ARRANGEMENT OF REGULATIONS

Regulation

IN exercise of the powers conferred on the Electoral Commission by Article 51 of the Constitution this Instrument is made this 11th day November, 1993.

Regulation 1—Local Government Electoral Area.

The electoral areas specified in the third column of the First Schedule to each instrument establishing a District Assembly shall be the local government electoral area for the purpose of District Assembly elections.

Regulation 2—Each Electoral Area to have One Member.

Each electoral area shall be represented by one member in a District Assembly.

Regulation 3—Agents of Candidate.

(1) For the purpose of local government election a candidate may appoint one agent to attend at each polling station to witness the poll and the counting of votes.

(2) Each candidate may appoint not more than two agents to attend at the electoral area centre for purposes of collating the votes from the polling stations.

Regulation 4—Submission of Members’ Names to the Secretary of the Assembly.

After a member of a District Assembly has been elected, the Commission shall inform the Secretary of the Assembly concerned, the name of the candidate elected.

Regulation 5—Application of L.I. 1537.

(1) Except as otherwise provided in this Instrument, and subject to any other enactment on District Assembly elections, the provisions of the Public Elections (Parliamentary) Regulations, 1992 (L.I. 1537) shall apply to local government elections with such modifications as may be necessary.

(2) The Forms and Notices provided in the Schedule to L.I. 1537 shall be adapted in such manner as the Commission shall provide for the purposes of District Assembly elections.

Regulation 6—Revocation.

The District Assembly Elections Regulations, 1988 (L.I. 1936) are revoked by these regulations.

Regulation 7—Interpretation.

In this Instrument unless the context otherwise requires—

“Commission” means the Electoral Commission established by the Electoral Commission Act, 1993 (Act 451);

“District Assembly” includes a Municipal or Metropolitan Assembly.
