IN exercise of the powers
conferred on the Minister by
section 35 of the Rent Act, 1963
(Act 220), these Regulations are
made this 3rd day of September,
1964.
PART I—APPLICATION TO RENT OFFICER
Regulation 1—Form of Application
for Assessment of Rent, Etc.
(1) Every application to the
appropriate Rent Officer for the
assessment or re-assessment of the
recoverable rent by him of any
premises shall be as in Form 1 of
the First Schedule; and may be
secured free of cost from such
officer or any person authorised
in that behalf by him at his
office.
(2) Each such application shall be
signed by the applicant or his
agent:
Provided that where the
application is on behalf of more
than one person—
(a) if such application is on
behalf of a partnership or of
joint owners or trustees, the
application may be signed by one
of the partners, joint owners or
trustees, as the case may be; and
(b) if such application is on
behalf of a body corporate or
society, the application may be
signed by the Manager or Secretary
of such body or society.
(3) Each such application shall be
delivered in triplicate to the
appropriate Rent Officer or any
person authorised in that behalf
by him at his office.
Regulation 2—Copies of
Applications to be Served on Other
Parties.
Where a person has delivered an
application for the assessment or
re-assessment of the rent of
premises to the appropriate Rent
Officer, he shall deliver copies
of such application to any other
person interested in such
premises, that is to say, to the
landlord, tenant or any other
person interested in such
premises.
Regulation 3—Affidavit or
Affirmation of Proof of Service on
Other Parties.
Where a person has delivered an
application for the assessment of
rent of premises to the
appropriate Rent Officer, he shall
also furnish him an affidavit or
affirmation as in Form 2 of the
First Schedule hereto.
Regulation 4—Notices of Hearing to
be Served by Rent Officer.
Where the appropriate Rent Officer
is required to assess or re-assess
the recoverable rent of any
premises he shall serve notices of
hearing as in Form 3 of the First
Schedule hereto to the persons
mentioned in regulation 2.
Regulation 5—Place of Hearing by
Rent Officer.
The investigation by the
appropriate Rent Officer in
respect of any matter for the
purposes of this Act or the
regulations thereunder shall be
made at the office of such officer
or at any other place specified in
that behalf by such officer.
Regulation 6—Interest to Debar
Rent Officer from Participating in
Proceedings.
No appropriate Rent Officer shall
hear or determine an application
in respect of premises in which he
is financially interested.
Regulation 7—Application by an
Interested Party.
Subject to the other provisions of
these regulations, an application
by any person interested in the
premises for an assessment or
re-assessment of the recoverable
rent of such premises by the
appropriate Rent Officer shall be
as in Form 4 of the First Schedule
hereto.
Regulation 8—Application for
Re-Assessment of Rent Resulting
from Alteration of Rates, Etc.
Every application to the
appropriate Rent Officer for the
re-assessment of the recoverable
rent, by reason of an alteration
in the rates or for the
apportionment of rates
attributable to parts of premises,
shall be as in Form l of the First
Schedule hereto.
Regulation 9—Form of Certificate
of Rent Officer.
The certificate of the appropriate
Rent Officer determining the
assessment of rent or the
apportionment of rates shall be as
in Form 5 of the First Schedule
hereto.
Regulation 10—Rent Officer to
Furnish his Certificate to
Parties, Etc.
(1) Every appropriate Rent Officer
shall, at the request of any party
to proceedings before him, furnish
such party with a copy of the
certificate referred to in
regulation 9 in respect of such
proceedings.
(2) No party shall be entitled as
of right at any time or for any
purpose to the inspection of, or
to a copy of, the record of
evidence given in any proceedings
before the appropriate Rent
Officer or to a copy of such
officer's notes.
(3) In an area where there is no
appropriate Rent Officer stationed
or no office for him, any such
certificate relating to premises
in such area may be deposited with
the Clerk to the Council for such
area for reference by persons in
the area.
Regulation 11—Order of Rent
Officer.
Every order of the appropriate
Rent Officer shall be noted in the
record of the proceedings at the
time when the order is made.
Regulation 12—Form of Declaration
of Rent Notice.
Every notice by the appropriate
Rent Officer to a landlord to
declare the rents payable by his
tenants shall be as in Form 6 of
the First Schedule hereto.
Regulation 13—Measures Against
Absconding Tenants.
(1) Every complaint under section
5 (1) (b) of the Act to a Rent
Officer shall be as in Form 7 of
the First Schedule hereto; every
reference of a complaint by a Rent
Officer to a Rent Magistrate shall
be as in Form 9 of that Schedule.
