IN exercise of the powers
conferred on the Minister
responsible for Transport and
Communications by section 33 of
the Road Traffic Ordinance, 1952
(No. 55) these Regulations are
made this 27th day of February,
1995.
Regulation 1—Section 4 of L.I. 953
Amended.
The Road Traffic Regulations, 1974
(L.I. 953) referred to in these
Regulations as the "principal
enactment" is amended by the
revocation of regulation 4 and the
insertion of the following new
regulation—
"4. Registration of Vehicles.
(1) Subject to the provisions of
this regulation, on receipt of the
application and the prescribed fee
the licensing authority shall
register the particulars of the
vehicle.
(2) The licensing authority shall
not register a vehicle—
(a) which does not comply in all
respects with the provisions of
these Regulations applicable to
its particular type or class;
(b) whose use on any road is
prohibited by any law;
(c) in respect of which a valid
certificate of roadworthiness is
not produced to him; or
(d) the owner of which does not
reside permanently in the region
in which the application is made.
(3) The licensing authority shall
not register a right-hand steering
vehicle.
(4) In the case of a commercial
vehicle the licensing authority
may, if he thinks fit, require the
production of the manufacturer's
specification or such other
evidence as he may require to
enable him ascertain whether the
freight or load which the vehicle
is constructed to carry is as
stated in the form of application
and in the case of a vehicle with
locally constructed body, may
determine the freight or load
which the vehicle is constructed
to carry.
(5) Commercial vehicles used
exclusively for carrying the
personal effects of the owner,
tractors or breakdown lorries
shall not be regarded as load
carrying vehicles and shall be
licensed according to their net
weights as if the weights were
their gross weights".
Regulation 2—New Regulation 4A
Inserted in Principal Enactment.
The principal enactment is amended
by the insertion after regulation
4 of the following new regulation—
"4A. Vehicle Registration
Certificate.
(1) Upon the registration of a
vehicle under these Regulations,
the licensing authority shall
issue in respect of the vehicle a
Vehicle Registration Certificate (V.R.C.)
containing the following—
(a) the name and address of the
owner;
(b) the date and place of
registration;
(c) the particulars of the
vehicle;
(d) particulars of roadworthiness
certificate and date of its
expiry; and
(e) such other particulars as the
licensing authority may specify
therein.
(2) A vehicle Registration
Certificate issued under paragraph
(1) shall be carried on the
vehicle whilst it is on the road".
Regulation 3—Paragraph of
Principal Enactment Substituted.
The principal enactment is amended
by the revocation of regulation 5
and the insertion of the
following—
"5. Identification Number Plates.
(1) On registering a motor vehicle
the licensing authority shall
assign to it an identification
mark which shall be registered in
respect of the vehicle.
(2) The identification mark shall
be a combination of letters and
figures allocated to the licensing
authority by the Principal
Licensing Authority.
(3) Where an applicant requests
that a particular identification
mark be assigned to a vehicle, the
licensing authority shall, subject
to these Regulations, assign the
identification mark on payment by
the applicant of the relevant fee
specified for the purpose in the
Fourth Schedule.
(4) The identification mark shall
be carried by the vehicle on two
plates which shall conform to the
requirements of the Second
Schedule.
(5) Number plates on vehicles
shall be legible at night and in
clear weather and must be visible
and recognized at a distance of
not less than 60 metres by the
driver of the immediate following
vehicle.
(6) The plates displaying the
identification mark shall be fixed
on a motor vehicle, one on the
front and the other at the rear,
and on a trailer, one on the rear,
so that every letter or figure on
the plate is upright and easily
distinguishable in the case of the
front plate in front, and in the
case of the rear plate from
behind.
(7) When a vehicle is towing a
trailer, an additional plate
displaying the identification mark
of the towing vehicle shall be
fixed on the rear of the trailer
in addition to the plate
displaying the identification mark
of the trailer.
(8) In the case of a motor-cycle
the plate fixed on the front of
the cycle may, if it is a plate
with duplicate faces conforming
with the Second Schedule, be fixed
so that from whichever side the
cycle is viewed the letters or
figures on one or other face of
the plate are easily
distinguishable though they may
not be distinguishable from the
front of the cycle".
