IN exercise of the powers
conferred on the Board by section
16 of the National Vocational
Training Act, 1970 (Act 351) and
with the approval of the
Commissioner responsible for
Labour and Social Welfare, these
Regulations are made this 27th day
of July, 1978.
Regulation 1Application.
These Regulations shall apply to
all apprentices and employers of
apprentices registered with the
Board.
Regulation 2Appointment of
National Apprenticeship Council.
(1) There shall be established for
the purpose of these Regulations a
Committee of the Board which shall
be called the National
Apprenticeship Council and which
shall consist of:
(a) a Chairman who shall be a
member of the Board;
(b) the Controller of
Apprenticeship;
(c) one member representing the
Ghana Employers' Association;
(d) one member representing the
Ghana Trades Union Congress;
(e) one member representing the
Department of Technical Education,
Ministry of Education;
(f) one member representing the
Department of Labour, Ministry of
Labour and Social Welfare;
(g) one member representing
industry in the public sector;
(h) one member representing
industry in the private sector.
(2) The Chairman, or in his
absence, a member of the Council
so appointed by the Council to act
as Chairman shall preside at every
meeting of the Council, and where
the person so appointed by the
Council to act as Chairman so
presides, he shall, with respect
to that meeting and any business
transacted thereat, have all the
powers and be deemed to be the
Chairman of the Council.
(3) The Chairman and members of
the Council shall hold office for
such period, not exceeding three
years as shall be specified at the
time of their appointment, and on
the expiration of such period
shall be eligible for
re-appointment.
(4) The quorum at every meeting
of the Council shall be seven.
(5) The Chairman may request the
attendance of any person to act as
adviser at any meeting of the
Council and that person, while so
attending, shall have all the
powers of a member except that he
shall not vote on any question and
his presence at the meeting shall
not count towards the constitution
of a quorum.
(6) The decisions of the Council
shall be determined by a simple
majority of the members present
and voting.
(7) A member of the Council may be
paid such travelling allowance or
remuneration (if any) as the
Council, with the approval of the
Board, may determine in relation
to him.
(8) The Council shall submit
minutes of every meeting as soon
as possible after every meeting to
the Board.
(9) Subject to the provisions of
these Regulations the Council may
regulate its own procedure.
Regulation 3Appointment of
Industrial Advisory Committee.
(1) For the purpose of advising
the National Apprenticeship
Council in regard to technical
matters appertaining to
apprenticeship, there shall be
established such committees as the
Council may from time to time
determine, and these committees
shall be called Industrial
Training Advisory Committees.
(2) The Industrial Training
Advisory Committees shall each
comprise:
(a) a Chairman who shall be the
Controller of Apprenticeship;
(b) not more than eight persons
qualified by technical
qualifications or experience or
both, within the trade or trades
for which each Committee is
established; and
(c) a specialist officer of the
Ministry of Education concerned
with technical education who shall
be nominated by the Ministry of
Education.
(3) Appointments to membership of
the committees shall be made by
the Council acting on the advice
of the Controller and except in
the case of ex officio
appointments shall be for such
period not exceeding three years,
as shall be specified at the time
of such appointments, and all such
persons shall be eligible for
reappointment.
(4) A committee shall meet for the
despatch of business at such times
and places as the Chairman shall
determine.
(5) The Chairman may, and shall on
the request in writing of not less
than half of the members of a
committee call an extraordinary
meeting at such time and place as
he may determine.
(6) The Chairman, if present,
shall preside at every meeting of
a committee, and in his absence,
any member of the committee
elected by the members present
shall preside at the meeting.
(7) The quorum at every meeting of
a committee shall be not less than
one half of the total membership
of the committee.
(8) All questions proposed at a
meeting of a committee shall be
determined by a simple majority of
the members present and voting and
where the votes are equal, the
Chairman or person presiding shall
have a second or casting vote.
(9) The Chairman may, in his
discretion, request the attendance
of a specialist consultant or
consultants at a meeting of any
committee to provide such
additional technical advice or
assistance as he may consider is
required for the business of a
committee; such person while so
attending shall have all the
powers of a member except that he
shall not be allowed to vote on
any question, and his presence at
the meeting shall not count
towards the constitution of a
quorum.
