IN exercise of the powers
conferred on the Commissioner
responsible for Sports by section
42 of the Sports Decree, 1976 (S.M.C.D.
54) these Regulations are made
this 11th day of August, 1976.
PART I— AMATEUR SPORTS
ASSOCIATIONS
Regulation 1—National Sports
Associations.
A
national sports association of any
sport or group of sports shall
consist of—
(a) an Honorary Chairman and an
Honorary Vice-Chairman appointed
by the Commissioner responsible
for Sports (in these Regulations
referred to as “the Commissioner
") on the recommendation of the
Executive Chairman; and
(b) a full-time Executive
Secretary who shall be an officer
of the National Council nominated
by the Executive Chairman.
Regulation 2—Regional Sports
Associations
A
regional sports association shall
consist of an Honorary Chairman,
an Honorary Vice-Chairman and an
Honorary Secretary to be appointed
by the Chairman of the Regional
Sports Council of the Region.
Regulation 3—District Sports
Associations.
A
district sports association shall
consist or such persons associated
with the sport in question as the
District Sports Council may
appoint not being less than three
or more than five.
Regulation 4—Functions of Sports
Associations.
(1) Every sports association
national, regional or district
shall at its respective level—
(a) be responsible for the
promotion, encouragement and
development of that sport or group
of sports;
(b) advise the National Council in
the case of a national sport
association, the Regional Sports
Council in the case of a regional
sport association and the District
Sports Council in the case of a
district sport association as to
how best the particular sport or
group of sports can be developed;
(c) consider and report to the
National Council through the
appropriate body upon such matters
as may be of benefit to sports
development generally;
(d) carry out such other functions
as the National Council may assign
to it through the Executive
Chairman.
(2) Subject to the provisions of
these Regulations, every sport
association may regulate its own
procedure.
Regulation 5—Relationship between
National Regional and District
Sports Associations.
(1) A national sport association
of any sport or group of sports
may liaise with the regional or
district sport association of the
sport or group of sports
for the effective running of that
sport or group of sports.
(2) A national sport association
of any sport or group of sports
may give such directions as it
considers necessary to the
regional or district sport
association of that sport or group
of sports with respect to the
exercise by the regional or
district association of its
functions.
(3) A regional sport association
may exercise like powers in
respect of a district sport
association of the sport or group
of sports.
Regulation 6—Tenure of Office of
the Members of Sports
Associations.
(1) The members of sports
associations other than Executive
Secretaries of national sports
associations, shall hold office
for twelve months and shall be
eligible for re-appointment, so
however, that no such member shall
hold office for more than two
years in succession.
(2) Any authority responsible for
the appointment of any person to
serve on any sport association may
by writing remove that person from
that office upon stated grounds of
misconduct or inability to perform
the functions of his office.
Regulation 7—Continuation of
Existing Associations.
Any sport association whether
national, regional or district
existing immediately before the
commencement of these Regulations
shall, subject to the provisions
of these Regulations, continue to
exist as if it were a sport
association established under
these Regulations and the members
thereof duly appointed under these
Regulations.
Regulation 8—Application of this
Part
This Part applies only in respect
of amateur sports associations.
PART II—PROFESSIONAL SPORTS
ASSOCIATIONS
Regulation 9—Establishment of
Professional Sports Associations.
(1) The National Council may cause
to be established national
professional sports associations
as the National Council may
determine.
(2) A national professional sport
association shall comprise such
number of persons, appointed to
the association in such manner and
shall have such functions, as the
National Council may, with the
prior approval of the
Commissioner, determine.
(3) Every professional sport body
existing immediately before the
commencement of these Regulations
shall, subject to the provisions
of these Regulations, continue to
exist as if it were a professional
sport association established
under this Part of these
Regulations.
Regulation 10—Ghana Boxing
Authority.
(1) There shall be a body to be
known as the Ghana Boxing
Authority in these Regulations
referred to as "the Authority”.
(2) The Authority shall have the
status of a national professional
sport association.
Regulation 11—Functions of
Authority.
The Authority shall, subject to
the provisions of the Sports
Decree, 1976 (S.M.C.D. 54) and
these Regulations, be responsible
for—
(a) the development, control,
management and promotion of
professional boxing in Ghana; and
(b) such other functions relating
to professional boxing as the
Commissioner may assign to it.
Regulation 12—Membership of
Authority.
(1) The Authority shall comprise
the following persons:—
(a) a Chairman appointed by the
Commissioner;
(b) a full-time Executive
Secretary who shall be an officer
of the National Council nominated
by the Executive Chairman;
(c) an Honorary Treasurer
appointed by the Commissioner; and
(d) three members who shall be the
Chairmen of the three committees
of the Authority, namely the
Control, Management and Promotions
Committees.
(2) All persons to be appointed
members of the Authority shall be
persons who appear to the
Commissioner to have wide
knowledge or experience in
professional boxing.
