IN exercise of the powers
conferred upon the Electoral
Commissioner by the provisions of
article 43 of the Constitution,
these Regulations are hereby made
this 6th day of August, 1970.
Regulation 1—Issue of Summons.
First Sch.
Form A.
(1) Whenever there is occasion to
conduct the election of a
President, the presiding officer
shall issue a summons, in the Form
A set out in the First Schedule to
these Regulations, commanding each
member of the presidential
electoral college to a meeting of
that college.
(2) The summons shall specify,
(a) the day on which the poll
shall be taken; and
(b) the place and the day for the
nomination of candidates which
shall not be earlier than the day
on which the poll is to be taken.
(3) The summons shall be served
personally on each member of the
presidential electoral college not
later than seven days before the
day on which the poll shall be
taken.
(4) The presiding officer shall,
so soon after the issue of the
summons under the provisions of
sub-regulation (1) of this
regulation, publish a notice in
the Gazette stating that the
summons has been issued and
specifying the day and the place
for the nomination of candidates
and the day on which the poll is
to be taken.
Regulation 2—Nominations.
Second Sch.
Form B
(1) The nomination of a candidate
for the election of a President
shall be in the Form B set out in
the Second Schedule to these
Regulations.
(2) A member of the presidential
electoral college shall be
entitled to nominate not more than
one candidate.
(3) A candidate for election as
President shall, at the time of
his nomination,

(a) deliver or cause to be
delivered to the presiding officer
a statutory declaration in the
Form C set out in the Second
Schedule to these Regulations; and
(b) deposit or cause to be
deposited with the presiding
officer the sum of five hundred
new cedis.
(4) Whenever the nomination paper
and the statutory declaration of a
candidate are delivered and the
deposit is made in accordance with
the provisions of these
Regulations the candidate shall be
deemed to be nominated unless and
until proof is given to the
satisfaction of the presiding
officer of the candidate's death
or the candidate withdraws before
the ballot is ordered to be taken.
(5) The presiding officer shall be
entitled to inform a candidate
that his nomination paper is not
valid on any one of the following
grounds, that is to say,
(a) that the provisions of clause
(1) of article 41 of the
Constitution have not been
complied with;
(b) that the nomination paper is
not subscribed as required by law,
and allow the candidate or his
accredited representative an
opportunity to make any amendment
or alteration that the candidate
deems necessary.
(6) Where he decides pursuant to
the provisions of the immediately
preceding sub-regulation that the
nomination paper of a candidate is
not valid, the presiding officer
shall endorse and sign on the
nomination paper the fact of, and
the reasons for, his decision and
inform the Electoral Commissioner
accordingly who shall determine
the validity of any such
nomination for the purposes of the
election to which it relates.
(7) Nothing in this regulation
shall prevent the validity of a
nomination being questioned
pursuant to the provisions of
article 42 of the Constitution.
Second Schedule
Form D.
(8) Before the ballot is ordered
to be taken the presiding officer,
the candidate, if present, and two
of the members who subscribed to
the nomination of the candidate
shall sign a declaration, in the
Form D set out in the Second
Schedule to these Regulations, to
the effect that before the ballot
was ordered to be taken the
nomination of the candidate had
been presented to, and received
by, the presiding officer who
shall state in the declaration the
time at which each nomination was
received by him and the time at
which he accepted each nomination.
(9) Before the ballot is ordered
to be taken the presiding officer
shall read out all the nominations
received by him and shall cause
the nominations so received to be
exhibited in a conspicuous part of
the place at which the election is
to be conducted.
Second Sch.
Form E.
(10) The nominations shall be
exhibited in the Form E set out in
the Second Schedule to these
Regulations.
(11) Pursuant to the provisions of
clause (6) of article 41 of the
Constitution, the number of
members to form a quorum at any
meeting of the presidential
electoral college shall not be
less than one-half of the number
of the total membership of the
presidential electoral college.
Regulation 3—Withdrawal of
Candidate.
At any time before the ballot is
ordered to be taken a candidate
whose nomination paper has been
delivered to the presiding officer
may, by notice in writing signed
by him and delivered to the
presiding officer, withdraw his
candidature.
Regulation 4—Unopposed Candidate.
(1) Where before the ballot is
ordered to be taken only one
candidate stands duly nominated
the election shall be held; and
the candidate shall be declared
elected, pursuant to the
provisions of clause (6) of
article 41 of the Constitution, if
the number of votes cast in his
favour is not less than one-half
of the number of the total
membership of the presidential
electoral college.