(10) The validity of any act or
proceedings of a committee shall
not be affected by any vacancy
among its members or any defect
in the appointment of a member
thereof.
(11) The Council may, pay to
members of a committee and to
other persons attending meetings
of a committee such travelling and
other allowances out of the funds
of the Institute as the Council
may determine.
(12) A full report of the
proceedings of a committee shall
be made in writing by the
Controller, and after it has been
approved by the committee, shall
be submitted to the Council.
(13) Subject to the provisions of
these Regulations each committee
may regulate its own procedure.
Regulation 4Appointment of
Controller and Assistant
Controller.
(1) The Board shall appoint for
the purposes of these Regulations
a Controller of Apprenticeship and
may if it deems fit, appoint one
or more persons to be Assistant
Controllers of Apprenticeship for
the purposes of these Regulations.
(2) Every Assistant Controller of
Apprenticeship so appointed may,
subject to the directions of the
Controller, perform any act or
discharge any duty which may
lawfully be performed or is
required to be discharged by the
Controller under the provisions of
these Regulations.
Regulation 5Duties and Functions
of Council.
Without prejudice to the other
provisions of these Regulations,
the Council shall
(a) at the request of the Board,
and may on its own motion
investigate and make
recommendations to the Board on
any matters connected with these
Regulations;
(b) investigate any dispute or
other matter arising out of a
contract of apprenticeship
referred to it by the Controller
or any person aggrieved by any
decision made by the Controller
under these Regulations, and shall
endeavour to settle such dispute
amicably;
(c) determine in consultation with
the Commissioner and the Prices
and Incomes Board, the minimum
rate of remuneration payable by
the employer to an apprentice in
the different trades;
(d) determine the hours and
conditions of work, leave
entitlements, holidays and other
conditions of service of
apprentices in the different
trades;
(e) perform such duties and
functions with regard to any other
matter concerning apprenticeship
as may from time to time be
referred to it by the Board.
Regulation 6Duties and Functions
of Industrial Training Advisory
Committees.
Without prejudice to any other
function specified in these
Regulations, an Industrial
Training Advisory Committee shall
(a) investigate and make
recommendations to the Council
either at the request of the
Council or on its own motion and
any matters connected with the
trade or trades for which it is
established;
(b) perform such duties and
functions in respect of any other
matter concerning apprenticeship
as may from time to time be
referred to it by the Council.
Regulation 7Permission to Employ
Apprentices.
(1) No employer shall employ an
apprentice without having first
obtained the written permission of
the Controller to do so.
(2) The Controller's permission
shall specify the maximum number
of apprentices who may be employed
at any one time by the employer to
whom permission is given.
(3) No permission shall be granted
under this regulation unless the
employer applying for such
permission satisfies the
Controller that his establishment
offers reasonable facilities for
the proper training of the
apprentice or the number of
apprentices proposed to be trained
by him.
(4) Any employer who is aggrieved
by any decision of the Controller
under this regulation, may appeal
therefrom to the Council.
(5) Any employer who
(a) employs an apprentice without
having first obtained the written
permission of the Controller to
employ apprentices: or
(b) having obtained the written
permission of the Controller to
employ apprentices, employs at any
one time a number of apprentices
in excess of the maximum number
specified in such written
permission, shall be guilty of an
offence.
Regulation 8Who may Bind Himself
as an Apprentice.
(1) Any person who
(a) has attained the certified or
apparent age of 15 years;
(b) has completed any period of
compulsory education required by
Law;
(c) has in the case of a trade in
respect of which a regulation has
been made, the qualifications
prescribed under the regulation,
and
(d) has been certified fit as
provided for in regulation 11 of
these Regulations,
may subject to the provisions of
sub-paragraph (3) of these
regulations, bind himself as an
apprentice in any trade.
(2) No person who does not qualify
under the provisions of
sub-regulation (1) of this
regulation shall bind himself as
an apprentice in any trade.
(3) A person who is a minor shall
not bind himself as an apprentice
in any trade except with the
consent of his parent or guardian,
or, if there is no parent or
guardian with the consent of the
Controller of Apprenticeship.
(4) A minor who, with such
consent, binds himself as an
apprentice shall be bond by the
contract of apprenticeship
throughout its currency,
notwithstanding that he may have
in the meantime obtained his
majority.