Regulation 13—Terms of Office of
Members of Authority.
(1) The members of the Authority
shall hold office for a term of
twelve months and shall be
eligible for re-appointment, so
however, that no person shall hold
office for more than two years in
succession.
(2) Any member of the Authority,
other than the Executive
Secretary, may be removed from
office by the authority who
appointed him, by writing copied
to the Executive Secretary on
stated grounds of misconduct or
inability to perform the functions
of his office.
Regulation 14—Meetings of
Authority.
(1) The Authority shall ordinarily
meet at such times and places as
it may determine but shall meet at
least once in every month.
(2) The Chairman, may, and shall,
on the request in writing of not
less than five members of the
Authority call an extraordinary
meeting of the Authority at such
time and place as the Chairman may
determine.
(3) The Chairman shall, if
present, preside at every meeting
of the Authority and in his
absence, the members present at
the meeting shall elect one of
their number to preside at the
meeting.
(4) The quorum at any meeting of
the Authority shall be four.
(5) All questions proposed at any
meeting of the Authority shall be
determined by a single majority of
members present and voting, and in
the case of an equality of votes,
the Chairman or other person
presiding shall have a second or
casting vote.
(6) The Authority may co-opt any
person or persons to attend any
meeting of the Authority as an
adviser or advisers, so however,
that any person so co-opted shall
not be entitled to vote on any
matter for decision by the
Authority at that meeting.
(7) The validity of any
proceedings of the Authority shall
not be affected by any vacancy
among its members or any defect in
the appointment of any member.
(8) The Authority may, subject to
the other provisions of these
Regulations. regulate its own
procedure.
Regulation 15—Disclosure of
Interest.
Every member of the Authority who
has any interest in any enterprise
or undertaking which is concerned
with the promotion of any
professional sport which the
Authority is about to promote or
with which the Authority proposes
to enter into an agreement shall
disclose the nature of his
interest to the Authority and
shall neither participate in any
deliberations of the Authority,
nor vote on any issue relating to
such promotion or agreement.
Regulation 16—Committees of the
Authority.
(1) The Authority shall have three
committees, namely—
(a) the Control Committee which
shall comprise five members;
(b) the Management Committee which
shall comprise three members; and
(c) the Promotions Committee which
shall comprise five members.
(2) The members of each of these
committees shall be appointed by
the Commissioner on the advice of
the Executive Chairman from among
persons appearing to the
Commissioner to have wide
experience or knowledge in
professional boxing.
Regulation 17—Meetings of Control
Committee.
The Control Committee of the
Authority shall—
(a) Control and seek to enhance
professional boxing in Ghana
within or outside Ghana;
(b) be responsible in relation to
boxing in Ghana for boxing rules
and regulations whether Ghanaian
or otherwise:
(c) liaise with the African Boxing
Union and other recognized World
Boxing Bodies through the
Authority;
(d) maintain up-to-date records of
boxing promoters, managers,
seconds, stewards and other
officials;
(e) be responsible for the issuing
of ratings;
(f) sanction promotions (local,
national, or outside Ghana)
involving Ghanaians;
(g) guarantee and organise
training and upgrading of all
professional boxing officials.
Regulation 18—Duties of Management
Committee.
The Management Committee of the
Authority shall—
(a) manage selected boxers;
(b) arrange for training
facilities, namely, gymnasia and
equipment;
(c) ensure the employment of
qualified staff connected with
paragraph (b) of this regulation;
(d) sign all contracts on behalf
of and with the consent of boxers
they manage;
(e) arrange fights with Ghanaian
and foreign promoters of fights
for selected boxers with the
approval of the Control Committee
and the Authority.
Regulation 19—Duties of Promotions
Committee.
The Promotions Committee of the
Authority shall—
(a) organise boxing promotions;
(b) provide all estimates of
income and expenditure of all
promotions to the Authority for
approval and to submit accounts on
promotions to the Authority for
all tournaments within seven days
after the promotion;
(c) be responsible for contracts
for promotions organised by the
Promotions Committee and for all
other arrangements.
Regulation 20—Meetings of
Committees.
(1) Each of the three committees
of the Authority shall meet for
the despatch of its business at
such times and places as its
Chairman may decide.
(2) Subject to sub-regulation (1)
of this regulation and subject
also to any directions given by
the Authority, each such committee
may prescribe its own procedure.
Regulation 21—Functions of
Chairman of Authority.
(1) The Chairman of the Authority
shall co-ordinate all the
activities of the three committees
of the Authority.
(2) The Chairman shall be
responsible to the Commissioner
through the Executive Chairman for
the efficient discharge of the
functions of the Authority.
Regulation 22—Duties of Executive
Secretary to Authority.
(1) The Executive Secretary of the
Authority shall be responsible for
the day-to-day administration of
the affairs of the Authority and
for the due implementation of the
policy decisions of the Authority.
