                     SUPREME MILITARY COUNCIL DECREE

PROHIBITED ORGANISATIONS DECREE, 1976 (SMCD 20)

 

ARRANGEMENT OF SECTIONS

Section

BE IT ENACTED by the Supreme Military Council as follows:—

Section 1—Prohibition of the Togoland Liberation Movement Etc.

(1) The following organisations are hereby declared unlawful and prohibited, namely,

(a) the organisation known variously as the Togoland Liberation Movement, T.L.M., TOLIMO, the National Liberation Movement of Western Togoland and N.L.M.W.T.; and

(b) any other organisation howsoever called, whose objects include advocating and promoting the succession from Ghana of the former British mandated territory of Togoland or part thereof or the integration of the said territory with any foreign territory.

 

(2) Without prejudice to the generality of paragraph (b) of subsection (1) of this section, the Chairman of the Supreme Military Council may, by executive instrument declare any organisation to be an organisation to which that paragraph applies and any organisation so declared shall be conclusively presumed at all times and for all purposes to be an organisation to which that paragraph applies.

Section 2—Offence and Penalty.

(1) On and after the commencement of this Decree, it shall be an offence for any person, in relation to any organisation referred to in section 1 of this Decree,

(a) to summon any person to a meeting of the organisation;

(b) to attend or cause any person to attend any meeting of the organisation;

(c) to publish any notice or advertisement relating to any meeting of the organisation;

(d) to prepare or participate in any procession or propaganda, campaign of the organisation;

(e) to use any slogan or label of the organisation;

(f) to invite persons to support the organisation;

(g) to grant a loan to, or make any contribution to, funds held or to be held by or for the benefit of, the organisation or accept any such loan or contribution;

(h) to give any guarantee in respect of such loan or funds as aforesaid; or

(i) to be a member of such organisation.

(2) Any person who contravenes any of the provisions of subsection (1) of this section shall be guilty of an offence and shall be liable on conviction to a fine not exceeding five thousand cedis or to imprisonment for a term not exceeding five years or to both.

Section 3—Ghanaian Citizens to be Punished wherever Act Committed.

A citizen of Ghana may be tried and punished for an offence under section 2 of this Decree notwithstanding that any act in  respect of which he is charged was committed wholly or partly outside Ghana.

Section 4—Repeal.

The National liberation Movement of Togoland (Proscription) Decree, 1976 (S.M.C.D. 18) is hereby repealed.

Section 5—Commencement.

This Decree shall be deemed to have come into force on the 3rd day of March, 1976.