Regulation 9Proof of Educational
Standards.
Where for any of the purposes
specified in these Regulations, it
is necessary for any person to
provide proof of his educational
standards, such proof may be
furnished in the form of a
certificate issued under the
authority of any school or other
educational institution approved
by the Ministry of Education and
the National Vocational Training
Institute.
Regulation 10Proof of Date of
Birth.
The age of any person who wishes
to become an apprentice under the
provisions of these Regulations,
and in respect of whom no
certificate extract of an entry in
a register of births is available,
may be inquired into and certified
by the Controller of
Apprenticeship or by any person
authorised by him, and the age of
any person so certified shall be
conclusive for the purpose of
these Regulations.
Regulation 11Medical Examination
of Apprentice.
Every person before entering into
a contract of apprenticeship shall
be medically examined at the
expense of the employer by a duly
qualified medical practitioner,
and a medical certificate to the
effect that such person is fit to
be employed in the trade concerned
shall be obtained by the employer
and submitted to the Controller in
accordance with the provisions of
Regulation 14 of these
Regulations.
Regulation 12Language of
Contracts.
Every contract or other document
which is prescribed under the
provisions of these Regulations
shall be printed or typewritten in
the English Language.
Regulation 13Regulation of
Contracts of Apprenticeship.
Every contract of apprenticeship
made after the commencement of
these Regulations, shall be in the
form set out in the First Schedule
to these Regulations.
Regulation 14Registration of
Contracts of Apprenticeship.
(1) Any employer who enters into a
contract of apprenticeship with
any person shall, within two
months thereafter, submit to the
Controller for registration
(a) the contract of apprenticeship
together with two copies thereof;
(b) the medical certificate
obtained under the provisions of
regulation 11 of these
Regulations, and
(c) two passport size photographs
of the apprentice.
(2) Any employer who fails to
comply with the provisions of
sub-regulation 1 of this
regulation shall be guilty of an
offence.
(3) Any contract of
apprenticeship, made after the
commencement of these regulations
shall not be binding unless it has
been registered by the Controller.
(4) The Controller may refuse to
register any contract of
apprenticeship, if in his opinion,
it is not in the interest of the
person who is the apprentice
thereunder.
(5) Any employer who is
dissatisfied with the refusal of
the Controller to register a
contract, may appeal to the
Council within thirty days from
the date upon which the decision
of the Controller was communicated
to him.
(6) In every case in which the
Controller registers a contract
under these Regulations he shall
(a) endorse the particulars of
registration thereon, and on one
of the copies referred to in
sub-regulation (2) of this
regulation and return the contract
and such copy to the employer, and
(b) file the other copy referred
to in sub-regulation (2) of this
regulation after having endorsed
the particulars of registration
therein.
(7) The employer shall deliver the
endorsed copy to the apprentice
for him to keep.
Regulation 15Transfer Contracts
of Apprenticeship.
(1) The rights and obligations of
an employer under any contract of
apprenticeship may, with the
consent of the apprentice reunder
and with the approval of the
Controller, be transferred to
another employer.
(2) The Controller may withhold
his approval under this regulation
if, in his opinion, the transfer
is not in the interest of the
apprentice.
(3) No transfer of the rights and
obligations of an employer under
any contract of apprenticeship
shall take effect unless
(a) the contract of apprenticeship
has been endorsed and signed by or
on behalf of the employer
transferring such rights and
obligations and the employer to
whom such rights and obligations
are being transferred, and by the
apprentice, and where such
apprentice, is a minor, has been
signed also by his parent or
guardian, and if he has no parent
or guardian, has been signed by
the Controller; and
(b) the contract has been
registered by the Controller in
the manner prescribed in
sub-regulation (4) of this
regulation.
(4) The employer to whom the
rights and obligations under a
contract of apprenticeship are
being transferred as aforesaid,
shall within one month of the date
on which the contract is signed by
him, submit such contract to the
Controller for registration and
any employer who fails to submit
such contract shall be guilty of
an offence.
Regulation 16Enticement of
Apprentices.