Regulation 4—New Regulation 5A
inserted in Principal Enactment.
The principal enactment is amended
by the insertion after regulation
5 of the following new regulation—
"5A. Registration of Number Plates
Manufacturers and Embossers of
Vehicle Registration Numbers.
(1) Any enterprise or person
engaged in the business of—
(a) manufacturing metal plates for
vehicle registration numbers; or
(b) embossing registration numbers
on number plates for vehicles
shall apply to be registered with
the licensing authority in the
region where the business is
operated upon such conditions as
the licensing authority shall
determine.
(2) Upon the registration the
licensing authority shall in the
case of an enterprise or person to
whom sub-regulation (1) (b)
applies issue the applicant a
trade mark submitted by the
applicant.
(3) No trade mark shal be issued
which is so similar to another
trade mark as to deceive or
confuse the public.
(4) Every enterprise or person
registered under sub-regulation
(1) (b) shall on embossing vehicle
registration numbers indicate on
the plates, as shall be directed
by the licensing authority, his
trade mark.
(5) Registration under paragraph
(1) of this regulation shall be in
addition to any other registration
required for the enterprise or
person under any other law".
Regulation 5—Regulation 7 of the
Principal Enactment Substituted.
The principal enactment is amended
by the revocation of regulation 7
and the insertion of the
following—
"7. Vehicle Lay-off.
(1) Where a vehicle registered
under regulation 4 and issued with
a V.R.C. under regulation 4A is
temporarily or permanently not in
use, the V.R.C in respect of the
vehicle shall be submitted to any
licensing officer who shall after
appropriate examination cancel the
V.R.C. and issue to the owner a
Laying-off Certificate (L.O.C.).
(2) Road charges in respect of a
vehicle for which a V.R.C. remains
uncancelled shall be payable by
the owner until the L.O.C. is
obtained.
(3) Where a vehicle is brought
back in use on the road after a
temporary lay-off without
cancellation of the V.R.C., all
outstanding road user charges in
respect of the vehicle shall
become payable.
(4) The licensing authority shall
provide a form for reporting
vehicles for lay-off.
(5) Notwithstanding the other
provisions of this regulation
where the licensing authority is
satisfied that a registered
vehicle has been destroyed or
permanently removed from Ghana, he
shall cancel the V.R.C. in respect
of the vehicle after a written
notice of not less than 90 days
has been given to the owner".
Regulation 6—Vehicles Seeking New
Registration.
Any vehicle submitted for
registration on and after the
coming into force of these
Regulations, shall be registered
in accordance with the provisions
of these Regulations.
Regulation 7—Re-registration of
Existing Registered Vehicles.
(1) Vehicles registered prior to
the coming into force of these
Regulations shall be submitted to
the licensing authority for
re-registration within 12 months
of the coming into force of these
Regulations.
(2) A person seeking to
re-register a vehicle under
paragraph (1) shall unless
exempted by any other law, submit
with the application—
(a) a valid roadworthiness
certificate on the vehicle;
(b) a valid insurance certificate
in respect of the vehicle; and
(c) a certified true copy of the
original technical particulars of
the vehicle.
(3) Except as provided in this
paragraph all the other provisions
applicable to first registration
of vehicles under these
Regulations shall apply to
re-registration of vehicles.
(4) Any person who after the
expiry of the re-registration
period provided under paragraph
(1) uses on the road a vehicle not
re-registered in accordance with
these Regulations commits an
offence and shall be liable on
conviction to a fine not exceeding
¢500,000 or imprisonment for a
term not exceeding 12 months or to
both.
Regulation 8—Offences and
Penalties.
(1) Subject to regulation 7 (1),
any person who uses on the road a
vehicle with number plates—
(a) that do not comply with the
provisions of these Regulations;
or
(b) that do not have embossed on
them the trade mark of the person
who embossed them
commits an offence and shall be
liable on conviction to a fine not
exceeding ¢500,000 or imprisonment
for a term not exceeding 12 months
or to both.
