PORTS (DUES AND RATES) REGULATIONS, 1984 (LI 1308).

 

IN exercise of the powers conferred on the Interim Management Committee of the Ghana Ports and Authority by section 77 of the Ghana Ports Authority Decree, 1977 (S.M.C.D. 96) and by section 6 of the Interim Management Committee (Public Boards and Corporations) Law, 1983 (P.N.D.C.L. 6) and with the prior approval of the P.N.D.C. Secretary responsible for Transport and Communications, these Regulations are made this 15th day of May, 1984.

Regulation 1—Dues, Rates, Rents and Charges Etc. to be Collected by the Authority.

(1) The Ports Authority shall, subject to the conditions and exemption set out in the First, second, Third and Fourth Schedules to these Regulations, collect and pay into the fund of the Ports Authority the dues, rates, rents, and charges fixed therein.

(2) Every foreign ship or vessel which enters a port shall pay in dollars or equivalent convertible currency to the Ports Authority the appropriate dues, rates and charges specified in the said Schedules.

(3) Every Ghanaian-owned ship or vessel which enters a port shall pay to the Ports Authority in cedis the appropriate dues, rates and charges specified in the said Schedules.

Regulation 2—Adjustment of Rents and Charges in Special Cases.

(1) The Ports Authority may, in special circumstances, adjust the dues, rates, rents and charges specified in the said Schedules to these Regulations to accord with the special nature of the actual services rendered except that no adjustment shall in any such case exceed fifty per centum of the maximum dues, rates, rents or charges so specified.

(2) Where in these Regulations no charges for any services have been prescribed the Ports Authority shall in each such  case determine the rates or amount payable.

(3) Any increases in rates for services rendered by other organisations shall have corresponding increases in the rates chargeable under these Regulations.

(4) Wharfage and port dues levied on cargo shall be based on weight or measurement of the cargo whichever is greater.

Regulation 3—Interpretation.

In these Regulations—

“Authority” means the Ghana Ports Authority established under section 2 (1) of the Ghana Ports Authority Decree, 1977 (S.M.C.D. 96).

"wharf" include a quay, pier, jetty or other landing place, or storage place.

Regulation 4—Revocation.

The Ports (Dues and Rates) Regulations, 1979 (L.I. 1192) as amended are hereby revoked.

Regulation 5—Commencement.

These Regulations shall be deemed to have come into force on the 1st day of September, 1983.

Conditions

1.  A ship entering a port otherwise than solely for the purpose of taking fresh water or ballasting and staying in a port less than six hours from the time of berthing shall pay one-half the ship’s dues otherwise payable under paragraph 1.

2.  For the purpose of calculating a ship’s dues under paragraph 1 (1) there shall not be counted any hours spent in a port on Christmas day or Good Friday, or after the ship has failed to sail due to a cause for which the ship’s master or agent is in no way responsible and the Harbour Master has certified that the delay in sailing is in the interest of the administration of the port.

3.  A rebate of the ship’s dues paid under paragraph 3 will be made on all petroleum products re-exported.

4.   The Ports Authority may waive all ship’s dues otherwise payable on a ship in distress or making use of a port as a harbour of refuge.

5.  Charges in respect of transhipment from ship to ship shall be payable by both the discharging vessel and the receiving vessel.

Exemptions

1.  The ship’s dues under paragraph 1 shall not by payable on—

(a) ships belonging to the Government or to a foreign Government unless carrying cargo or passengers for reward.

(b) ships berthed at the manganese wharf.

2.  The ship’s dues under paragraph 3 shall not be payable in respect of—

(a) personal baggage of passengers, other than motor vehicles or animals;

(b) cargo discharged from and reshipped in ships putting in from stress of weather, because of damage, or for the purpose of effecting repairs;

(c) shipped goods which have been landed in error;

(d) mails;

(e) petroleum products imported in bulk and supplied direct to ships belonging to the Government;

(f) building materials and articles certified by the Resident Engineer to be imported for use solely for harbour works at the port of entry;

(g) petroleum products originally imported in bulk, on re-export.