(2) Where at a ballot taken
pursuant to the provisions of the
preceding sub-regulation the
number of votes cast in favour of
the candidate is less than
one-half of the number of the
total membership of the
presidential electoral college,
the election shall be declared
void and the presiding officer
shall adjourn the meeting for not
more than seven days, exclusive of
the days on which and to which the
meeting is so adjourned, for the
nomination of candidates for the
election of the President and he
shall so inform the presidential
electoral college and the
provisions of Regulation 2 of
these Regulations shall apply.
Regulation 5—Ballot Papers.
(1) The vote at the poll for the
election of the President shall be
given by ballot and the ballot of
every member of the presidential
electoral college shall consist of
a ballot paper.
(2) Every ballot paper shall,
(a) be capable of being folded up;
(b) have a number printed on it;
and
(c) have attached to it a
counterfoil with the same number
printed thereon.
(3) Each member of the
presidential electoral college
shall be entitled to a single vote
for each ballot for the election
of the President.
Regulation 6—Sealing of Ballot
Boxes.
(1) Immediately before the ballot
is ordered to be taken the
presiding officer shall show the
ballot boxes empty to the members
of the presidential electoral
college so that they may see that
the ballot boxes are empty and
shall then,
(a) close the ballot boxes and
place his seal upon them in such a
manner as to prevent their being
opened without breaking the seal;
and
(b) place one in his view and in
the view of the members of the
presidential electoral college for
the receipt of ballot papers.
(2) Not more than one ballot box
shall be used at any one time for
the receipt of ballot papers.
Regulation 7—Procedure of Voting.
(1) Immediately before a ballot
paper is delivered to a member of
the presidential electoral
college,
(a) the ballot paper shall be
perforated or stamped with an
official mark selected by the
presiding officer;
(b) the number and name of the
member as stated in the copy of
the register of members of the
presidential electoral college
shall be called out;
(c) [As deleted by the
Presidential Elections (Amendment)
Regulation, 1970 (CI 11)].;
(d) a mark shall be placed in the
copy of the register of members
against the number of the member
to denote that a ballot paper has
been received, without showing the
particular ballot paper which has
been received; and
(e) a mark which shall so far as
possible be permanent, shall be
made on the left hand of the
member in such manner as the
Electoral Commissioner shall
determine to indicate that the
member has been issued with a
ballot paper.
(2) A member of the presidential
electoral college on receiving a
ballot paper at the election of a
President, shall forthwith proceed
to the place set aside for the
marking of the ballot paper and
shall there secretly write on the
ballot paper the name of the
candidate for whom he wishes to
vote.
(3) The member shall then fold up
the ballot paper so as to conceal
his vote and shall immediately
proceed to put the ballot paper so
folded into the ballot box in the
presence of the presiding officer
and the other members of the
presidential electoral college.
(4) A member who has inadvertently
spoilt his ballot paper in such a
manner that it cannot be
conveniently used as a ballot
paper may, on delivering it to the
presiding officer and proving to
his satisfaction the fact of the
inadvertence, obtain another
ballot paper in place of the
ballot paper so delivered; and the
spoilt ballot paper shall be
immediately cancelled and the
counterfoil marked accordingly.
(5) Subject to the provisions of
clauses (6), (7) and (8) of
article 41 of the Constitution,
and exclusive of the ballots taken
under any such provision, where at
the election of the President no
candidate is declared elected
after five ballots the election
shall be adjourned by the
presiding officer for not more
than two days, exclusive of the
days on which and to which it is
adjourned and at any such
adjourned election as many ballots
shall be taken as shall result in
the election of a candidate as the
President.
Regulation 8—Procedure on Close of
Poll.
(1) Immediately after the close of
the poll the presiding officer
shall, in the presence of the
members of the presidential
electoral college, proceed to
count the ballot papers and record
the total number of votes cast in
favour of each candidate.

(2) The presiding officer shall
then sign a declaration in the
Form F set out in the Third
Schedule to these Regulations,
stating,
(a) the total number of members of
the presidential electoral
college,
(b) the total number of the
members thereof present at the
election, and
(c) the number of votes cast in
favour of each candidate,
and the presiding officer shall
there and then announce the
results of the election.
(3) A candidate or a member of the
presidential electoral college may
require the presiding officer to
have the votes recounted or again
recounted but the presiding
officer may refuse so to do if in
his opinion the request is
unreasonable.
(4) On the completion of the
counting or of any recount of the
votes a candidate or a member of
the presidential electoral college
present shall be given a
reasonable opportunity to exercise
the right conferred by the
provisions of the immediately
preceding sub-regulation.