(2) The Executive Secretary shall
also perform such functions of the
Authority as the Authority may
direct.
Regulation 23—Duties of Honorary
Treasurer.
(1) The Honorary Treasurer of the
Authority shall be responsible for
the financial administration of
the Authority.
(2) The Honorary Treasurer shall
keep for the Authority proper
books of account and proper
records in relation thereto.
Regulation 24—Allowances for
Members of Authority and
Committees.
Members of the Authority and of
its committees may be paid such
allowances as the Commissioner and
the Commissioner responsible for
Finance may approve in relation to
them.
Regulation 25—Licences.
(1) No person shall act or
participate as a referee, boxer,
manager, inspector, match-maker,
promoter, trainer, time-keeper or
second at or with respect to any
professional boxing match or
tournament unless he first obtains
from the Authority a licence
allowing him so to do and pays the
fee prescribed by the Authority in
relation thereto.
(2) Any question as to whether or
not any person is acting or
participating as referred to in
sub-regulation (1) of this
regulation shall be determined by
the Authority.
(3) Any person who contravenes
sub-regulation (1) of this
regulation shall be guilty of an
offence and liable on summary
conviction, to a fine not
exceeding ¢1,000 or a term of
imprisonment not exceeding twelve
months or both.
Regulation 26—Boxers’ Welfare
Fund.
(1) There shall be established a
fund to be known as “Boxers’
Welfare Fund” for the purpose of
providing future security for
boxers.
(2) There shall be paid into the
Boxers' Welfare Fund in respect of
every professional boxing
promotion such sum as the
Commissioner may determine in
consultation with the Authority.
(3) The trustees of the Boxers'
Welfare Fund shall be the
Commissioner, the Executive
Chairman, the Chairman of the
Authority and a representative of
the body known as “the Ex-Boxers’
Association” and a leading
professional boxer nominated by
the Commissioner.
Regulation 27—Submission of
Estimates.
(1) Every national sport
association shall once in every
year at such time and in such form
as the National Council may
direct, submit to the National
Council for its approval a
statement of the
association's programme and
estimates of its income and
expenditure for that year
(2) Every such association shall
also prepare and submit to the
National Council once in every
three months, a statement of the
association's financial
transactions during the last
preceding three months.
(3) The National Council may,
subject to such modifications as
it may consider appropriate,
direct that regional and district
sports associations shall submit
respectively to the respective
Regional and District Sports
Councils the statements required
to be submitted by sub-regulations
(1) and (2) of this regulation.
Regulation 28—Sports Associations
to Account for Moneys Received.
(1) Every national sport
association shall, in such form
and at such times as the National
Council may specify, render to the
National Council through the
Executive Chairman proper accounts
of all moneys received by them.
(2) Regional and District sports
associations shall, subject to
such directions as may be given by
the National Council, render like
accounts to their respective
Regional or District Sports
Councils.
(3) The National Council may
direct that the accounts of any
sport association be audited
by an auditor specified by the
National Council.
Regulation 29—Power of National
Council to Give Directions or Take
Over.
(1) The National Council shall
exercise, generally, overall
supervision over all
national sports associations in
Ghana.
(2) The National Council may, with
the prior approval of the
Commissioner take over and manage
for such period as the
Commissioner may approve, the
affairs of any national sport
association if the National
Council is satisfied that it is
essential so to do in the best
interests of the sport or group of
sports concerned.
(3) Without prejudice to
sub-regulations (1) and (2) of
this regulation the National
Council may give to any national
sport association such directions
as it may consider reasonable in
the interests of the sport or
group of sports to which the
national sport association relates
and the national sport association
shall comply with such directions.
Regulation 30—Offences.
Any person who—
(a) contravenes any of the
provisions of regulations 27 and
28 of these Regulations;
(b) in any way obstructs the
carrying out of an audit directed
by the National Council under
sub-regulation (3) of regulation
28 of these Regulations;
(c) obstructs the take-over or
management by the National Council
of the affairs of a national sport
association under sub-regulation
(2) of regulation 29 of these
Regulations; or
(d) fails without reasonable cause
(proof of which shall be on him)
to comply with any directions
given by the National Council
under sub-regulation (3) of
regulation 29 shall be guilty of
an offence and liable on summary
conviction to a fine not exceeding
¢500.00.
Regulation 31—Interpretation.
In these Regulations, unless the
context otherwise requires—
“Authority” means the Ghana Boxing
Authority established under
regulation 10 of these
Regulations;
“Executive Chairman” means the
Chief Executive and Executive
Chairman of the National Council;
and
“National Council” means the
National Sports Council
established under the Sports
Decree, 1976 (S.M.C.D. 54).
Regulation 32—Commencement.
These Regulations shall be deemed
to have come into force at the
same time as the Sports Decree,
1976 (S.M.C.D. 54).
