IN pursuance of the Provisional
National Defence Council
(Establishment) Proclamation,
1981, this Law is hereby made:
Section 1—Disapplication of SMCD 8
to Prisons Service.
On the coming into force of this
Law, the provisions of the
Pensions and Social Security
(Amendment) Decree, 1975 (SMCD 8),
other than those provisions
relating to the Pensions Ordinance
(Cap 30), shall cease to be
applicable to the members of the
Prisons Service and any member of
the Prisons Service who before the
commencement of this Law is
required by virtue of the Pensions
and Social Security (Amendment)
Decree, 1975 (SMCD 8) to
contribute towards his pension or
to the social security fund as a
member of that fund shall, on the
coming into force of this Law,
cease to make such contribution
towards his pension or to the
social security fund.
Section 2—Refund of Accumulated
Contributions.
(1) Subject to subsection (2) of
this section, all amounts paid by
or on behalf of any member of the
Prisons Service as contributions
towards that member's pension or
social security fund before the
commencement of this Law shall be
refunded to him—
(a) when he retires from the
Prisons Service on attaining the
retirement age prescribed under
the Prisons Service Decree, 1972 (NRCD
46);
(b) where he resigns or is
dismissed from the Prisons
Service, upon attaining the age of
superannuation in accordance with
the provisions of the Social
Security Decree, 1972 (NRCD 127).
(2) Any amount payable to any
member of the Prisons Service
under subsection (1) of this
section shall be paid to his
estate if that member dies before
he is due to retire from the
Prisons Service or his retiring
awards are paid to him or before
attaining the age of
superannuation.
Section 3—Prisons Service Members
Eligible for Pension.
Subject to section 1 of this Law,
any member of the Prisons Service
shall on the commencement of this
Law be eligible for pension, and
any enactment relating to pensions
for the time being in force shall
apply to him.
Section 4—Pensionable Service to
Include Period of Contributing to
Social Security Fund.
Any period of service in the
Prisons Service in respect of
which any member of the Service
has contributed to the social
security fund by virtue of section
1 of the Pensions and Social
Security (Amendment) Decree, 1975
(SMCD 8) shall, for the purposes
of computing his pension, be
deemed to be pensionable service.
Section 5—Commencement.
This Law shall be deemed to have
come into force on the 1st day of
August, 1986.