(5) As soon as practicable after
the announcement of the results of
the poll, the presiding officer
shall, in the presence of the
members of the presidential
electoral college cause to be made
up into separate packets, sealed
with his own seal, the counted,
unused and spoilt and rejected
ballot papers, the counterfoils of
the ballot papers and the ballot
papers account and forward the
same to the Electoral Commissioner
for disposal.
(6) Any ballot paper,
(a) which does not bear the
official mark, or
(b) on which anything is written
or marked by which a member can be
identified except the name of the
candidate and the printed number,
or
(c) which is not marked or which
is void for uncertainty.
shall, subject to the provisions
of sub-regulation (7) of this
regulation be void and not
counted.
(7) Before rejecting a ballot
paper as void, the presiding
officer shall take all proper
precautions to prevent any person
from seeing the number printed
thereon, and with the number so
concealed, show the paper to each
candidate or one of the members
who subscribed to his nomination
and give him an opportunity to
express an opinion thereon.
(8) The presiding officer shall
endorse the word "rejected" on any
ballot paper which under the
provisions of this regulation is
not to be counted and shall add to
the endorsement the words
"rejection objected to" if an
objection is made to his decision
by a candidate or any one of the
members who subscribed to his
nomination.
Third Sch. Form G.
(9) The presiding officer shall
draw up a statement in the Form G
set out in the Third Schedule to
these Regulations showing the
number of ballot papers rejected
under the following heads:
(a) want of official mark,
(b) voting for more than one
candidate,
(c) writing or mark by which a
member of the presidential
electorate college could he
identified, and
(d) unmarked or void for
uncertainty,
and any candidate or one of the
members who subscribed to his
nomination may copy the statement.
(10) The decision of the presiding
officer on any question arising in
respect of a ballot paper shall be
final, but shall be subject to
review on a petition presented to
the Supreme Court pursuant to the
provisions of clause (1) of
article 42 of the Constitution.
(11) The presiding officer shall,
as soon as practicable after the
announcement of the results of the
election pursuant to the
provisions of sub-regulation (2)
of this regulation,
(a) inform the Prime Minister of
the name and particulars of the
person who has been elected as
President; and
(b) cause to be published in the
Gazette a notice stating the name
of the person elected and the
total number of votes cast in
favour of each candidate.
Regulation 9—Disposal of
Documents.
(1) The Electoral Commissioner
shall retain for a period of one
year all documents forwarded to
him pursuant to the provisions of
sub-regulation (5) of Regulation 8
of these Regulations and shall
then, unless otherwise directed by
the Supreme Court cause them to be
destroyed.
(2) Documents relating to the
election of a President in respect
of which legal proceedings have
been started shall not be
destroyed until the proceedings
have been finally disposed of.
Regulation 10—Declaration of
Secrecy.
Third Sch.
Form H.
Before the ballot is ordered to be
taken, a declaration of secrecy in
the Form H set out in the Third
Schedule to these Regulations
shall be made by,
(a) the presiding officer;
(b) any other person appointed by
the presiding officer to assist
him,
(c) all the members of the
presidential electoral college
present and voting; and
(d) every candidate attending, or
any person permitted by the
presiding officer to attend, at
the meeting for the election of
the President.
Regulation 11—Disposal of Deposit.
(1) Subject to the provisions of
this regulation, a deposit made
under the provisions of paragraph
(b) of sub-regulation (3) of
Regulation 2 of these Regulations
shall as soon as practicable after
the result of the election is
declared be returned to the person
making it or to the personal
representative of the candidate.
(2) Where a candidate who has been
duly nominated dies before the
ballot is ordered to be taken his
deposit shall be returned as soon
as practicable after the
publication of the results of the
election to the person making it
or to the personal representative
of the candidate.
(3) Where a ballot is taken and
after the completion of the
counting of the votes by the
residing officer including any
recount it is found that the
number of votes cast in favour of
a candidate is not more than
one-third of the number of the
total membership of the
presidential electoral college the
deposit of any such candidate
shall be forfeited and paid into
the Consolidated Fund.
Regulation 12—Election of
Representatives of the Houses of
Chiefs.
(1) For the purposes of the
election of the three Chiefs who
are members of the House of Chiefs
of a Region, to serve as members
of the presidential electoral
college, the President of the
House of Chiefs of the Region
shall issue a notice to each
member of the House of Chiefs of
the Region.
(2) The notice shall specify,
(a) the day on which the poll
shall be taken; and
(b) the place and the day for the
nomination of candidates which
shall not be more than seven days
before the day on which the poll
is to be taken.
