IN exercise of the powers
conferred on the Secretary
responsible for the Interior by
section 38 of the Police Service
Act, 1970 (Act 350) these
Regulations are made this 30th day
of December, 1992.
PART I—LICENSING
Regulation 1—Organisations to be
Licensed.
(1) No person shall establish an
organisation to—
(a) undertake private
investigations as to facts or the
character of any person; or
(b) perform services of watching,
guarding, patrolling or carriage
for the purpose of providing
protection against crime,
unless that person has been
granted a licence for that purpose
by the Secretary.
(2) No person shall engage an
organisation specified in
sub-paragraph (1) for an
investigation or service unless
that organisation has a valid
licence issued under these
Regulations.
Regulation 2—Application for
Licence to Operate.
(1) An application for a licence
under regulation 1 shall be made
in writing to the Secretary,
accompanied by—
(a) a fee of five thousand cedis;
(b) the particulars specified in
the First Schedule to these
Regulations;
(c) two copies of the curriculum
vitae of each shareholder,
director, partner or owner; and
(d) two passport size photographs
of each shareholder, director,
partner or owner, whose name shall
be written clearly on the reverse
side of the photographs.
(2) The Secretary may, require
from the applicant—
(a) such further evidence as the
Secretary may specify concerning
the character, competence and
integrity of any director, partner
or other person responsible for
the operations of the
organisation; and
(b) such further information as
the Secretary may specify.
Regulation 3—Grant of Licence to
Operate.
The Secretary, having regard to
national security and the public
interest, may grant a licence to
the applicant upon payment by the
applicant of a licence fee of
fifty thousand cedis.
Regulation 4—Nature of Licence to
Operate.
(1) A licence under regulation 1
shall be valid for one year from
the date of issue and may be
renewed yearly at a fee of fifty
thousand cedis.
(2) A licence under regulation 1
shall specify the number of
offices, agencies, stations or
other places of business which the
organisation is permitted to
maintain within Ghana.
(3) The Secretary, may suspend or
revoke a licence, where in his
opinion the ownership or control
of, or any controlling interest in
the organisation to which the
licence relates has passed to a
person who is unsuitable to be
considered for the grant of the
licence.
Regulation 5—Employees to be
Licensed.
No organisation licensed to
operate under these Regulations
shall employ a person unless that
person is permitted by the
Secretary to be employed by the
organisation.
Regulation 6—Returns of Employees
of Licensed Organisations.
(1) An organisation licensed to
operate under regulation 1 shall
notify the Secretary in writing
within one month after employing
any person in its service, of the
name and address of the employee
and other particulars relating to
the employee that the Secretary
may direct.
(2) The organisation shall submit
to the Secretary on the 1st day of
January, and the 1st day of July
in each year a return indicating
the names and addresses of its
employees and such other
information as the Secretary may
direct.
Regulation 7—Application for
Employee's Permit.
(1) An application for a permit
under regulation 5 shall be made
in writing to the Secretary,
accompanied by—
(a) a fee of two thousand cedis;
(b) the particulars specified in
the Second Schedule to these
Regulations;
(c) two signed copies of a
reference from a member of
Parliament, senior police officer,
judge, magistrate, lawyer or
person of similar standing; and
(d) two sets of finger
impressions of the applicant.
(2) The Secretary may require
from the applicant—
(a) such further evidence as the
Secretary may specify concerning
the character, competence and
integrity of the applicant; and
(b) such further information in
clarification of the application
as the Secretary may specify.
Regulation 8—Nature and Mode of
Employee's Permit.
(1) A permit under regulation 5
shall authorise the applicant to
be employed by the organisation
specified in the permit.
(2) The permit shall specify the
kind of work which the applicant
is authorised to perform.
(3) The Secretary may suspend or
revoke a permit where in his
opinion, the person holding the
permit is unsuitable to continue
holding that permit.
Regulation 9—Passes to be Issued
to employees of Licensed
Organisations.
(1) An organisation licensed
under regulation 1 shall issue a
pass to each of its employees.
(2) The employee shall—
(a) carry the pass when on duty
on behalf of the organisation;
(b) produce the pass for
inspection upon request by a
police officer or by a member of
the Armed Forces not below the
rank of Sergeant or an equivalent
rank; and
(c) return the pass to the
organisation for cancellation when
he leaves the service of the
organisation.
Regulation 10—Effect of Expiry of
Licence or permit.