3.   The ship’s dues under paragraph 3 shall not be payable in respect of—

(a) passengers transhipped within a port;

(b) children under three years of age;

(c) personal baggage of passengers.

PART II

Light Dues

The rate for light dues shall be $0.11 or ¢1.00 per tonne of a vessel’s net registered tonnage.

Conditions

For every ship whether Ghanaians or foreign entering Ghana from any place outside Ghana there shall be paid by the master or agent thereof to the Ports Authority at or for the first port which the ship enters light dues at the rate specified in this Part.

 

Exemptions

The following vessels are exempted from payment of light dues—

(a) ships belonging to the Government or to a foreign Government unless carrying passengers or cargo for fare or freight;

(b)  pleasure yachts and boats of under five tonnes registered shipping tonnage;

(c)  sailing ships (not being pleasure yachts) of less than twenty tonnes;

(d) vessels when navigated wholly and bonafide in ballast (other than tugs and pleasure yachts) on which no freight is earned and without passengers;

(e)  ships putting in for bunkers, stores, water or provisions for their own use on board;

(f)  Ghanaians fishing vessels licensed locally for the time being employed in sea fishing or sea fishing service exclusive of vessels used for catching fish otherwise than for profit;

(g) ships putting in from stress of weather, or for the purpose of repairing or because of damage provided they do not discharge or load cargo other than cargo discharged with a view to such repairs and afterwards reshipped;

(h)  vessels putting in for medical assistance;

(i)  sailing yachts of above five tonnes registered shipping tonnage which enter Ghana waters solely for yacht racing and leaving Ghana waters solely in connection with such object.

 

SECOND SCHEDULE

PILOTAGE DUES

 

1.  On every ship not failing within paragraph 2 entering or leaving port, pilotage dues shall be as follows:—

(b) For the service of moving a ship from wharf to the next wharf  berth, in either direction, or from a buoy berth to the adjacent  buoy berth:—                                   

(i) if commenced between 6.00 a.m. and 6.00 p.m. on an ordinary working day per tonne of a vessel’s net registered tonnage   0.01    0.20   

(ii)  if commenced between 6.00 p.m. and 6.00 a.m. or on a Saturday or Sunday or Public Holiday per tonne of a vessel’s net registered tonnage           0.02    0.32   

(c)  For the service of moving a ship from a berth to another berth not covered by paragraph (b)—                         

(i)  if commenced between 6.00 a.m. and 6.00 p.m. on an ordinary working day, per tonne of a vessel’s net registered tonnage   0.03    0.40   

(ii)  if commenced between 6.00 p.m. and 6.00 a.m. or on a Saturday or Sunday or Public Holiday, per tonne of a vessel’s not registered tonnage           0.04    0.60   

2.  For pilotage beyond port limits or other special services for which no specific rate is prescribed in this Schedule the pilotage dues shall be such as the Ports Authority may determine in each case.

Conditions

1.  Berthing or unberthing or moving from one berth to another shall commence at the time when the pilot takes charge of the ship for the purpose of carrying out such berthing, unberthing or moving.

2.  The dues under sub-paragraphs (b) and (c) of paragraph 1 for moving a ship from one berth to another are payable where the movement is made at the request of the Master of the ship or in pursuance of a direction given by the Harbour Master because the ship is in breach of some regulation made by the Ports Authority relating to the port.

3.   When a pilot boards a ship at the requested time and the ship is not ready to move or sail or if the move is cancelled between 6.00 a.m. and 6.00 p.m. additional dues of $11.50 or ¢180.00 per half-hour shall be charged.  Where the move is cancelled between 6.00 p.m. and 6.00 a.m. or on a Saturday or Sunday or Public Holiday the additional dues shall be $22.90 or ¢360.00 per half-hour.  In either case the minimum charge shall be as for one hour.

4. An extra charge of $19.09 or ¢300.00 shall be raised against the Tema Shipyard and Drydock Corporation for each vessel piloted into the Tema Drydock.

Exemptions

Pilotage dues shall not be payable:—

(a) on ships belonging to the Government or a foreign Government unless carrying cargo or passenger for reward;

(b) by ships putting in from stress of weather, or for the purpose of repairing or because of damage provided they do not discharge or load other than cargo discharged with a view to such repair and afterwards re-shipped;

(c) by pleasure yachts and boats of under five tonnes registered shipping tonnage.

