IN exercise of the powers
conferred on the Board by section
16 of the National Vocational
Training Act, 1970 (Act 351) and
with the approval of the
Commissioner responsible for
Labour, Social Welfare and
Co-operatives, these Regulations
are made this 23rd day of August,
1974.
Regulation 1—Application.
These Regulations shall apply to
all clerical and secretarial
teaching and training institutions
in Ghana offering training
programmes leading to employment.
Regulation 2—Appointment of
National Clerical Training
Council.
(1) There shall be established
for the purpose of these
Regulations a Committee of the
Board which shall be called the
National Clerical Training Council
(referred to in these Regulations
as " the Council") which shall
consist of—
(a) a chairman who shall be a
member of the National Vocational
Training Board;
(b) one member representing the
National Vocational Training
Institute;
(c) the Chief Training Officer,
Establishment Secretariat,
Training Division, or his
representative;
(d) one member representing the
Ministry of Education;
(e) one member representing the
Ghana Teaching Service;
(f) the Chief Labour Officer or
his representative;
(g) the Director, School of
Administration, Legon, or his
representative;
(h) one member representing the
Ghana Manpower Board;
(i)
one member representing the Ghana
Employers' Association;
(j) one member representing the
Trades Union Congress;
(k) the Senior Deputy Registrar of
the West African Examinations
Council or his representative;
(l) two other members with
specialized knowledge in clerical
training.
(2) The Chairman, in consultation
with the Committee, may request
the attendance of any person to
act as adviser at any meeting of
the Council and that person, while
so attending, shall have all the
powers of a member except that he
shall not vote on any question and
his presence at the meeting shall
not count towards the constitution
of a quorum.
(3) The Chairman shall have a
second or casting vote in all
cases of equal division of vote.
(4) The Chairman or, in his
absence, a member of the Council
so appointed by the Council to act
as Chairman, shall preside at
every meeting of the Council and
in the event of an equal division
of votes, shall have a second or
casting vote.
(5) The Chairman and members of
the Council shall hold office for
three years, and on the expiration
of their term of office shall be
eligible for re-appointment.
(6) The quorum at every meeting of
the Council shall be half the
number of the members of the
Council.
(7) The decisions of the Council
shall be determined by a simple
majority of members present and
voting.
(8) A member of the Council may be
paid such travelling allowance or
renumeration or both (if any) as
the Council may, with the approval
of the Board, determine in
relation to him.
(9) The Council shall as soon as
possible after every meeting
submit a copy of the minutes of
the meeting to the Board for
ratification.
(10) Subject to the provisions of
these Regulations the Council may
regulate its own procedure.
Regulation 3—Duties and Functions
of Council.
Without prejudice to the other
provisions of these Regulations
the Council shall perform the
following duties and functions:—
(a) advise the National Vocational
Training Board on matters of
policy affecting clerical and
secretarial training;
(b) study and assess any overlap
or gaps or both in clerical and
secretarial training from
information made available to it
by appropriate bodies in relation
to the requirements of employers
and recommend to the National
Vocational Training Board
appropriate action to be taken;
(c) research and recommend to the
National Vocational Training Board
national standards for employment,
namely, job definition, minimum
entrance qualifications, minimum
syllabus requirements (duration
and content), certification in
clerical, secretarial and allied
occupations and ensure that
standards recommended are
realistic in terms of both
training and employment;
(d) appoint panels of technically
competent persons to carry out
specific functions as decided by
the Council;
(e) perform such other functions
as may from time to time be
assigned to it by the Board.
Regulation 4—Registration of
Training Institutions.
(1) All institutions offering
clerical and secretarial training
programmes leading to employment
shall apply in writing to the
Ministry of Education for
registration.
(2) Every application for
registration shall include
information in respect of the
teaching staff, equipment,
curriculae, student intake and any
other information as may be
required by the Commissioner
responsible for Education.
(3) The Commissioner responsible
for Education shall on receipt of
the application appoint an
inspector to conduct an inspection
of the institution and submit a
report to him.
(4) No institution shall be
registered unless the Commissioner
responsible for Education is
satisfied that all the
requirements in sub-regulation (2)
of this regulation have been met.
(5) Any Inspector who with intent
to procure the registration of any
institution presents a false
report to the Commissioner
responsible for Education commits
an offence and shall be liable on
summary conviction to a fine not
exceeding ¢200 or to imprisonment
for a term not exceeding twelve
months or to both.
Regulation 5—Appointment of
Inspectors.
(1) The Commissioner responsible
for Education shall appoint
qualified persons to serve as
inspectors for all or any of the
purposes under these Regulations.
(2) Where the Commissioner
responsible for Education so
directs the Board shall request
the National Vocational Training
Institute to second some members
of its qualified employees to
assist the Inspectors in carrying
out their functions under these
Regulations.
Regulation 6—Powers of Inspectors.
(1) An Inspector shall at the
direction of the Commissioner
responsible for Education and at
any reasonable time enter the
premises of any institution
registered under regulation 4 of
these Regulations to carry out the
following duties:—
(a) ensure that standards set
under the provisions of these
Regulations are attained and
maintained;
(b) where such standards are not
attained, give advice as to
interpretation of syllabus; course
content and teaching methods; give
on-the-job training to teachers or
instructors and recommend suitable
formal training courses for them;
(c) require the production of any
records in respect of the teaching
staff, student intake and
equipment;
(d) examine and make extracts from
or copies of any records produced
under paragraph (c) of this
sub-regulation;
(e) advise any institution on
matters relating to clerical and
secretarial training as such
institution may request;
(f) perform such other functions
as are incidental to the exercise
of his powers or duties under
these Regulations.
(2) Every Inspector shall as soon
as he enters the premises of any
institution in pursuance of any
official duty notify the head of
the institution or his
representative of his presence.
(3) The Inspector shall, if so
required by the head of the
institution, be accompanied during
any inspection or examination by
the head of the institution his
representative.
(4) Any person who—
(a) refuses or fails to comply
with any request made by an
Inspector under these Regulations;
or
(b) hinders an Inspector in the
exercise of his powers under these
Regulations,
shall be guilty of an offence and
liable on summary conviction to a
fine not exceeding ¢200 or to
imprisonment for a term not
exceeding twelve months or to
both.
(5) Any Inspector exercising or
seeking to exercise any of the
powers specified in sub-regulation
(1) of this regulation shall, on
being required to do so, produce
written evidence of his
appointment or identification
document.
Regulation 7—Disclosure of
Information an Offence.
(1) Except for the purpose of the
performance of his duties or the
exercise of his powers under these
Regulations, any member of the
Council or any Inspector who
discloses to another person any
information relating to the
financial affairs, equipment or
working processes of any
institution that comes to his
knowledge in the course of the
performance of his duties or in
exercise of his powers under these
Regulations shall be guilty of an
offence; provided that this
regulation shall not apply to the
disclosure of information made for
the purpose of any criminal
proceedings taken by virtue of
these Regulations or for the
purposes of a report of any such
proceedings.
(2) Any person who is guilty of an
offence under sub-regulation (1)
of this regulation shall be liable
on summary conviction to a fine
not exceeding ¢200 or to
imprisonment not exceeding twelve
months or to both.
Regulation 8—Interpretation.
In these Regulations, unless the
context otherwise requires:
"Board" means the National
Vocational Training Board
constituted under section 4 of the
Vocational Training Act, 1970 (Act
351);
"Council" means the National
Clerical Training Council
established under regulation 2 of
these Regulations;
"Inspector" means an officer
appointed under regulation 4 of
these Regulations.