(3) The notice shall be sent so as
to reach each member of the House
of Chiefs not later than fourteen
days before the day on which the
poll is to be taken and in
addition the notice may, subject
to the provisions of this
regulation, be communicated to the
members of the House of Chiefs by
publication in the press.
(4) A copy of the notice shall be
forwarded to the Electoral
Commissioner so as to reach him
not later than four days before
the meeting to which it relates
and the Electoral Commissioner or
a representative of the Electoral
Commissioner duly appointed by him
in writing in that behalf shall be
present at such meeting.
(5) The President of the House
shall preside at the meeting of
the House of Chiefs required to be
held pursuant to the provisions of
this regulation and where the
President himself is standing as a
candidate at the election, a
member appointed by the members of
the House present at the meeting
shall preside at the meeting.
(6) Nominations shall be indicated
at the meeting and each member of
the House shall be entitled to
nominate three Chiefs who are
members of the House.
(7) Subject to the provisions of
these Regulations, proceedings at
the meeting shall be conducted in
accordance with the standing
orders, bye-laws, rules or
regulations, regulating the
election of officers by the House
of Chiefs.
(8) Where there is no quorum at
any such meeting a further meeting
of the House shall be called by
the issue of a fresh notice and
the provisions of these
Regulations shall apply
accordingly.
(9) The Electoral Commissioner or
his representative at the meeting
shall ensure that the provisions
of these Regulations are duly
complied with in relation to the
election.
(10) The President or the member
presiding at the meeting shall
declare the result of the election
at that meeting and the results
shall be authenticated by the
signatures of the person presiding
and the Electoral Commissioner or
his representative and such
representative shall be given two
copies of the statement of the
results.
Regulation 13—Election of the
Representatives of the District
Councils.
(1) For the purposes of the
election of members of the
District Councils in a Region to
serve as members of the
presidential electoral college,
all the District Councils in the
Region shall, at a joint meeting
held for that purpose elect
fifteen members to the
presidential electoral college.
(2) No person shall be elected as
a member of the presidential
electoral college under the
provisions of this regulation who
is not qualified to be elected as
a member of the National Assembly.
(3) The provisions of Regulation
12 of these Regulations shall
apply to any joint meeting of the
District Councils in a Region with
such modifications as may be
determined by the Electoral
Commissioner.
(4) The Electoral Commissioner or
his representative appointed in
that behalf in writing by the
Electoral Commissioner shall
preside at any joint meeting of
all the District Councils in the
Region for the purposes of
electing the representatives of
the District Councils in the
Region to the presidential
electoral college.
Regulation 14—Functions of
Electoral Commissioner.
(1) Subject to the provisions of
articles 40 and 41of the
Constitution, the Electoral
Commissioner shall exercise
general supervision over the
elections required to be held
under the provisions of these
Regulations and may in particular
and notwithstanding any other
provision of these Regulations
attend or cause his duly appointed
representative to attend any
proceedings to which the
provisions of these Regulations
apply.
(2) The Electoral Commissioner
shall take all steps that appear
to him to be necessary for
ensuring, subject to the
provisions of articles 40 and 41
of the Constitution, that the
presidential electoral college is
duly constituted and for the
purposes of securing that the
provisions and principles of these
Regulations are given effect to.
(3) Pursuant to the provisions of
the immediately proceeding
sub-regulation the Electoral
Commissioner may,
(a) give such directions, and
(b) make such modifications or
administratively apply such
modifications, as may appear to
him to be necessary to give effect
to the provisions and principles
of these Regulations.
(4) The Electoral Commissioner
shall as soon as possible upon
receipt by him of the results of
the election of any member of the
presidential electoral college
under the provisions of these
Regulations cause the results to
be published in the Gazette and
also notify the Clerk to the
National Assembly of the said
results.
(5) The Electoral Commissioner
shall have power to request from
any person any information or any
other assistance reasonably
required by him for the purposes
of any matter to which these
Regulations relate.
(6) It shall be the duty of all
persons to give such assistance as
may be requested from them by the
Electoral Commissioner for the
purposes of coming into effect the
provisions and principles of these
Regulations.
Regulation 15—Standing Orders of
National Assembly.
Save as otherwise provided in
these Regulations the Standing
Orders of the National Assembly
shall, mutatis mutandis, apply to
the election of a President under
the provisions of these
Regulations.
Regulation 16—Commencement.
These Regulations shall come into
force on the 27th day of August,
1970, pursuant to the provisions
of paragraph (b) of article 126 of
the Constitution.
