             NATIONAL VOCATIONAL TRAINING BOARD (TRADE TESTING) REGULATIONS, 1971 (LI 715).

IN exercise of the powers conferred on the Board by section 16 of the National Vocational Training Act, 1970 (Act 351) and with the approval of the Minister responsible for Labour and Co-operatives, these Regulations are made this 8th day of November, 1971.

Paragraph 1—Application.

These Regulations shall apply to all apprentices registered with the Board and all other persons who may be declared eligible by the Board under such bye-laws or other instruments as the Board may from time to time declare.

Paragraph 2—Appointment of National Trade Testing Committee.

(1) There shall be established for the purposes of these Regulations a committee of the Board which shall be called the National Trade Testing Committee which shall consist of—

(a) a Chairman who shall be a member of the Board;

(b) the Commissioner of Trade Testing;

(c) one member representing the National Apprenticeship Council;

(d) one member representing the Department of Labour, Ministry of Labour and Cooperatives;

(e) one member representing the Ghana Employers' Association;

(f) one workers representative;

(g) not more than two members representing industry in the public sector;

(h) not more than two members representing industry in the private sector.

(2) The Chairman shall preside at every meeting of the Committee or, in his absence, any member of the Committee elected by the members present shall preside.

(3) The Chairman and members of the Committee shall hold office for such period, not exceeding three years, as shall be specified at the time of their appointment, and on the expiration of such period shall be eligible for re-appointment.

(4) The quorum at every meeting of the Committee shall be half the number of the members of the Committee.

(5) The Chairman may request the attendance of any person to act as adviser at any meeting of the Committee and that person, while so attending, shall have all the powers of a member except that he shall not vote on any question and his presence at the meeting shall not count towards the constitution of a quorum.

(6) A member of the Committee may be paid such travelling allowance or remuneration (if any) as the Committee may, with the approval of the Board, determine in relation to him.

(7) The Committee shall submit minutes of every meeting as soon as possible after every meeting to the Board.

(8) Subject to the provisions of these Regulations the Committee may regulate its own procedure.

Paragraph 3—Appointment of Commissioner and Assistants.

(1) The Board shall appoint for the purposes of these Regulations a Commissioner of Trade Testing and may, if it deems fit, appoint one or more persons to be Assistant Commissioners of Trade Testing.

(2) Every Assistant Commissioner of Trade Testing so appointed may, subject to the direction of the Commissioner, perform any act or discharge any duty which may lawfully be performed or is required to be discharged by the Commissioner under the provisions of these Regulations.

Paragraph 4—Duties and Functions of Committee.

Without prejudice to the other provisions of these Regulations the Committee shall perform the following duties and functions—

(a) it shall investigate and make recommendations to the Board on any matters relating to trade testing and trade certification;

(b) it shall at the request of the Board, and may of its own motion, investigate and make recommendations to the Board on any matters connected with these Regulations.

Paragraph 5—Establishment of Trade Tests.

(1) The Board may devise such tests as it deems necessary for the purpose of determining the technical competence of persons engaged in, or seeking to be engaged in, any trade or occupation  as may be approved by the Board. Any such tests shall be in a form and subject to the conditions prescribed by the Board, with the advice of the Committee and the approval of the Minister.

(2) The Board may, in relation to the tests described in sub-paragraph (1) of this paragraph delegate the administration and execution of such tests to such competent body as the Board may, on the advice of the National Trade Testing Committee, from time to time determine. Where such delegation is exercised, the Board may, at its discretion and with due notice, extend or withdraw such delegation.

Paragraph 6—Trade Test Fees.

There shall be payable by every person who applies to undergo any trade test as may be established under paragraph 5 of these Regulations such fees as the Board may, with the advice of the Committee, prescribe.

Paragraph 7—Trade Test Certification.

(1) The Commissioner, on being satisfied that an applicant has reached the standard required to qualify in a trade test, and has paid such fees as prescribed by the Board under paragraph 6 of these Regulations, shall grant to such applicant a certificate made out in such form as the Board may, with the advice of the Committee, prescribe.

(2) Notwithstanding the provisions of sub-paragraph (1) of this paragraph all apprentices registered with the Board shall be required to undergo such trade tests and shall receive such certificates as the Board may, with the advice of the National Apprenticeship Council, prescribe.

Paragraph 8—Penalties for Misuse of Certificates.

Any person who—

(a) makes use of any certificate issued under the provisions of paragraph 7 of these Regulations to which he is not entitled under such provisions;

(b) being entitled under the provisions of paragraph 7 of these Regulations to the possession of a certificate and parts with such possession to any person for an unauthorised purpose;

(c) alters or defaces a certificate issued under the provisions of paragraph 7 of these Regulations, or makes any model, likeness or facsimile of such certificate with intent to defraud or deceive; or

(d) fails to produce or surrender without good cause any  certificate issued to him under the provisions of paragraph 7 of these Regulations to the Commissioner when required for the purposes of inspection,

shall be guilty of an offence and shall on summary conviction be liable to a fine not exceeding Ną100.00 or to imprisonment not exceeding six months or both.

Paragraph 9—Interpretation.

In these Regulations, unless the context otherwise requires—

"Apprentice" means any person registered as an apprentice under paragraph 8 of the National Vocational Training Board (Apprentice Training) Regulations, 1971.

"Board" means the National Vocational Training Board as constituted under section 4 of the National Vocational Training Act, 1970 (Act 351).

"Committee" means the National Trade Testing Committee appointed under paragraph 2 of these Regulations.

"Commissioner" means the Commissioner or Trade Testing appointed under paragraph 3 of these Regulations.

"Trade" means any skilled manual occupation as may be designated from time to time by the Board.