(2) The appropriate Rent Officer
shall endeavour as far as may be
possible to reconcile the parties
to the complaint and shall, for
that purpose, have the power to
receive sums as rent on behalf of
the landlord.
(3) Where a complaint referred to
in paragraph (1) involves the
matter of the absconding of a
tenant, such complaint shall be
supported by an affidavit or
affirmation made by the
complainant testifying to the
facts of that matter.
(4) If the appropriate Rent
Officer is satisfied, after such
investigation as he may think fit,
that there is prima facie evidence
that the tenant of any premises in
an area for which he has been
appointed has absconded from such
premises, he shall post a notice,
as in Form 8 of the First Schedule
hereto, at the entrance of the
premises, declaring his intention
to apply to the appropriate Rent
Magistrate for the right to force
open the doors thereof and search
therein.
(5) If the tenant of any premises
referred to in paragraph (4) fails
to appear before or communicate
with, the appropriate Rent
Officer, within fourteen days of
the posting of the notice
mentioned therein on such
premises, such officer shall make
an application as in Form 9 of the
First Schedule hereto to the
appropriate Rent Magistrate for an
order as in Form 10 of that
Schedule hereto, enabling him to
force open the doors of, and
search, such premises and to hand
over any articles found therein to
the landlord of such premises for
safe custody.
(6) If, after a period of fourteen
days from the date of the search
of the premises by the appropriate
Rent Officer under the authority
of the order referred to in
paragraph (5), the tenant of such
premises fails to appear before,
or communicate with, such officer,
he shall apply to the appropriate
Rent Magistrate for an order
providing for the manner of
disposal of articles found therein
and the Magistrate shall make such
order in that behalf as he may
think fit and equitable.
PART II—APPEALS TO RENT MAGISTRATE
Regulation 14—Forms to be
Submitted to Rent Officer.
(1) Every notice of intention to
appeal to the appropriate Rent
Magistrate from the decision of
the appropriate Rent Officer shall
be as in Form 11 of the First
Schedule hereto.
(2) The form of the statement of
appeal referred to in section 12
(2) of the Act shall be as in Form
12 of the First Schedule hereto.
Regulation 15—Form of Rent Officer
Embodying Reason for Assessment of
Rent.
The form to be furnished by the
appropriate Rent Officer to the
appropriate Rent Magistrate
embodying his reasons for the
assessment of rent shall be as in
Form 13 of the First Schedule
hereto.
Regulation 16—Notices of Hearing
to be Served by Rent Magistrate.
As soon as may be practicable
after the receipt by a Rent
Magistrate of Form 13, he shall
serve the landlord, tenant and any
other person interested in the
premises concerned referred to in
that Form, notices of hearing as
in Form 3 of the First Schedule
hereto.
Regulation 17—Minister’s
Assessment Under Section 13 of Act
to Prevail.
Subject to the provisions of the
Act, every assessment made by the
Minister and applicable to any
premises shall be the assessment
for such premises, in lieu of any
previous assessment made by any
person or authority.
PART III—OTHER MATTERS CONNECTED
WITH OR RELATING TO A RENT OFFICER
OR RENT MAGISTRATE
Regulation 18—Form to be Furnished
by Landlord for Purposes of
Section 17 of Act.
Where a landlord requires his
premises for the purposes of
section 17 (1) (g), (h), (i) or
(k), he shall furnish to the
appropriate Rent Officer a
declaration as in Form 14 of the
First Schedule hereto.
Regulation 19—Rent Officer, A
Public Officer for Purposes of
Act.
The Chief Rent Officer and every
appropriate Rent Officer furnished
with an identity card by the Chief
Rent Officer or any other person
authorised in that behalf by him
shall be deemed to be public
officers within the meaning of
section 3 (1) of the Criminal
Code, 1961 (Act 29).
Regulation 20—Imprisoned Tenants.
(1) Where the tenant of any
premises has been imprisoned and
there is no other resident
therein, the appropriate Rent
Officer shall communicate with him
through the Officer in Charge of
his prison and request him—
(a) to appoint some responsible
person to look after such premises
and his belongings and pay rent at
the dates appointed in that
behalf; or
(b) to terminate the tenancy and
to appoint some responsible person
to take custody of his belongings
and to pay any arrears of rent.
(2) The tenant shall, within
fourteen days of such request,
comply with its terms.
(3) If the tenant fails to comply
with such request within the said
period of fourteen days, the
appropriate Rent Officer shall
apply to the appropriate Rent
Magistrate for an order providing
for all or any of the following
matters:—
(a) to force open the doors of
his premises;
(b) to enable his landlord or some
other responsible person specified
by the Magistrate to take custody
of his belongings;
(c) to enable the sale of such
belongings; and
(d) to utilize the proceeds of
such sale in the payment of the
expenses connected with the sale
and of any arrears of rent.
