IN pursuance of the Proclamation entitled "Proclamation for the constitution of a National Liberation Council for the administration of Ghana and for other matters connected therewith", published in Gazette No. 11 of Monday, 28th February, 1966, this Decree is hereby made:—

FRUIT INDUSTRY DECREE, 1969 (NLCD 356)

IN pursuance of the Proclamation entitled "Proclamation for the constitution of a National Liberation Council for the administration of Ghana and for other matters connected therewith", published in Gazette No. 11 of Monday, 28th February, 1966, this Decree is hereby made:—

Paragraph 1—Standard, Packing and Shipping.

All fruit intended for export shall be of such standard of quality as is prescribed by regulations and shall be packed and shipped in accordance with this Decree and the regulations.

Paragraph 2—Powers of Entry and Inspection.

For the purposes of this Decree every Inspector may at all reasonable times enter any premises in which fruit is kept or suspected of being kept for export and may examine any fruit or any part of such premises or any receptacle or package therein.

Paragraph 3—Duty of Inspector.

It shall be the duty of every Inspector to satisfy himself that fruit intended for export conforms to the standard of quality and is packed as prescribed by regulations.

Paragraph 4—Marking of Packages and Issue of Certificate.

On being satisfied that the requirements of paragraph 1 have been complied with the Inspector shall mark each package of fruit intended for export with a stamp or seal showing that the fruit in such package has been inspected and passed as fit for export by an Inspector and at the same time shall issue a certificate in the form prescribed by regulations.

Paragraph 5—Evidence.

A certificate shall be conclusive evidence that the requirements of this Decree and the regulations have been complied with.

Paragraph 6—Offences.

Any person who—

(a) exports or attempts to export fruit without first complying with all the requirements of this Decree and the regulations (other than regulations providing for the cleansing, maintenance or control of premises where fruit is stored or kept); or

(b) wilfully tampers with any package of fruit after the same has been certified fit for export; or

(c) obstructs, resists or hinders an Inspector in the lawful exercise of his powers or duties under this Decree; or

(d) contravenes any provision of this Decree or any regulation made thereunder, or who makes default in complying with any provisions with which he has a duty to comply;

shall be liable on conviction to a fine not exceeding two hundred new cedis and in default of payment to imprisonment not exceeding six months.

Paragraph 7—Power to make Regulations.

The Commissioner may by legislative instrument make Regulations in respect of all or any of the following matters:—

(a) the cleansing, maintenance and control of premises where fruit intended for export is to be stored or kept, and for the imposition of penalties for failure to clean or maintain the premises;

(b) methods of packing and standards of quality for the export of any fruit;

(c) the inspection, stamping or sealing and grant of certificates for export of fruit and generally controlling the export of fruit;

(d) the appointment of Inspectors and other persons to carry out the provisions of this Decree and any regulations made thereunder and investing them with powers necessary for the due execution of their duties and for giving effect to the purposes of this Decree;

(e) the form of an Inspector's Certificate to be issued under paragraph 4;

(f) the fees to be paid for any matter or thing done under any regulations under this Decree;

(g) any other matters for carrying out the principles and provisions of this Decree.

Paragraph 8—Interpretation.

In this Decree—

"Commissioner" means the Commissioner responsible for Agriculture;

The word "export" applies only to fruit exported for use or marketing outside Ghana;

"Fruit" means any fruit, nut or vegetable product, other than cocoa beans, to which this Decree shall be made to apply by regulations made hereunder;

"Inspector" means any person appointed by the Commissioner to exercise the powers of inspection of fruit under this Decree.

"Regulations" means regulations made under this Decree.

The following enactments as subsequently amended are hereby repealed:—