Any person who induces or attempts
to induce an apprentice to quit
the service of his employer, or
who employs a person whom he knows
is bound by a contract of
apprenticeship to any other person
shall be guilty of an offence and
shall be liable on summary
conviction to a fine not exceeding
’200 or to imprisonment for a term
not exceeding three months.
Regulation 17Probationary Period.
(1) The first four months of every
contract of apprenticeship shall
be a period of probation during
which the contract may be
terminated by either party.
(2) The employer shall give notice
to the Controller of the
termination of any contract under
sub-regulation (1) of this
regulation, and any employer who
fails to give such notice within a
period of one month after the date
of such termination shall be
guilty of an offence.
Regulation 18Suspension of
Apprentice.
(1) If an employer is satisfied
that an apprentice bound to him by
contract under the provisions of
these Regulations has committed a
serious breach of the terms of
such contract, he may forthwith
suspend the apprentice without pay
for any period not exceeding one
month from the date of such
suspension.
(2) Any employer who has suspended
an apprentice, shall report the
matter in writing to the
Controller within three working
days of the commencement of the
suspension period, and the
Controller shall then investigate
the matter and may confirm or set
aside the suspension of the
apprentice or vary the terms
thereof.
(3) Whether or not a complaint has
been lodged by the employer, the
Controller may order the
suspension of an apprentice
pending investigation and if he so
does he shall make a report of his
investigation to the Council.
(4) Where the Controller sets
aside the suspension of an
apprentice or varies its terms,
the employer shall pay to the
apprentice such remuneration as
may have been withheld from him
during the period of suspension.
(5) The fact of suspension shall
be endorsed by the Controller upon
the file copy of the contract of
apprenticeship.
(6) Any employer who fails to
report the suspension of an
apprentice in accordance with the
provisions of this regulation,
shall be guilty of an offence.
Regulation 19Minimum Pay Rate of
Apprentices.
Every employer shall pay to an
apprentice the minimum rate of
remuneration payable to an
apprentice in the particular trade
as determined by the Board in
consultation with the Commissioner
and the Council.
Regulation 20Annual Leave and
Travel Allowances.
Every employer shall grant the
apprentice paid annual leave,
travelling allowance, and such
other conditions of service as
determined by the Board in
consultation with the Commissioner
and the Council.
Regulation 21Employer to Pay Fees
to the Institute.
Every employer shall pay such fees
to the Institute in connection
with any course of apprenticeship
as determined by the Board in
consultation with the Commissioner
and the Council.
Regulation 22Termination of
Contracts.
(1) Subject to the Provisions of
regulation 17 of these
Regulations, any contract of
apprenticeship may be terminated
(a) by mutual agreement in writing
of the parties thereto with, in
the case of an apprentice who is a
minor, the same consent as is
requisite for binding himself as
an apprentice; or
(b) by the Controller, at the
instance of any party thereto, if
he is satisfied that it is
expedient so to do;
(c) by the Controller at the
instance of the Council.
(2) An employer shall give notice
to the Controller of the
termination of any contract under
sub-regulation (i) (a) of this
regulation and any employer who
fails to give such notice within a
period of one month after the date
of such termination shall be
guilty of an offence.
(3) An employer who terminates a
contract of apprenticeship,
outside of the period of
probation, on his own initiative,
shall be guilty of an offence.
(4) The Controller shall not
exercise the powers conferred upon
him by sub-regulation (1) (b) of
this regulation unless he has
given both parties to the contract
an opportunity to be heard by, or
make representations to him.
(5) The fact of termination shall
be endorsed by the Controller upon
the file copy of the contract of
apprenticeship.
(6) Any party dissatisfied with
the action of the Controller in
terminating a contract of
apprenticeship may appeal to the
Council within one month from the
date upon which the decision of
the Controller was communicated to
him.
(7) The decision of the Council
under sub-regulation (6) of this
regulation shall be endorsed by
the Controller upon the file copy
of the contract of apprenticeship.
(8) A contract terminated under
this regulation shall be
terminated for all purposes but
without prejudice to any right of
action which may have accrued
before the date of such
termination.
(9) An apprentice whose contract
is terminated under this
regulation, may, in the discretion
of the Controller, not be allowed
to register under another
contract.
Regulation 23Responsibility for
Training.
Every employer shall be
responsible for the training of an
apprentice to the trade standards
laid down and published by the
Board on the recommendations of
the Council.