(4) The appropriate Rent Officer
shall as soon as may be
practicable after the receipt by
him of such order carry out its
terms.
Regulation 21—Form of Rent Officer
to Landlord Relating to Compliance
with Act.
Every notice of the appropriate
Rent Officer to a landlord
relating to his intention to
ascertain whether the landlord is
complying, with the provisions of
the Act shall be as in Form 15 of
the First Schedule hereto.
Regulation 22—Service of Orders,
etc., of Rent Magistrate on Rent
Officer, Etc.
Where the appropriate Rent
Magistrate makes an order,
assessment or other determination
or gives a direction for the
purposes of this Act or the
regulations, copies of such order,
assessment, determination or
direction shall be served on the
appropriate Rent Officer and on
interested parties, that is to
say, on the landlord, tenant or
any other person interested in the
premises.
PART IV—REFERENCES BY MINISTER
Regulation 23—Reference by
Minister to Rent Magistrate.
The Minister shall refer the
matter of the assessment of rent
to the appropriate Rent
Magistrate, if but only if—
(a) such matter has been dealt
with by the appropriate Rent
Officer;
(b) there has been no appeal from
the assessment of such officer;
and
(c) the Minister is dissatisfied
with such assessment.
Regulation 24—Reference by
Minister to Rent Officer.
Without prejudice to the
generality of the powers referred
to in section 5 (1) (c) of the
Act, the Minister may refer any
matter for the determination of
the appropriate Rent Officer if—
(a) such matter has not already
been dealt with by such an
officer, or
(b) such matter has been dealt
with by such an officer and the
Minister is dissatisfied with his
determination:
Provided that when the reference
is made under clause (b) of this
regulation, the reference shall be
made to another appropriate Rent
Officer.
PART V—REGISTERS, RETURNS, ETC.
Regulation 25—Rent Register.
The rent register shall contain
the particulars specified in the
Schedule to Form 5 of the First
Schedule hereto and such other
particulars as the Chief Rent
Officer for Ghana may require in
writing to be specified therein.
Regulation 26—Register of Vacant
Premises.
The register of vacant premises
referred to in section 5 (1) (e)
of the Act shall be as in Form 16
of the First Schedule hereto.
Regulation 27—Register of
Prospective Tenants.
Every appropriate Rent Officer
shall maintain, in respect of the
area for which he has been
appointed, a register of
prospective tenants for premises
in such area as in Form 17 of the
First Schedule hereto.
Regulation 28—Register of
Applications for Assessment of
Rents, Etc.
Every register of applications for
assessment of rents, for
apportionment of rates and for
other connected matters shall be
as in Form 18 of the First
Schedule hereto.
Regulation 29—Register of
Complaints.
Every register of complaints
received by the appropriate Rent
Officer shall be as in Form 19 of
the First Schedule hereto.
Regulation 30—Rent Docket.
The rent docket in respect of any
premises shall be as in Form 20 of
the First Schedule hereto.
Regulation 31—Complaint Docket.
The docket in respect of
complaints made to the appropriate
Rent Officer shall be as in Form
21 of the First Schedule hereto.
Regulation 32—Charge Book.
Every charge book maintained in
connection with charges made for
the purposes of the Act or these
regulations shall be as in Form 22
of the First Schedule hereto.
Regulation 33—Premises Record
Sheets.
Every appropriate Rent Officer
shall maintain two record sheets
in respect of any premises as in
Forms 23 and 24 of the First
Schedule hereto and enter therein
the particulars referred to in
those Forms.
Regulation 34—Rent Card.
The obverse side of every rent
card referred to in section 20 of
the Act shall be as in Form 25 of
the First Schedule hereto and the
reverse side of such card shall be
as in Form 26 of that Schedule.
Regulation 35—Returns.
Every appropriate Rent Officer
shall send the Minister within ten
days after the end of each month,
monthly returns as in Forms 27,
28, 29 and 30, for such month,
with the blank spaces therein duly
supplied.
PART VI—MISCELLANEOUS
Regulation 36—Prescribed Form for
Purposes of Section 19 of Act.
The prescribed form for the
purposes of section 19 of the Act
shall be as in Form 31 of the
First Schedule hereto.
Regulation 37—Prescribed Period
for Purposes of Section 21 of Act.
The prescribed period for the
purposes of section 21 of Act
shall be—
(a) the period agreed upon by the
landlord and the tenant when
approval to make the improvements
was granted by the landlord; and
(b) where no such period has been
agreed upon, five years from the
completion of the last
improvements made by the tenant,
which in the opinion of the
appropriate Rent Officer were
major improvements.
