IN exercise of the powers conferred on the Electoral Commission by Article 51 of the Constitution this Instrument is made this 6th day of January, 1995.

Regulation 1—Units for Elections.

The units specified in the third column of the First Schedule to each legislative instrument establishing a District Assembly shall be the local government units for the purpose of elections to the Unit Committees for the district concerned.

Regulation 2—Election of Unit Committees.

There shall be elected from each unit ten persons who shall be members of the Unit Committee in accordance with regulation 24 (1) (a) of the Local Government (Urban, Zonal and Unit Committees) (Establishment) Instrument, 1994 (L.I. 1589).

Regulation 3—Qualification of Candidate to Unit Committees.

A candidate for election to a Unit Committee—

(a) shall be a registered voter;

(b) shall be resident in the unit;

(c) must have discharged all his tax and rate liabilities or made arrangements satisfactory to the appropriate authority for the discharge of those taxes and rates; and

(d) shall not be a person who has been convicted of any offence involving fraud or dishonesty.

Regulation 4—Nomination of Candidates for Unit Committee Election.

(1) Each candidate for election to a Unit Committee shall be nominated on a nomination form provided by the Commission and the form shall be delivered by the candidate or his proposer to the district representative of the Commission on a date and time directed by the Commission.

(2) The nomination paper shall be witnessed by the signature or mark of two registered voters as proposer and seconder and supported by one other registered voter, all of whom shall be resident in the unit.

Regulation 5—Qualification to Vote.

Every Ghanaian of eighteen years and above and of sound mind resident in a unit area shall be entitled to vote in the unit.

Regulation 6—Mode of Election.

(1) Unit Committee elections shall be by show of hands.

(2) Voting shall take place in all units on a day and at a place and time specified by the Electoral Commission.

Regulation 7—Declaration of Election Results.

The first ten candidates who obtain the highest number of votes cast shall be declared elected to the Unit Committee.

Regulation 8—Elected Candidates.

The Commission shall communicate the names of persons elected to the secretary of the District Assembly concerned.

Regulation 9—Interpretation.

In this Instrument unless the context otherwise requires—

"Commission" means the Electoral Commission established by the Electoral Commission Act, 1993 (Act 451).

Regulation 10—Revocation.

The Public Elections (Unit Committee) Regulations, 1994 (C.I. 8) are hereby revoked.
