PUBLIC SERVANTS (HOUSING LOANS SCHEME) REGULATIONS, 1975 (LI 1020).  

 

IN exercise of the powers conferred on the Commissioner responsible for Housing by section 25 of the Public Servants (Housing Loans Scheme) Decree, 1975 (N.R.C.D. 319) and on the recommendations of the Public Servant’s Housing Loans Scheme Board these Regulations are made this 12th day of June, 1975.

Regulation 1—Application for a Loan Under the Decree.

(1) All applications for a loan under the Public Servants (Housing Loans Scheme) Decree, 1975 (N.R.C.D. 319) in these Regulations referred to as “ the Decree”, shall be made to the Board through the Head of Department or other similar authority in the form set out in the Schedule to these Regulations.

(2) The application  form shall be submitted in duplicate with one copy each of the following documents attached in respect of the property in question:—

(a) Site plan;

(b) building plan;

(c) title deeds;

(d) building permit;

(e) development permit.

(3) All applications for a loan shall be treated as confidential.

Regulation 2—Name and Address of Contractor.

Where the construction of the residential property is to be undertaken by a contractor the applicant shall furnish the Board with the name, address and registered number of the contractor, as well as a copy of the draft building agreement between the contractor and himself to be entered into by them.

Regulation 3—Valuation.

(1) The Board shall in all cases arrange to have a valuation made of property in question by a valuer approved by the Board and a report submitted thereon to the Board.

(2) The valuation report shall contain among other things—

(a) in the case of the building of a new house the provisional estimates of the amount of money required to complete the construction in accordance with any plan which the Board approves;

(b) the estimated open market value of the residential property on completion or in the case of an existing property as it exists;

(c) a recommendation on the insurance value of the property as to exists or on completion;

(d) any other matter which in the opinion of the valuer is relevant to the consideration of the application by the Board.

Regulation 4—Loans for Extension of Existing House.

Where a public servant desires to obtain a loan to effect extensions to an existing residential property the following conditions shall apply:—

(a) an application shall be made in duplicate to the Board in the form set out in the Schedule to these Regulations and shall, except where the Board otherwise directs, be accompanied by one copy each of the documents referred to in regulation 1 (2) of these Regulations;

(b) the application shall be considered on its merits, taking into consideration all factors normally considered in an application for the construction of a new house;

(c) if the applicant has already been granted a loan under the Scheme, the additional loan shall be added to any unpaid amount outstanding in his name;

(d) the plan of the  proposed extensions and the estimated cost shall be submitted with the application to the Board;

(e) the Board shall, without prejudice to the generality of regulation 3 cause the extensions to be valued under that regulation;

(f) repayment of the loan and interest thereon shall be as provided in subsections (1), (2), (3), (4) and (7) of section 15 of the Decree;

(g) the period of repayment of the loan and interest shall not exceed thirty years calculated from the date of the grant (if any) of the first loan by the Board to the applicant;

(h) the borrower shall, where the loan is additional to an earlier one,

(i) continue the repayment of the original loan as before,

(ii) commence repayment of the principal of new loan on the date of salary payment nine months from the date of first drawing on the loan or two months from the completion of the extensions, whichever is the earlier, and

(iii) pay interest on any part of the new loan released for the purpose of the extensions from the day of such release at such times and in such instalments and in such manner as the Board may determine,

(iv) where the loan is the borrower’s first application for a loan the Board repayment of the loan and interest thereon shall be in accordance with sub-paragraphs (ii) and (iii) of paragraph (h) of this regulation.

Regulation 5—Loans for Paying Off Existing Loans in Respect of Property Already Acquired.

(1) A public servant who already obtained a loan from any bank or any other institution to build or acquire a residential property for his use any part of which is still outstanding, may apply to the Board on the form provided in the Schedule to these Regulations if he desires that the loan be paid  off under the Scheme.

(2) The application shall be submitted in duplicate to the Board together with, except where the Board otherwise directs, one copy each of the documents specified in regulation 1 (2) of these Regulations.

(3) There shall also be submitted to the Board an up-to-date statement of  the loan account from the bank or institution concerned.

(4) The application shall be considered on its merits by the Board taking into consideration all factors normally considered in an application for construction of new residential property.

(5) Where an application made under this regulation is granted by the Board, the Board shall arrange for the paying off of loan to the bank or institution concerned.

(6) The Board shall arrange for  all title deeds and similar documents deposited with the creditors and relevant to the property to which the loan relates to be transferred to the Board and may demand further security where it is thought necessary.

(7) Repayment of a loan granted under this regulation and interest thereon shall be as provided under section 15 of the Decree as the case may be.

Regulation 6—Notification of Change of Address.

A borrower who changes his address shall furnish the Board with his new address within thirty days after the change.

Regulation 7—Notification of Dismissal, Transfer, Death Etc.

(1) The borrower shall notify the Board of his dismissal, removal, transfer or resignation from the public service within thirty days after the occurrence of such event.

(2) The Head of Department or other similar authority of the borrower shall notify the Board of the dismissal, removal, transfer, resignation or death of the borrower within thirty days after occurrence of such event.

(3) Within thirty days after any of the events referred to in sub-regulation (2) of this regulation has come to his notice the Controller and Accountant-General or other person responsible for making deductions from the borrower’s salary towards repayment of the loan shall notify the Board of such event.

Regulation 8—Deductions Made by Person Other than Accountant-General to be Paid to Board within 21 Days.

Where deductions from the salary of a borrower is made by a person other than the Accountant-General, the amount deducted shall be paid to the Board within 21 days after such deduction.

Regulation 9—Borrower’s Record.

The Board shall maintain in respect of each borrower a record of all sums paid to or received from the borrower.

Regulation 10—Borrower’s Annual Statement of Account.

The Board shall, at the end of each financial year furnish the borrower with a statement of account in respect of the preceding year.

Regulation 11—Ancillary Costs to be Borne by Borrower.

The borrower shall pay to the Board all ancillary costs incurred by the Board and incidental to the grant of the loan.

Regulation 12—Interpretation.

In these Regulations “valuer” includes a quantity surveyor.