 

THIRD SCHEDULE

PART 1

WHARFAGE AND OTHER RATES

Charges shall be levied on all goods landed or discharged on or over the wharves, or into lighters, or into the water, or loaded or delivered from any wharf, or lighter or from the water, from or to any vessel or from ship to ship within the harbour area on the agent of the vessel on behalf of the owners of the goods as follows;

Conditions

For cement clinker landed by lighter at Takoradi a special rate of $0.06 or ¢0.66 per tonne is payable.

For the avoidance of doubt charges in respect of transhipment from ship to ship shall be payable by both the discharging vessels and the receiving vessel.

Exemptions

Wharfage rates shall not be payable in respect of:—

(a) Goods shipped which have landed in error; cargo discharged from and reshipped in ships putting in from stress of weather, because of damage or for purpose of affecting repairs, bunker coal, stores or provisions for use of the ship putting in for them.

 

(b)  Mails;

(c)  Building materials and articles certified by Resident Engineer to be imported for use solely for harbour works at the port of entry.

A rebate of wharfage charges paid on importation will be made on all bulk petroleum products re-exported.  Transhipment charges in respect of unpacked Tuna fish shall be levied only once.

 

PART II

RENT AND REMOVAL CHARGES

Conditions

(1) In calculating—

(a) any free period laid down in this Part the day when the goods are landed, stored or deposited shall be included as a whole day and Saturday or Sunday or Public Holiday shall also be included, unless the period is stated as a period of working day; and

 

(b) any other period so laid down, Saturdays or Sundays and Public Holidays shall be included.

Where goods are removed before the end of the period so laid down, the charges will be payable as for the whole period.

(2) Sub-paragraphs (a) and (b) of paragraph 1 apply only to logs and curls conforming to a specification of goods of merchantable quality as prescribed under the Trees and Timber (Control of Export of Logs) Regulations, 1961 (L.I. 130).

(2) The owner of any log or curl which does not conform to this specification shall, after the expiration of seven days from the date of entry, be charged for each tonne of such log or curl ¢30.00 per week and in addition, for each of the following services:—

(a) cranage in  respect of unloading from a vehicle;

(b) cranage in respect of re-loading to a vehicle; and

(c) removal to any part of a port appointed by the Ports Authority ¢30.00 per tonne or part thereof the log or curl.

(4) The charges specified for logs and curls shall be payable by the Lighterage Company or the contracting agents on behalf of the owner of the logs or curls on the tonnage show on the ship’s manifest.

(5) Rent charges on rejected logs shall be payable by the contracting agents on behalf of the owner.

 

FOURTH SCHEDULE

PART I

MOORING AND BERTHING CHARGES

(1)  For the mooring and berthing of every ship over ten tonnes net registered tonnage other than craft engaged exclusively within a port—                                   

(i) if commenced between 6.00 a.m. and 6.00 p.m. on an ordinary working day, per tonne of vessel’s net registered tonnage   0.01    0.08   

(ii) if commenced between 6.00 p.m. and 6.00 a.m. or on a Saturday or Sunday or Public Holiday  0.01            0.14   

(2) For the use of coir springs and wire hawsers provided by the Ports Authority for every spring or hawser, per day or part of a day of twenty-four hours          3.82    40.00 

(3) For the use of chains cables, buoys, shackles, rings, hooks, sinkers and other items of mooring equipment, a charge equal to fifteen per centum of the agreed replacement value of the equipment so hired shall be charged per month.                                   

Conditions

(1) The services rendered under paragraph 1 shall include attendance to ropes and the supply of necessary boats and crew for the purpose of mooring and berthing.

(2) The mooring; and berthing charges shall be payable whether a ship is berthed alongside or at the buoys or mooring, it shall be paid for each movement, i.e. mooring, unmooring or shifting.  The minimum charge for each movement shall be ¢200.00 or $28.00.

