
(2) Any receiver who accepts in
respect of a coupon a stake higher
than that prescribed relative to
that coupon shall be guilty of an
offence and liable on summary
conviction to a fine not exceeding
one hundred cedis or to
imprisonment for six months or to
both.
(3) No person shall sell or offer
for sale coupons in any place
other than that appointed for the
purpose.
(4) Any person who contravenes
sub-regulation (3) of this
regulation shall be guilty of an
offence and liable on summary
conviction to a fine not exceeding
twenty cedis.
Regulation 17—Interpretation.
In these Regulations—
“Commissioner” means Commissioner
responsible for Finance;
“coupon” means a coupon issued by
the Director under regulation 1 of
these regulations for the draw of
national weekly lotto;
“Director" means the Director of
National Lotteries;
“head office" means the central
office of the Department of
National Lotteries;
“receiver" means a person
appointed by the Director under
the National Weekly Lotto
Regulations, 1962 (L.I. 237) to
receive stakes.