Regulation 38—Summons, Etc.
(1) The summons for a witness
shall be as in Form 32 of the
First Schedule hereto.
(2) The summons for a person
against whom a complaint has been
made shall be as in Form 33 of the
First Schedule hereto.
(3) The notice to produce
documents shall be as in Form 34
of the First Schedule hereto.
(4) Every person summoned to
appear before the appropriate Rent
Officer or Rent Magistrate shall
appear before such officer or
Magistrate at the date, time, and
place specified in the summons.
(5) Any person who contravenes the
provision of subsection (4) shall
be guilty of an offence and shall
be liable upon conviction by the
appropriate Rent Magistrate to a
fine not exceeding one hundred
pounds or to imprisonment for a
term not exceeding 6 months or to
both such fine and imprisonment.
Regulation 39—Evidence.
(1) Every witness shall be
examined first by the party
summoning him.
(2) Every witness may, after the
examination referred to in
paragraph (1), be cross examined
by the party opposing him in the
proceedings.
(3) After the cross-examination
referred to in paragraph (2), the
party summoning the witness shall
have the right to re-examine him,
if any new fact arises out of such
cross-examination or in
explanation of any part of his
cross-examination; but the
re-examination must be strictly
confined to matters arising out of
the cross-examination.
(4) After re-examination, no
further questions shall be asked
of the witness, except by leave of
or through the appropriate Rent
Officer or Rent Magistrate; but
such officer or Magistrate shall
have the right at any stage of the
proceedings to put all such
questions to any witness as may be
necessary in order to elicit all
the facts of the case.
(5) The appropriate Rent Officer
or Magistrate may at any time
recall a witness for further
questioning.
(6) When any document is produced
before the appropriate Rent
Officer or Magistrate, it shall be
read and admitted as evidence, if
relevant and it appears to such
officer or Magistrate to be a
genuine document.
(7) Every witness shall be
examined on oath or affirmation.
Regulation 40—Hearing.
(1) If at any hearing of an
application or appeal, the
applicant or appellant appears but
the other party does not appear,
the appropriate Rent Officer or
Magistrate shall, before hearing
such application or appeal,
inquire into the question whether
the other party to such
application or appeal has been
duly notified in respect of the
matter of the day, time and place
of the bearing of such
application. Such officer or
Magistrate, if he is satisfied
that the application or appeal has
not been duly notified, may
adjourn the hearing to permit the
necessary notification; but if,
satisfied as to due notification,
may proceed to hear such
application or appeal,
notwithstanding the absence of
such other party.
(2) If at the hearing of such
application or appeal, such other
party appears and opposes such
application or appeal but the
applicant does not appear, the
appropriate Rent Officer or
Magistrate may dismiss or adjourn
the hearing of such application or
appeal.
Regulation 41—Joinder of
Applications and Appeals.
Where two or more applications or
appeals relate to the same
premises, the appropriate Rent
Officer or Magistrate may join
such applications or appeals.
Regulation 42—Fees.
The fee specified in an entry in
column 2 of the Second Schedule
hereto shall be the fee in respect
of the matter relating to appeals
to Rent Magistrates specified in
the corresponding entry in column
1 of that Schedule.
Regulation 43—Deviations in Form.
(1) Where a form delivered or sent
to any person for the purposes of
these regulations deviates
materially from the appropriate
form set out in the First Schedule
hereto, such person shall refuse
to accept the first-mentioned form
and request a fresh form to be
delivered or sent.
(2) If a time limit is prescribed
by the Act or by these regulations
for the delivery or sending of
such form, the fresh form shall be
sent within the appropriate
period. In the computation of such
period, no remission shall be
granted for the delay caused by
the delivering or sending of the
improper form.
(3) If any person finds any
difficulty in filling up any
particulars to be specified in any
Form set out in the First Schedule
hereto, he may secure the relevant
information from the appropriate
Rent Officer.
Regulation 44—Protection for Acts
Done in Good Faith.
No suit or other legal proceeding
shall be made against any officer
or person in respect of anything
which is done in good in good
faith by him for the purposes of
the Act or of any regulations made
thereunder.
Regulation 45—Interpretation.
In this Act, unless the context
otherwise requires
“Act” means the Rent Act, 1963
(Act 220);
“Clerk to the Council” includes
the Town Clerk of a City or
Municipal Council; and
“Council” shall have the same
meaning as in the Local Government
Act, 1961 (Act 54).
Regulation 46—Date of
Commencement.
These Regulations shall come into
force on the first day of October,
1964.