(3) The letting on hire of the equipment referred to in paragraph 3 shall be at the absolute discretion of the Ports Authority who may impose a condition of insurance for any specific tank in connection with which the equipment is to be used.  Where the equipment is used outside a port, the charges payable under paragraph 3 shall be subject to a surcharge of fifty per centum.

Exemptions

The mooring and berthing charges shall not be made in the case of ships belonging to the Government or to a foreign Government unless carrying cargo or passengers for reward.

PART II

CHARGES FOR TUGS AND OTHER CRAFTS

(4) A charge under paragraph 1 for moving a ship from one berth to another is payable where the movement is made at the request of the Master of the ship or in pursuance of a direction given by the Harbour Master because the ship is in breach of some regulation made by the Ports Authority relating to the Port.

Exemption

A charge under paragraph 1 shall not be payable in respect of ships belonging to the Government or to a foreign Government unless carrying cargo passengers for reward.

PART III

CHARGES FOR UNDERWATER SERVICES

Conditions

1. The charge for the use of a graving dock shall commence from the time when the dock gate is closed after the vessel has been placed in the dock and shall cease when the dock gate is opened to allow the vessel to leave after completion of the work carried out on it.  For the purpose of calculating the charge a day means a period of twenty-four hours.

2. The charge for docking and undocking shall be divided equally where two vessels dock at the same flooding and subsequently undock at the same flooding.

3. Where three or more vessels dock at the same flooding and subsequently undock at the same flooding the pumping charge shall be doubled and divided equally between the vessels.

4. When a vessel is floated to allow another vessel to enter or leave the dock the pumping charge shall be made against the vessel entering or leaving and the vessel remaining in the dock shall not be charged under sub-paragraph (a) and shall be allowed a free period of twelve hours for loss of time.

5. If two or more vessels are in dock when the dock is flooded or partially flooded for benefit of another ship, the other ship shall pay the additional pumping charge of $26.73 or ¢315.00 and one day’s charge in addition.  A free period of twenty-four hours for loss of time shall be allowed and this shall be divided equally between the vessels floated.

6. If the Ports Authority consider it necessary to order any vessel temporarily to undock, no pumping charge shall be made for the undocking and re-docking of that vessel and that vessel and the vessel shall be allowed a free period of time equal to the total time lost by the vessel in consequences of the operation.

7. The slipway charges shall commences form the time the vessel has been hauled on to the slipway and cease when the vessel leaves the slipway.  For the purpose of calculating the charges a day means a period of twenty-fours hours.

8.  The hauling and launching charges shall be payable whether the vessel is hauled or launched (as the case may be) on the same tide or otherwise.

9.  Where a vessel is floated and later hauled to allow another vessel to slip or unslip no charge shall be made against the vessel so floated and the vessel shall be allowed a freeperiod twelve hours for loss of time.

10.  If the Ports Authority consider it necessary to order a vessel temporarily to vacate a slipway, no extra hauling or launching charges shall be made against the vessel and the vessel shall be allowed a free period of time to the total time lost by the vessel in consequences of the operation.

PART VII

CHARGES FOR MOORING OF SMALL CRAFT

(2) The number of pumps required for standing by or for fire attendance services shall be determined by the Fire Superintendent.

(3) Where a fire-boat, trailer-pump or self-propelled pump is used outside a port the rates payable shall be double the rates prescribed in paragraphs 1 and 2.

(4) When foam is used in connection with fire-fighting the cost of the foam used shall be charged in addition to the prescribed charges.

(5)  Pumps may be hired for pumping services other than fire-fighting services by arrangement with the Port Manager at the same charge as for the fire-fighting services.

(6)  The Ports Authority may waive in whole or in part the charge for an ambulance on the grounds of hardship.

PART IX

CHARGES FOR SUPPLY OF DRINKING WATER

FERRY TOLLS REGULATIONS, 1984 (LI 1303).

IN exercise of the powers conferred on the Secretary responsible for Roads and Highways by section 2 of the Tolls Decree, 1973 (N.R.C.D.153) and with the approval of the Provisional National Defence Council these Regulations are made this 22nd day of October, 1984.

Regulation 1—First Class Ferries.

The following ferries are hereby declared to be First Class Ferries:—