Regulation 24Records to be Kept
by Employer.
(1) Every employer who employs an
apprentice shall keep in respect
of such apprentice an Apprentice
Training Record as prescribed by
the Board and specified in the
Second Schedule to these
Regulations.
(2) The Apprentice Training Record
shall be in addition to any other
records required to be kept by an
employer under the provisions of
section 46 of the Labour Decree,
1967 (N.L.C.D. 157).
(3) The Controller of
Apprenticeship shall supply to
each employer at the time of
registration of each contract of
apprenticeship copies of such
records in blank form for each
apprentice.
(4) Every such employer shall
thereafter maintain such records
up to date, and such records shall
at all times be available for
inspection by the Controller or
his representative.
(5) Every person who employs or
has employed an apprentice shall
retain any records in accordance
with this regulation for a period
of three years after the date of
the last entry in the record.
(6) Every employer who fails to
keep the prescribed records in the
form and manner specified, and
every employer and former employer
who fails to retain every such
record for the specified period
shall be guilty of an offence.
Regulation 25Identity Cards.
The Controller of Apprenticeship
shall supply every apprentice at
the time of registration with an
official Apprentice Identity Card
in the form set out in the Fourth
Schedule to the Regulations.
Regulation 26Imitations and
Regard of Method of Payment and
Foreign Services.
Any term in a Contract of
Apprenticeship or any condition of
an apprenticeship which provides
(a) that the whole or any part of
the wages of an apprentice shall
be based upon the quality of work
done; or
(b) for an apprentice to be
employed outside Ghana, shall be
null and void.
Regulation 27Conditions of Work.
(1) The hours of work of an
apprentice shall be determined by
the Board.
(2) An apprentice shall not be
required to work overtime except
with the approval of the
Controller, and the Controller
shall not grant such approval
unless he is satisfied that such
overtime work is in the interest
of the training of the apprentice.
(3) The provisions of the
Factories, Offices and Shops Act,
1970 (Act 328) relating to the
health and safety of workers,
shall apply to all apprentices
undergoing training in factories.
(4) The provisions of the
Factories, Offices and Shops Act,
1970 (Act 328) relating to
compensation to be paid to workers
on account of injury or death by
accident shall apply to all
apprentices.
(5) The provisions the Social
Security Decree, 1972 (N.R.C.D.
127) relating to the payment of
benefits shall apply to all
apprentices.
Regulation 28Conduct and
Discipline.
(1) Except as otherwise expressly
provided for by these Regulations,
an apprentice undergoing training
under the provisions of these
Regulations, shall be a trainee,
and not a worker, and the
provisions of any law relating to
workers shall not apply to an
apprentice.
(2) In all matters of conduct and
discipline, an apprentice shall be
governed by the internal rules and
regulations of the establishment
in which he is undergoing
training.
Regulation 29Certificate of
Completion.
(1) The employer of an apprentice
shall, within one month following
the completion of the said
apprentices contract of
apprenticeship endorse such
contract to such effect and submit
it to the Controller.
(2) On receipt of such endorsed
contract, the Controller shall
make out a certificate of
completion in such form as set out
in the Second Schedule to these
Regulations.
(3) Any employer who fails to
comply with the provisions of
sub-regulation (1) of this
Regulation shall be guilty of an
offence.
Regulation 30Penalties for Misuse
of Certificates.
Any person who
(a) makes use of any certificate
issued under the provisions of
regulation 29 of these Regulations
and to which he is not entitled
under the said provision; or
(b) being entitled to a
certificate issued under the
provisions of regulation 29 of
these Regulations parts with it to
any person for unauthorised
purpose; or
(c) alters or defaces a
certificate issued under the
provisions of regulation 29 of
these Regulations or makes any
model likeness, or facsimile of
such certificate with intent to
defraud or deceive, or
(d) fails to produce or surrender
to the Controller without good
cause any certificate issued to
him under the provisions of
regulation 29 of these Regulations
when required to do so for the
purposes of inspection;
shall be guilty of an offence and
shall be liable on summary
conviction to a fine not exceeding
’200.00 or to imprisonment not
exceeding six months or to both.
Regulation 31Miscellaneous Powers
of the Controller.
