ROAD TRAFFIC (USE OF LIQUIFIED PETROLEUM GAS) REGULATIONS, 1994 (LI 1592).

 

IN exercise of the powers conferred on the Minister for Transport and Communications by section 33 of the Road Traffic Ordinance, 1952 (No. 55) these Regulations are made this 23rd day of June, 1994.

Regulation 1—Registration of L.P.G. Fitted Vehicles.

(1) Every motor vehicle fitted or manufactured to run on Liquified Petroleum Gas (L.P.G.) shall be registered  with the licensing authority.

(2) A person who owns or uses a motor vehicle fitted to run on L.P.G. shall apply for the registration of the motor vehicle with the licensing authority.

(3) The application shall be in such form and shall be accompanied by such particulars as  the licencing authority  shall determine.

(4) There shall be an examination of the motor vehicle which shall be conducted by the licencing authority to determine the suitability of the motor vehicle before registration under these Regulations.

Regulation 2—Certificate of Registration.

The licensing authority may after the examination issue a certificate of registration to the applicant.

Regulation 3—Numbering of Cylinder and Issue of Sticker.

(1) On registering a motor vehicle under these Regulations, the licencing authority shall—

(a) issue a number for the cylinder in the motor vehicle; and

(b) issue a sticker for the motor vehicle.

(2) A sticker issued under sub-regulation (1) shall bear the number on that L.P.G. cylinder in the  motor vehicle and  the sticker shall be fixed conspicuously on the windscreen of the motor vehicle.

(3) The sticker shall be renewed every six months but no sticker shall be renewed unless the licensing authority has examined the motor vehicle and approved the renewal.

Regulation 4—Use of Motor Vehicle Run on L.P.G.

No person shall drive or be in charge of a motor vehicle fitted or manufactured to run on—

(a) L.P.G., or

(b) L.P.G. and petrol; or

(c) L.P.G. and diesel

unless the motor vehicle has been registered under these Regulations.

Regulation 5—Licence for Installation of L.P.G. Cylinder in Motor Vehicles.

(1) No person shall operate a business for the purpose of enabling a motor vehicle to be run on—

(a) L.P.G., or

(b) L.P.G. and petrol; or

(c) L.P.G. and diesel

unless he has been issued with a licence for that purpose by the licensing authority.

(2) A person shall be considered as operating a business under sub-regulation (1) of this regulation and regulation 9 if as a body of persons, partnership, organisation or individual, he undertakes any commercial activity under these Regulations.

(3) An application for a licence for the purpose of sub-regulation (1) of this regulation shall be made to the licensing authority and shall be in such form and shall be accompanied by such particulars as the licensing authority shall determine.

(4) The licensing authority may issue the licence subject to such conditions as may be provided in the licence.

(5) A licence issued under sub-regulation (1) of this regulation shall be in the form of a certificate and shall be valid for twelve months from the date of issue and is renewable annually.

(6) The licence issued under this regulation shall be displayed in a conspicuous place on the premises where the installation, manufacture or conversion is carried on.

Regulation 6—Non-Transfer of L.P.G. Cylinder.

(1) No person shall transfer an L.P.G. cylinder in a motor vehicle licensed under these Regulations to another motor vehicle or replace the cylinder in a motor vehicle with another cylinder without the prior approval of the licensing authority.

(2) The approval of the licensing authority shall be in the form of a certificate which shall be valid for twelve months from the date of issue and is renewable annually.

Regulation 7—Fees.

The fees provided in the Schedule to these Regulations shall be payable in respect of the matters specified in relation to them.

Regulation 8—Offence and Penalties.

A person who—

(a) drives or is found in charge of an unregistered motor vehicle contrary to regulation 4; or

(b) operates a business of installing L.P.G. cylinders in motor vehicles or converts motor vehicles without a licence contrary to sub-regulation (1) of regulation 5; or

(c) transfers an L.P.G. cylinder without a licence contrary to regulation 6; or

(d) fails to exhibit a sticker or a licence issued under these Regulations

commits an offence and is liable on conviction to a fine not exceeding ¢500,000 or to a term of imprisonment not exceeding one year or to both.

Regulation 9—Transitional Provisions.

A person who on the coming into force of these Regulations—

(a) owns or uses  a motor vehicle fitted or manufactured to run on L.P.G., L.P.G. and petrol or L.P.G. and diesel; or

(b) operates a business for installing L.P.G. cylinders in motor vehicles

shall within two months of the coming into force of these Regulations apply to the licensing authority for the registration of the motor vehicle or the issue of the relevant licence.

Regulation 10—Interpretation.

In these Regulations unless the context otherwise requires—

“commercial activity" means the conversion process to enable a motor vehicle manufactured to run on petrol or diesel into a motor vehicle fitted to run on

(a) L.P.G., or

(b) L.P.G. and petrol, or

(c) L.P.G. and diesel.

“L.P.G.” means liquified petroleum gas;

“licensing authority”  means the Minister responsible or Transport and Communications.