(2) Any enterprise or person who
not being registered with the
licensing authority—
(a) manufactures metal plates for
vehicle registration numbers; or
(b) embosses vehicle registration
numbers on metal plates
contrary to regulation 5A of this
regulation commits an offence and
is liable on conviction to a fine
not exceeding ¢500,000 or
imprisonment for a term not
exceeding 12 months or to both.
(3) Any person who fraudulently
uses a trade mark in embossing
vehicle number plates commits an
offence and is liable on
conviction to a fine not exceeding
¢500,000.00 or to imprisonment for
a term not exceeding 12 months or
to both.
Regulation 9—Second Schedule of
Principal Enactment Substituted.
The Second Schedule to the
principal enactment is hereby
revoked and the following Second
Schedule inserted—
"SECOND SCHEDULE
IDENTIFICATION NUMBER PLATES
(Regulation 5)
(1) The identification mark
registered in respect of a vehicle
shall be embossed on metal plate
consisting of 99 per cent
aluminium and laid with 95 per
cent silver reflective sheeting or
coating and of the thickness of 1
mm and hardness of Temper 14(H14).
(2) The inking of the number
plates shall be of chlorinated
rubber or "K" paint with hot
stamping or such other method as
the licensing authority may
prescribe.
(3) Number plates shall be
resistant to wear and tear.
(4) Each number plate shall be
rectangular or be of such shape as
the licensing authority may
direct.
(5) The number plates shall be
affixed one to the front and one
to the rear of the vehicle.
(6) Each region shall have a
different licensing code of
letters which shall form the
prefix of the registration number
of a vehicle registered in the
region.
(7) Each year shall be identified
by a different letter or a
combination of letters put at the
end of the numbers.
(8) All letters and figures must
be 8.9 cm. high; every part of
every letter and figure must be
1.58 cm. broad; and the total
width of the space taken by every
letter or figure, except in the
case of the figure "1", must be
6.35 cm.
(9) The space between adjoining
letters and between adjoining
figures must be 1.27 cm. and there
must be a margin between the
nearest part of any letter or
figure and the top and bottom of
the plate of at least 1.27 cm and
between the nearest part of any
letter or figure and the sides of
the plate of at least 2.54 cm.
(10) The national flag with the
letters "GH" shall be embossed in
the right-hand corner of the
number plates.
(11) In the case of the plates for
a motor-cycle each of the
dimensions mentioned above must be
halved, and the shape of the plate
need not to be rectangular so long
as the minimum margin between any
letter or figure and the top,
bottom and sides of the plate is
preserved.
(12) The number plates of the
vehicles specified in column A in
this paragraph shall have the
background colour and embossing
colour specified in relation to
them in column B and C

borders made of the same colour as
the embossing colour.

Regulation 10—Insertion of Fourth
Schedule on Fees and Charges.
(1) The principal enactment is
amended by the insertion of a
Fourth Schedule as provided
herein.
(2) The fees and charges specified
in the Fourth Schedule shall be
paid in respect of the matters
specified in relation to them and
accordingly the fees and charges
for the respective matters as
provided in the principal
enactment are amended as provided
in the Fourth Schedule.

Regulation 11—Interpretation.
In these Regulations unless the
context otherwise requires—
"L.O.C."
means Laying-Off Certificate;
"licensing authority" shall have
the same meaning as provided under
the Road Traffic Ordinance, 1952
(No. 55);
"motor vehicle" or "vehicle" shall
for the purposes of regulations 1
to 9 include motor cycles.
"V.R.C."
means Vehicle Registration
Certificate.
Regulation 12—Revocation.
The following legislative
instruments are revoked—
(a) the Road Traffic (Amendment)
Regulations, 1980 (L.I. 1242);
(b) the Road Traffic (Amendment)
Regulations, 1983 (L.I. 1287)
except paragraphs (n), (p) and
(s); and
(c) the Road Traffic (Amendment)
Regulations, 1994 (L.I. 1585).