(1) The Controller may, if he
deems it expedient, order that the
term of any contract of
apprenticeship be extended by not
more than one day in respect of
every working day upon which the
apprentice, bound by such
contract, was absent from work,
and the contract period of
apprenticeship shall thereupon be
deemed to be extended accordingly.
(2) Where the Controller is
satisfied that a person has
undergone previous technical
training directly relevant to the
trade in which he desires to be
apprenticed, the Controller may
authorise the reduction of the
period of apprenticeship to be
served by such person to such
lesser period as he shall
determine.
(3) The Controller shall have all
the powers of an inspector as
provided for under regulation 34
of these Regulations.
Regulation 32Appointment of
Inspectors.
(1) There may be appointed such
persons as the Board considers
necessary to be inspectors for all
or any of the purpose of these
Regulations.
(2) Every such inspector shall be
subject to the directions and
control of the Controller in the
performance of his duties as
outlined in regulation 32 of these
Regulations.
Regulation 33Identity Cards for
Inspectors.
Every Inspector shall be furnished
with an Identity Card as specified
in the Fifth Schedule to these
Regulations and he shall produce
such Identity Card for inspection
when required to do so.
Regulation 34Powers of
Inspectors.
(1) An Inspector may
(a) at any reasonable time, enter
any premises in which he has
reasonable cause to believe that
an apprentice is or has within two
previous six months been employed
and may take with him any
interpreter or other assistant;
(b) examine, with respect to
matters relating to these
Regulations every person who he
finds on any such premises, and
may require every such person to
be so examined;
(c) require any apprentice to
appear before him at any
reasonable time and place fixed by
the inspector and then and there
to question that apprentice;
(d) require the production or
delivery of any of the records
required to be kept under the
provisions of these Regulations,
and of any document relating
thereto or relating, with respect
to matters under these
Regulations, to the business of
any person believed is or was
within the preceding six months
the employer of an apprentice;
(e) examine and make extracts from
and copies of any such documents
produced or delivered up as
aforesaid;
(f) inspect the facilities and
interview qualified personnel at
Training Centres, Institutions and
other such places.
(2) An inspector shall not enter
or inspect a private dwelling
house without the consent of the
occupier thereof.
(3) On the occasion of a visit or
inspection, an inspector shall
notify the employer or his
representative of his presence
unless he has reasonable grounds
for believing that such
notification would be prejudicial
to the performance of his duties.
(4) An inspector shall be
accompanied during any inspection
or examination by the employer or
his representative, if so required
by the employer.
(5) Any person who
(a) refuses or fails to comply
with any requirement made by an
inspector under the provisions of
this Regulation, or
(b) hinders an inspector in the
exercise of his powers under the
provisions of this Regulation,
shall be guilty of an offence and
shall be liable on summary
conviction to a fine not exceeding
’200.00 or to imprisonment not
exceeding six months or to both.
(6) Any inspector exercising or
seeking to exercise any of the
powers specified in sub-regulation
(1) of this Regulation shall, on
being required so to do, produce
his identity card as evidence of
his appointment.
Regulation 35Disclosure of
Information as an Offence.
Any member of the Council or any
member of any other body or any
officer appointed under these
Regulations who discloses to any
person, except for the purpose of
the performance of his duties in
the exercise of his powers under
these Regulations any information
relating to the financial affairs,
plant, equipment or working
processes of any person, such
information having been acquired
in the performance of his duties
or in exercise of his powers under
these Regulations, shall be guilty
of an offence. Provided that
nothing in this Regulation shall
apply to the disclosure of
information made for the purposes
of any criminal proceedings which
may be taken by virtue of these
Regulations or otherwise for the
purposes of a report of any such
proceedings.
Regulation 36Existing Contracts
of Apprenticeship.
Every contract of apprenticeship
valid in accordance with the law
in force at the commencement of
these Regulations shall be deemed
to comply with the provisions of
regulation 13 of these
Regulations.
Regulation 37Penalties.
Any person who is guilty of an
offence under these Regulations in
respect of which no penalty has
been specifically provided shall
be liable
(a) on summary conviction to a
fine not exceeding ’200 or to
imprisonment not exceeding six
months, or to both such fine and
imprisonment;
(b) in the case of a continuing
offence, to a further fine not
exceeding ’20 for each day on
which the offence continues.