The holder of licence under
regulation 1 or 6 or a permit
under regulation 5 may, not more
than two months before the expiry
of the licence or permit apply to
the Secretary in accordance with
these Regulations for renewal of
the licence or permit.
Regulation 11—Persons not
Entitled to Licence or Permit.
(1) The following persons shall
not be granted a licence or a
permit under these Regulations—
(a) a person who has been
convicted, whether in Ghana or
elsewhere, of felony, an offence
involving fraud, dishonesty or
moral turpitude; an offence in
relation to arms or ammunition, or
an offence in relation to narcotic
drugs;
(b) a person who has been
sentenced to a period of
imprisonment (whether in Ghana or
elsewhere);
(c) a person who has been
dismissed, removed or released on
disciplinary grounds from the
Police Service, the Prisons
Service, or the Armed Forces of
Ghana; or
(d) a person in respect of whom
the Secretary is satisfied that it
is contrary to the national
interest or the interest of
national security that that person
should be granted a licence under
these Regulations.
(2) The Secretary shall revoke
the licence or permit of a person
who is—
(a) convicted of an offence
specified in paragraph (1) (a); or
(b) sentenced to any period of
imprisonment.
PART II—CONTROL AND ADMINISTRATION
Regulation 12—Uniforms to be
Approved.
(1) No employee of an organisation
licensed under regulation 1, shall
wear, carry or bear any uniform,
cap, badge, accoutrements or other
identification mark unless the
uniform, cap, badge, accoutrements
or other identification mark has
been approved for use by the
Inspector General of Police in
writing.
(2) The Inspector-General of
Police shall not approve any
article for use under this
regulation if in the
Inspector-General's opinion that
article has a resemblance to a
similar article used by the Police
Service, the Prisons Service or
the Armed Forces of Ghana.
Regulation 13—Control of Use of
Firearms.
No person licensed or granted a
permit under these Regulations
shall bear or possess any fire arm
or ammunition in the course of his
duties.
Regulation 14—Offences.
(1) Any person who—
(a) for the purpose of obtaining a
licence or a permit under these
Regulations, makes a statement or
provides information which he
knows to be false or has no reason
to believe to be true;
(b) acts as the employee of a
private security organisation when
he has no permit or the
organisation has not been licensed
under these regulations;
(c) fails to carry whilst on duty,
or to produce for inspection when
requested, in accordance with
regulation 9 a pass issued to that
person under that Regulation;
(d) wears, carries or bears an
article which that person is not
authorised to wear, carry or bear
under regulation 12;
(e) bears or possesses any
firearm or ammunition contrary to
regulation 13;
(f) without lawful excuse proof
of which shall be on him has in
his possession a pass issued under
regulation 9; or
(g) otherwise contravenes any
other provisions of these
regulations, commits an offence.
(2) A person licensed under these
Regulations who—
(a) in any manner interferes with
the lawful exercise by another
person of his right to form or
join any organisation or assists
any labour organisation to strike;
(b) corruptly seeks to obtain
information as to the activities
of any trades union;
(c) supplies or offers to supply
to another person any firearm,
ammunition, tear gas or similar
manufactured weapon; or
(d) collects or offers or attempts
to collect, or directly or
indirectly engages in the business
of collecting debts or claims of
any kind, commits an offence.
Regulation 15—Penalties.
A
person who commits an offence
under regulation 14 is liable on
conviction to a fine not exceeding
one million cedis or to
imprisonment not exceeding one
year or to both.
Regulation 16—Revocation of
Licences, Etc.
(1) The Secretary may revoke or
suspend a licence granted under
regulation 1, if—
(a) the ownership or control of,
or any controlling interest in the
organisation to which the licence
relates has passed to a person who
is unsuitable to be considered for
the grant of the licence; or
(b) the organisation to which the
licence relates, contravenes a
provision of these Regulations.
(2) An organisation licensed under
regulation 1 shall dispense with
the services of an employee in
respect of whom the Secretary
notifies the organisation in
writing that the permit of the
employee has been withdrawn.
Regulation 17—Revocation.
(1) The Police Service (Private
Security Organisations)
Regulations, 1972 (L.I. 751) are
hereby revoked.
(2) Any organisation licensed to
operate under regulation 1 of the
Police Service (Private Security
Organisations) Regulations, 1972 (L.I.
751) and whose licence was valid
immediately before the
commencement of these Regulations
shall be deemed to have been duly
licensed under regulation 1 of
these Regulations.