Regulation 38
(1) The Controller may, with the
approval of the Council, in the
case of any particular contract,
exempt any person from any of the
provisions of these Regulations.
(2) Any such exemption may, at any
time, be withdrawn by the
Controller, with the approval of
the Council.
Regulation 39Institution of
Proceedings.
Any inspector may institute
proceedings in respect of any
offence under these Regulations.

These Regulations shall bind the
Government.
Regulation 41These Regulations a
is Additional to other Enactments.
The provisions of these
Regulations shall be in addition
to and not in derogation of, any
other enactment for the time being
in force relating to apprentices,
their employment and other matters
connected with apprenticeship.
Regulation 42Interpretation.
In these Regulations unless the
context otherwise requires
apprentice means a person who
has entered into a contract in
writing with an employer to serve
the employer for a specified
period not exceeding five years
for the purpose of learning and
being taught a trade.
Board means the National
Vocational Training Board
Constituted under Section 4 of the
National Vocational Training Act,
1970 (Act 351);
Certificate of Completion means
a Certificate of completion issued
under the provisions of Regulation
29 of these Regulations;
Contract of Apprenticeship means
a contract of apprenticeship as
specified under the provisions of
regulation 13 of these
Regulations;
Controller means the Controller
of Apprenticeship appointed under
the provisions of regulation 4 of
these Regulations;
Council means the National
Apprenticeship Council established
under the provisions of regulation
2 of these Regulations;
Industrial Training Advisory
Committee means the Industrial
Training Advisory Committee
established under the provisions
of regulation 3 of these
Regulations;
Inspector means an inspector
appointed under the provisions of
regulation 32 of these
Regulations;
Minor means a person under the
age of 21 years;
Records means the records
prescribed by the Board under the
provisions of regulation 23 of
these Regulations;
Trade means any skilled manual
occupation as may be designated
from time to time by the Board.

(ii) been examined by a duly
qualified medical Practitioner and
certified to be sufficiently fit
to perform the duties of the trade
to which he is bound without
danger to himself or other, and
(iii)attained
the educational standard required
by an appropriate Apprentice Rule
or Regulation.
NOW THIS CONTRACT WITNESSETH:
1. THAT THE APPRENTICE, of his
own free will and with the consent
of his guardian, AGREES:
(a) to bind himself as an
apprentice to the employer for
years commencing on the

first four months shall be
probationary on either side, in
order to learn the trade
of

(b) to obey all lawful and
reasonable orders of the employer
or his representatives and to
execute conscientiously all work
entrusted to him;
(c) not to disclose or communicate
to any person any information that
would be detrimental to the
business of the employer;
(d) not to damage any goods,
money, vehicles, machines, tools
or other property of the employer
placed in his custody or care, or
to misuse or waste or lend or
dispose of them to any person
without the consent of the
employer or his representative;
(e) to pursue conscientiously
related training and take any
tests which the terms of his trade
require;
(f) to possess himself of such
personal tools the terms of his
trade require.
2. THAT THE EMPLOYER AGREES:
(a) to the best of his ability to
instruct the apprentice or cause
him to be instructed in the trade
concerned for the period specified
in paragraph 1(a).
(b) to remunerate the apprentice
at not less than such minimum
rates as the National Vocational
Training Board, on the advice of
the National Apprenticeship
Council, may from time to time
determine for the trade concerned;
(c) to provide at his own expense
all tools and materials necessary
for the instruction of the
apprentice, provided that in the
case of personal tools he may
recover the cost thereof by
appropriate instalments from the
apprentice;
(d) to release the apprentice from
his work when necessary to attend
courses in connection with his
apprenticeship and to continue to
remunerate him during the period
for which he is so released, and
to pay such costs if any, in
connection with such courses as
the National Vocational Training
Board, on the advice of the
National Apprenticeship Council,
may from time to time determine;
(e) on completion of the
apprenticeship, to endorse this
contract accordingly and forward
it to the Controller of
Apprenticeship for the purpose of
issuing to the apprentice a
certificate of completion.
3. This Contract shall be subject
to the provisions of the National
Vocational Training Board
(Apprentice Training) Regulations,
1978.
